IMPOTENCY AS A GROUND FOR DIVORCE
Abstract
Introduction
Marriages are considered to be very pure bonding of a man and a woman. The concept of marriage has evolved for a very long time and no one can deny that it is the most mandatory ceremony that humans need to perform for the growth of human civilization. According to the one of the oldest religion of earth i.e., Hinduism , marriages are a sacred relationship of two opposite sexes. In religious texts of Hindu’s it is even mentioned that the bond of marriages are decided by God and no one has the right to break that bond, etc. But for the individual’s right , when two people who are tied in the bond of marriage are not able to further continue the relationship then they are provided with a few remedies under law to get out. The term ‘ Divorce’ legally means: “The legal separation of man and wife, effected, for cause, by the judgment of a court, and either totally dissolving the marriage relation, or suspending its effects so far as concerns the cohabitation of the parties.”
If anyone of the partners is facing problems in continuing the marriage then he/she can file a decree for divorce and if the court feels correct then the demand of divorce will be granted. There are many legal grounds on which ,a decree of divorce can be passed, such as adultery, child marriage, cruelty, marital rape, fraud, bigamy(not in muslims), desertion, etc. One of the ground for divorce under various statutes of law is ‘Impotency’. Marriage is the legally or formally recognized union of two people as partners in a personal relationship, usually a man and a woman. When we think of marriage we usually think of a man and a woman with children living happily ever after. Sometimes this is not the case in some marriages around the world. Usually there is some struggle and difficulties in marriages that could end in divorce. According to Weaver (2014), “In today’s world, divorce is a normative event, affecting approximately half of all marriages in the United States (U.S. Census Bureau, 2004.)” (p.39) This is quite a large number of divorces considering that there is millions of people that live in the United States. Divorce is not always the easiest solution when ending a
All things considered, divorce should not be a word that is commonly used. A man and woman should be married for all the right reasons, until one or both passes away. Divorce does not just harm the couple, but the children are affected as well. Some children turn to depression, cheating, drugs, and stealing while others are happy with the decision made by their parents. Hopefully as the years progress, divorce rates will
Often times there are couples that get married but have chosen not to stay with one another because of a difference in opinion, this is called divorce.
Marriage is supposed to be the best time that couples get to enjoy each other’s company. Unfortunately, not all marriages are meant to be and getting a divorce may be the best option for the spouses. Divorce does not only mean the dissolution of marriage. It also involves property division, child custody, child support and in some cases spousal support also referred to as alimony.
Divorce is defined as a judicial declaration dissolving a marriage in whole or in part, especially one that releases the marriage partners from all matrimonial obligation, according to Webster’s dictionary. Divorce itself can be viewed as a symbolic interaction perspective, how the interpretation of divorce has changed throughout the generations. During the 1920’s, marriage was associated with having a responsibility, a role that a wife had to uphold and a role that a husband had to commit to. These roles were demanded to be maintained because the norms were that women should marry, bear children, and do household chores while the man worked and provided for the family. Divorce, during that time period, was considered either illegal or a taboo.
What comes to your mind when you think of divorce? Divorce by definition is “the legal dissolution of a marriage by a court of law”. Getting a divorce is no easy decision as it affects many different aspects of life such as the dynamics of the two individuals, their loved one and mostly the children. Taken that into consideration, sadly the divorce rate in today’s society has been increasing throughout time.
Lack of sex can also lead to an affair, which is another one of the major reasons for divorce. This is something you cannot expect to do to your partner and get away with it. When you cheat your partner will find out sooner or later and they will not be happy about it. This can easily lead to a divorce and the last thing you want to do is destroy your marriage for a one night stand.
Divorce. A fight for equity "When two people decide to get a divorce, it isn't a sign that they don't understand one another, but it is a sign that they have, at last, begun to" this is a reading to Hellen Poulland. Divorce is one of the subjects of aruguments in the Phillipines. A lot of people including the Catholic Church, are against divorce because they believe that it emperils the sanctity of marriage. However, there are also people who believe that divorce doens't destroy the sanctity of marriage but rather, it saves your soul. Regardless of all the opposing views here are some of the reasons why divorce is justifiable and must be imposed.

According to the text, Scientists try to provide analysis and insight, based on empirical data, but the task goes beyond reporting facts. The unionship held between two people commemorated into the term marriage involves a couple madly in love, willing to put their status of love into legal terms. However what happens when all the love festivities wither away and one or both parties involved in this union decide that they aren’t destined to be together forever ? In America alone, there is one divorce approximately every 36 seconds, equating to 2,400 divorces a day, and a total of approximately 876,000 a year. Most people take their time on deciding whether to marry the partner they are with, however divorce rates are still at an all time high in America. In today’s society, divorce is considered a normal thing that couples go through, instead of working out issues, as divorce seems like an easier and more convenient alternative. The general reasons as to a divorce are infidelity, financial instability, and a lack of communication amongst partners.
The law of divorce has drastically evolved through the years and encompasses the process of terminating a valid marriage between a woman and a man, ultimately ending their relationship. Contemporary developments in English law have altered the principal basis of divorce by substituting ‘irretrievable breakdown’ of marriage in place of the fault-oriented grounds, which is the only ground for a divorce.
Divorce laws in the United States are significantly more lenient today than they were many years ago, especially during that of the WWII era. A marriage defined by Merriam-Webster is a legally sanctioned contract between a man and a woman to be together for life. This definition is not so far from that of the religious definition of marriage. From a religious stand point, however depending on your specific religion, marriage is meant to be a union of a forever relationship even through eternity. Though both the dictionary and religious definitions of a marriage seem similar enough and straight forward enough to understand for those who are willing to take that forever leap into an eternal bond there are those who depend on the easier
Divorce is the suspension of the marital coalition under the terms legally summoned by the court. The couple is then set free of their obligations towards each to other
When life becomes unbearable between a women an her husband, they may think of divorce as being a fair solution for both of them to get their “independence” and live a normal life, they may even think that it is suitable for their children. However, this is not the case , divorce may have some serious consequences that can affect the whole society .
