The legislative process is a very long and complex procedure that often results in most proposed bills failing to become laws. Due to this, most domestic policy plans often go unfulfilled. After the Connecticut elementary school shooting that resulted in 20 students dead and 6 adults, many Americans felt that there should be restrictions on the purchasing of guns. When President Barak Obama proposed a mandatory background check for gun buyers, there was an 80 percent support from American citizens. However, the proposed bill began to die out despite the vast support in favor of the bill. This is due to the fact that the legislative process limits the power of the President in reference to law making.

This is a huge step for America as more states band together to impose stricter laws on firearms. In the past, states banding together to ban or legalize something has shown to influence the federal government or other states that have yet to follow. This has been proven with abortions and homosexual marriage and is now taking place with gun control. In a speech regarding the Charleston, South Carolina shooting in June of 2015, President Obama stated, “More than 11,000 people were killed by gun violence in 2013 alone.” After the Sandy Hook shooting, in Newtown, Connecticut with a death toll of 26, Congress has still failed to pass these regulations which 90% of Americans wish to have. While tightening the gun control may not guarantee the complete absence of mass shootings or gun violence and crime, it has definately been shown to significantly reduce these rates. Based upon my understanding of the United States Constitution as well as listening to the arguments brought forth by the two parties in this particular case, I see a great reason to believe that three of the four provisions of the Firearm Owner’s Privacy Act is an unconstitutional abridgment of the First Amendment. The record-keeping provision, anti-harassment provision, and the inquiry provisions are in clear violation of the First Amendment as they are content-based regulations of speech that fail strict scrutiny.
