Race And Crime In America Essay

Crime has always been a hot topic in sociology. There are many different reasons for people to commit criminal acts. There is no way to pinpoint the source of crime. I am going to show the relationship between race and crime. More specifically, I will be discussing the higher chances of minorities being involved in the criminal justice system than the majority population, discrimination, racial profiling and the environment criminals live in.

For my final project I chose to focus on Race and sentencing. The United States is about 5% of the world’s population but when it comes to world prisoners the Unites States is about 25%. In the United States African Americans are incarcerated 5 times more than whites in state prisons throughout the country and also 10 times more than whites in 5 states. In this paper I am going to research and study specific articles and studies that document the rate of incarceration for African Americans and Whites. This is not only a problem state by state sentencing but it is also problem for federal sentencing as well. Not only am I going to look at race and sentencing but I am going to also

Institutional racism is alive and well in the juvenile justice system as it is in the criminal justice system, due to racial disparity and bias in the court room” (Jones, Bridgett). This is a statement that plagues many people involved in the justice systems. There are huge racial disparities throughout the world. Post-Slavery: the early development of the Race/Crime Connection, Profiling: Racializing possible cause, and differential bias involvement as well as institutional racism. We can work on having better policies and procedures driven into police practices and we need to make sure people of color are not excluded from juries to stop most of the disparity.

While both sides of this deeply entrenched controversy substantiate meaningful claims, neither of their arguments is exhaustive, although Walker, Spohn, and DeLone’s case is much more convincing. African American arrest statistics are best understood as the convergence of both a somewhat higher incidence of crime as well as racial discrimination in the criminal justice system. Although higher incidence of crime may initially appear to justify higher arrest rates, there is significant evidence demonstrating that not only is African American crime exaggerated by a racially discriminatory criminal justice system (one of the products of which is disparate arrest rates), the greater crime rates in and of themselves are a result of economic inequality.

The existence of racial disparity and structural inequality within the criminal justice system renders the concept of true justice for all unobtainable. The statistics of convictions and prison sentences by race definitely support the concept that discrimination is a problem in the justice system as well as the insignificantly number of minority judges and lawyers. There are a multitude of circumstances that influence these statistics according to the “Central Eight” criminogenic risk factors. The need for programs and methods to effectively deter those at risk individuals has never been greater and the lack of such programs is costing society in countless ways.

Policing and punishment in America is hardly colorblind. It is not a coincidence that minorities serve longer sentences, have higher arrest and conviction rates, face higher bail amounts, and are more often the victims of police use of deadly force than white citizens. When it comes to criminals, many people have a preconception of what a criminal is. Usually when people think of a criminal they picture a Black or Latino face. The thought of an Asian criminal is often related to Asian gangs. Interestingly enough, White people as a group are rarely associated with the thought of crime, even though they account for 70% of arrests and 40% of the prison population each year (Russel xiv). African Americans are targeted by law enforcement more often than any other race (Toth, Crews & Burton, 2008). Because of this the term racial profiling was created to explain the process of targeting people for criminal activity because of race not evidence (Toth et al, 2008). African Americans are over represented in the criminal justice system based on their population amount compared to whites (Toth et al, 2008). African American males are incarcerated at a rate 9 times that of white males in most states, in others that number may be as high as 12 to 26 times more (Toth et al, 2008). Nationwide statistics show in most states 1 in 20 over the age of 18 are in prison, while 5 other states report 1 in 13 or 14 compared to the 1 in 180

Is the Criminal Justice system racist? This question has been asked many times by people of many colors. According to Mac Donald (2008), the criminal justice system is not at all racist. The article depicts arrest rates of both whites and blacks and compares statistics on these arrests. It looks at the number of whites and the number of blacks in jails and prisons. In this critique, we will be looking into this article to see these points in which Mac Donald states proves that the criminal justice system is, in fact, not a racist one.

Research shows that African Americans and Latinos have been the victims of racial profiling by the criminal justice system. African Americans and Latinos are at a higher risk of being arrested, prosecuted and sentenced that Whites. The main cause of racial disparities occurs because law enforcement agencies believe that African Americans and Latinos are at high risk of engaging in crime and violence. During prosecutions and court hearings, the jury and judges give harsher sentences to minority groups. As a result, minorities view the criminal justice system as unjust since it favors whites. This research paper reviews relevant literature to show white privileges and racial disparities in the criminal justice system. Additionally, the paper provides linkages between racial disparities in the United States criminal justice system and the law. In this regard, the main objective of the research paper is to give detailed insights on racial discriminations in the criminal justice system.

The Mass Incarceration in the United States is a major topic of discussion in our society and has raised many questions about our criminal justice system. There are few topics disputed as much in criminal justice as the relationship between race, ethnicity, and criminal outcomes. Specifically, the large disparities that minorities face regarding incarceration in our country. Minorities such as Hispanics and African Americans are sentenced at far higher rates than their white counterparts. There are multiple factors that influence this such as the judicial system, racial profiling by law enforcement, and historical biases (Kamula, Clark-Coulson, Kamula, 2010). Additionally, the defendants race was found to be highly associated with either a jail or prison sentence; with the “odds increasing 29 percent for black defendants, and 44 percent for Hispanic defendants” (King, Johnson, McGeever, 2010).

Racism has a huge impact on society to this day. The greatest wrong doing in the U.S criminal justice system is that it is a race based organization where African Americans are specifically focused on and rebuffed in a considerably more forceful route than white individuals. Saying the Us criminal justice system is racist might be politically disputable in different ways. In any case, the actualities are debatable. Underneath I explain many cases of these issues. Information on race is available for each step of the criminal justice system – from the use of drugs, police stops, arrests, getting off on bail, legal representation, jury selection, trial, sentencing, prison, parole, and freedom.

Crime, racism, drugs, alcohol, AIDS, child labour, polygamy, child abuse, unemployment, homelessness, poverty and rape are prime examples which help define the notion social problems (SPs) (Best, 1989). Sociologist often define SPs as arrangements that fail to work within society (Bassis, Gelles, and Levine, 1982:2), which are seen and viewed widely as a problem, are caused by human action and affect a mass of people (Farley, 1987:2, Gusfield,1989). Welfare societies create policies and legislation to deal with SPs and, take responsibility for ensuring that individuals in society are safe, out of harm’s way and, try to combat poverty by having minimum standards of living, so that it is affordable within the free market. There is a problem when it comes to defining SPs because, it relies on a significant proportion of society to identify an objective social condition and subjectively interpret it as troublesome and require change (Theodorson and Theodorson, 1969:392). Theories that make attempts to view SPs as objectively rejected conditions in society, fail to explain why certain conditions are labelled as SPs (Hilgartner and Bosk, 1988). The real question here then is, how do we go about deciding what is and isn’t a SP objectively? Who decides and how do they make that decision? Whose responsibility is it to deal with the problem? How do we go about rating SP like crime against homelessness and child labour? This essay will attempt to answer these question while examining
