While they adopted many of the essential elements of the English legal system, they had major differences in the American legal system (Brinkley, 2012). It was the first time that a democratic government was developed and tested in a time where monarchies ruled Europe and it was the time when the world saw that the concept of democracy could lead to the fundamental change in society, specifically politically, socially, and economically. All wars are the result of social change, talks of revolution, institution of slavery and connection to power and liberation. A consistent reason is that the states have always been dependent upon themselves and relying on their own kind to create a sense of power. The institution of slavery gave white men a sense of power in which was stripped away from them by the government. They no longer could control and have an opinion in state nor federal government decisions. Throughout all these eras of history the enslaves Africans were never seen as equal, therefore were never treated as equal. They were always seen as the black labor workers. The focus point of this paper will be the institution of slavery. After the civil war and reconstruction, America changed drastically in defining slavery and what would become of the institution.
Looking at the social order at the time is important to understanding what is to come. While the slaves were now free and able to do as they pleased, there was still a deeply embedded racism within the minds of Southern whites. Just because blacks had fought in the Civil War did not suddenly mean that the perception of blacks had changed; rather to the Southern elites, they still viewed blacks as inferior and only good for labor, longing to perpetuate the slave system but within a new industrial framework seeing as how the agricultural framework had been destroyed.
