“Use of force refers to the amount of effort required by police to compel compliance by an unwilling subject. The Fourth Amendment forbids unreasonable searches and seizures, and various other legal and policy controls govern how and when officers can use force. Most agencies tightly control the use of force, and supervisors or internal affairs units routinely review serious incidents.” (). Police officers have the right to use discretion and can use force whenever they deem necessary, but consequently, some police officers abuse their power and use it excessively. Police officers do need to establish authority in their community but they need to be careful on how they do it. They could do it by excessively using any one of these types of force; by verbal restraint, physical restraint, less lethal force, or lethal force. The use of force happens all the time and could happen because of several different reasons. There are ways to prevent it if done right. And statistically, police brutality is increasing and needs to stop.
In the case that I have chosen, a woman, by the name of Seryina Trujillo, from Denver, Colorado is taken into custody after she was implicated of hindering with officers and firefighters as they tried to bring two men to the Denver Cares detox unit. Trujillo spits on one of the officers, James Medina, and kicked him in the face while she was being arrested and brought to a police vehicle. The force used at the scene of the crime is ultimately left in the hands of the officer; however, when it is misused or overused it usually leads to a divide between community and law enforcement. Given the high stake at hand, a formal rule has been placed known as the force continuum which provides both law enforcement officers and civilians how much force is to be used in a given situation. Not only does this teach officers how much force to use, but it also teaches officers how to avoid the use of force in general. They are taught mediation tactics so that if force is not needed, it is not used at all. This affords the community to not fear police and also stops legal actions and stigmas from being drawn on all police officers. Police brutality is one of the most serious and divisive human rights violations in the United States and it occurs in every community. The job of a police officer is to maintain public order, prevent, and detect crime. They are engaged in a dangerous and stressful occupation that can involve violent situations that must be controlled. In many of these confrontations with the public it may become necessary for the police to administer force to take control of a situation. There are several different types of force. These types of force include verbal commands or persuasion, physical force (unarmed), force using weapons that are non lethal, force that involves using weapons such as the bean bag gun or taser, and lastly, deadly force. All officers have to give way to each force option before last resorting to the use of deadly force, unless of course if the officer is in a life or death situation. This may be the only way to use deadly force in the first and last resort. They have a couple of weapons that they carry in case the need to use them arises. They carry a baton, tasers, handcuffs, guns and they also have police dogs. Some police do follow the guidelines for using force. Others may abuse their authority and not use force properly. It is really only up to the officers to do the right thing. Some cops are great and live to protect our communities while others abuse their authority.

Law enforcement officers are given much power and authority over one’s civil liberties. Not only do they have a duty but also a responsibility to enforce laws and ordinances in their jurisdiction, maintain order and protect its people. In some cases, the only way to accomplish this is through legitimized use of force. Use of force can best be described as "the amount of effort required by a law enforcement officer to induce compliance of an unwilling subject" (nij.gov, 2012). With that said, law enforcement officers have been given the right to apply only enough force necessary to control a situation, while defending others, preventing escape, during self-defense and while a subject is resisting arrest (Pollock, pp. 234). It is not until that force becomes excessive that it becomes say an issue.
In the “Encyclopedia of Violence, Peace, and conflict” the author discusses how many uses of force by the police cannot be labeled police brutality or excessive force. This is because in the line of duty police may need to utilize the use of force out of necessity. The author continues by stating that police officers in society today commonly have to use power against its citizens for reasons in everyday police work or in order to maintain control over certain circumstances. While racing down the freeway on March 3, 1991, driver Rodney King and friends were leading the Los Angeles Police Department on a high speed chase making it up to 115 miles per hour. When King was eventually caught, officers pulled him from his car and began to beat King with their batons hitting and kicking him more than 50 times and shocking him with stun guns in a period of two minutes as he struggled helplessly on the ground outside of his car. King suffered 11 skull fractures, kidney damage, and brain damage. Many police officers decide that it is best to use force. Even when it is not required. An innocent man asked a police officer to move his vehicle out of his driveway and the officer forced him out of his house. The officer had a “...history of brutality, attacked him, tasered him in the back, kidnapped him and threw him in a cage for weeks — causing him to lose his job, his house, and his dignity” (Algorist). This cop chose to harm an innocent man and risk his job over a simple question that could have been resolved in a much safer manner. The cop used force towards the man and the man was not a criminal.

They have the power to infringe upon any citizen’s rights to freedom and therefore they must use this power effectively. One thing that the public often say in criticism of the polices use of force is “well, he only stole some [something worth a small amount of money]” or “[the arrested individuals] didn't do anything that bad to deserve that much force”. The use of force, with regards to law enforcements use of it, is a complex topic that should be looked at in all perspectives. There is tension between the police and the community they work for, on whether this is a power that the officers should have or not. There are ambiguous laws that do not give law enforcement offices much guidelines on what is exactly permissible when it comes to force, and all the different situations it could occur. The line that the use of force leis on is often a fine one. It is teetering between excessive force and never being able to enforce the laws. The use of forces is a conversation that is worth having with all the pros and cons that it brings to the discussion board.
