The Articles Of Confederation And The Us Constitution

The Articles of Confederation was the first federal foundational laws of the United States. It was composed due to the conflicting views of the politicians at the time and the need to unite the States during the war. Its development and resoluteness had a sluggish inception due to some Americans uncertainties of the government’s substantial central power and property demands by States. The Articles of Confederation was finally sanctioned on March 1, 1781. Under the Articles, each States stayed autonomous, with Congress having the final say over disputes. Congress was also given the ability to make accords and agreements, uphold armies and currencies. The Articles of Confederation did best with territorial expansion in the West, thanks to the Ordinances that were written for the Articles and the benefits they had. However, under the Articles, the central government had no power to impose taxes and manage commerce, because of this the government was consistently short of funds. Despite the lack of funding, money was still required for the war effort, and Congress' meantime solution was to print nearly $250 million paper currency, this led to major inflation in the States. This deficit urged legislators to find a solution; the Constitution of 1787. Both the Articles and the Constitution worked to preserve a free government, different from the tyrannical rule they have experienced from the British Parliament. Also, both documents allowed states the power to manage mercantilism,

The Articles of Confederation was first written in 1777. It was passed by the Confederation of Congress. Congress decided that they needed a firm government to organize the states as a whole. At least that was their primary goal. Since each state had separates rules. The Articles of Confederation was later ratified by each state in 1781. It was “America’s first federal constitution” (Keene 138). The confederation had a few strengths but many weaknesses. The nation faced many economic and political issues that lead people to controversy.

The most significant issues that the United States had under the Articles of Confederation were: “managing the western expansion, foreign relations, and debt.” The first significant issue was with the western expansion as Americans relocated to the Nashville, western Pennsylvania, and Kentucky areas in mass numbers in the 1780s. The result of this meant that the areas were enhanced greatly that had western charters. At the time, the northern and southern areas (in the Appalachian Mountains and Mississippi River) had specific boundaries based on the original colonized charters which meant that the western area was the Pacific Ocean. The states that did not have part of the western area resented the condition and as a result, Maryland protested by not approving the Articles of Confederation unless the state of Virginia yielded its western land to the federal government which they did in 1784. However, their yielding was not without strings attached as they demanded that they be allowed to keep a small portion of the land reserve for their own use as a part of the deal which Congress had no choice but to accept. Eighteen years later in 1802, every state had yielded their western land to the federal government.

It all started after the Declaration of Independence during the time America was busy fighting the Revolutionary War, when Congress realized that they needed to form a plan to move forward and unite the thirteen states as a nation.

Rules would be the new topic of discussion at the end of the American Revolution amongst the newly formed Free states that won their independence from Britain. One huge question loomed over the Free states, how could they conduct a civilized way of living without another ruler such as the king of Britain here in America? There needed to be some sort of system that would generate a control to create a unified country. States were acting and conducting business as if each state was its own country and this left the America vulnerable on many fronts. Some of the main issues that surfaced were; How to divide powers between local and national governments? Which laws should be made, and by whom and who would enforce them? I will address some of the differences between the Constitution and The Articles of Confederation.

The Articles of Confederation became the first guiding principles of the original thirteen states. However, the weaknesses embedded in the articles became obvious, outweighing its positive impact and they were ratified in 1781. George Washington sated that the articles were "little more than a shadow without the substance."1 They limited the central government’s ability to work smoothly and adversely affected the economy. Lack of power left the government in dismay and they sought a fix to their problems without becoming a tyrannical monarchy. The founding fathers believed that replacing the articles with The Constitution was the best way to give the central government enough power to carry out its tasks. In 1787 delegates from all 13 states met in Pennsylvania to begin amending the articles. This process revealed many of the similarities and differences that were contained within The Articles of Confederation and The Constitution.

After fighting for our country against Great Britain in the American Revolution, the United States gained independence. We had to figure out how to govern ourselves since we would no longer be under the power of the monarch. The Articles of Confederation was the answer to our problems; even though it established a very weak central government and had many problems, it was our first constitution and our first step towards a solid government. Some of the problems with the Articles included that the Congress had no power to tax, no power to regulate commerce, no power to regulate domestic affairs, no power to enforce laws, and many more. The problems lead to troubles with the States which convinced the Continental Congress to create a convention of delegated people to revise them; this convention was called the Constitutional Convention. The Convention fixed these problems by throwing the Articles out altogether and creating a new Constitution.

The Articles of Confederation, which was considered the first constitution of the United States of America, and the US Constitution, which acts as the supreme law in the United States today, both are poles apart. In fact, it was only because of the weaknesses of the Articles that the present-day US Constitution was drafted. The Articles of Confederation or Articles was a written agreement which laid the guidelines for the functioning of the national government. It was drafted by the Continental Congress and sent to the thirteen original states for ratification in November 1777. Within a few years of its ratification, the Articles was subjected to severe criticism by the Founding Fathers of the United States. Problems with the document existed in plenty; the biggest issue being the fact that it left the national government at the mercy of states. Eventually, it was decided that this agreement had to be revised to suit the needs of the nation as a whole. The delegates at the Philadelphia Convention came to the conclusion that it was better to draft an entirely new constitution instead of revising the existing agreement, and thus came into existence the new US Constitution.

It established a “firm league of friendship” among the states, rather than a government “of the people” (Dye 66). When the Articles of Confederation were established the federal government lacked power, but most of the power was held within the states. “The Articles created a loose confederation of sovereign states and a weak central government, leaving most of the power with the state governments” (Primary Documents in American History). The Articles of Confederation failed, because they did not give Congress and the national government enough power. The Articles of Confederation formed a war-time confederation of states, with an extremely limited central government. The U.S. had just recently fought a war to stop such an oppressive rule of a strongly based government that overpowered the local government. One of the biggest breaking points for the Articles of Confederation was when Daniel Shays and 1,000 angry farmers broke into the courthouse because the farmers couldn’t pay the loans and were threatened to take loans away from them. Some of the other problems that led the Articles of Confederation to fail was; the states didn’t act immediately, the central government was designed very weak, each state had 1 vote, the document was nearly impossible to amend, the government couldn’t collect enough taxes to fund operations, states had their own currency, and the Confederation government couldn’t help settle the Revolutionary War debts.

    The Articles of Confederation created a government with virtually no power - it couldn’t enforce laws, pass tax laws, fund itself, or even get the states to work together. Basically, Congress was a weak government; it had much less power than the states themselves.

The Articles of Confederation were created so that each state would have a lot of freedom. The Articles would allow each state to have their own currency, judicial process, and laws. Each state would only be connected to the central government for common defense, the security of liberties, and the general welfare. Each state only had one vote in congress regardless of size and population. The country was becoming bankrupt because congress did not have the power to tax. Congress also did not have the power to regulate trade between other countries or even states. Congress could not enforce any acts they passed because their was no executive branch. There was no national court system which means that each state had to have their own court system. To add an amendment to the Articles of Confederation there had to be a unanimous vote. Laws required at 9/13 majority to pass. The Articles were weak and they did not provide

After the Constitutional Convention in 1787, the United States Government was reorganized under the Constitution. This gave the federal government far more power than did the Articles of Confederation, which invested power within the states. Basically, the Constitution created three branches of government (Executive, Judicial, and Legislative) which would work together to run the government. To make sure that there was an equal balance of power among the branches, a system of checks and balances was devised so that each branch could limit the power of the others. It is important to note that "the doctrine of separation of powers is not established by any constitutional provision [but] rather it emerges from he framers'

After the meetings in Mount Vernon and Annapolis, the founding fathers realized that they needed to change the Articles of Confederation for a completely new constitution. Before the Constitution was ratified in 1789 the Anti-Federalists opposed it because it jeopardized states rights, individual rights and the dream that stresses the idea that a country populated by few citizens involved in agriculture is the freest most equal society.

They did not trust strong governments, so the central government very little power (Murphy). There was no court system given to the national government so the states were in charge of it all, which meant complaints could not be filed against them (Brackemyre). One of the only powers the national government had was to declare war but they were not allowed to raise an army to fight it and it lacked a chief executive to conduct foreign affairs. The United States also had an ineffective legislative under the Articles of Confederation. Amendments that they wanted to be passed needed to be vote on unanimously and there had to be a nine out of thirteen vote to pass a law (Kelly). Each state also had only one despite their population. Under the Articles, the government did not have a stable economic system, lacked key central leadership and had an inefficient legislature.
