I am filing a Title 38 U.S.C. Section 1151 claim because I have incurred or aggravated an illness while participating directly in a Vocational Rehabilitation Training under the provision of Non-Paid Work Experience (NPWE) program. During the month of December 2010 through April 2016 I began working at the Veterans Affairs office at 6437 Garners Ferry Rd, Columbia, SC 29209. The first five years was as a Federal Work-Study, while pursing my Bachelor of Business Administration degree. After graduating I was immediately accepted into the Veterans Affairs Non-Paid-Work-Experience (NPWE) training program because it was determined by (VR&E) that a severe employment handicap (SEH) existed. The next thing I can remember is waking up in the hospital after craniotomies. The stress connected to my employment contributed to nicotine addiction weakened my immune defenses and played a role in the course of my cancer. I used tobacco products to alleviate the traumatic experiences relating with my in service PTSD/Alcohol/Drug Abuse problems. The brain mass, lung cancer and emphysema disease is a result of cigarette smoking. This habit developed secondary to my PTSD/Alcohol/Drug symptoms. Specifically, the nicotine addiction started soon after my discharge from the Air Force and has continued until 2016, averaging one pack per day for 33 years. However, I do not know if this is the right form to request secondary tobacco use because of PTSD, that is service connected, but let it be part of my request for compensation for the record. My records will reveal no complaints relating to the existing condition and that I was not taking any prescription medication for it or receiving any treatment at all. I was leading an active life working, playing sports, handling household chores to include preparing my own meals without any difficulties. Now I suffer from an increase in cognitive impairment because of PTSD and the secondary illness to include my ability to maintain normal interactions due to persistent anxiety, depression, flashes of my own death and a sense of detachment from others
The health benefits of tobacco have only recently been brought into the light. As a new area of research, few sources have extensive knowledge of the subject. Some of the few studies have shown that tobacco can be used to fight certain forms of cancer, prevent Parkinson’s disease, and battle obesity. Doctor William Campbell Douglass, “who himself smokes 3 to 4 cigars a day,” has spent years unraveling the mysteries of tobacco. Doctor Douglass’ explanations pointed to several statistics indicating moderate smoking can improve conditions of patients suffering from specific forms of cancer (Douglass). He also describes a study which shows that women who smoked regularly were at a risk that was 54% lower than women who did not smoke (Douglass). Several other independent studies have also proven the benefits of tobacco. A 2010 study published

This the only proof the doctor have, maybe he misunderstood or gotten my words twisted, but I repeated I never said I was diagnosed or rear end in a parking lot. I never was rear-ended in anyone parking lot. What I told the examiner was when I was on my way back from Iraq the VA examiner diagnose me with a cervical strain from all the convey trips. (See DA Form 638, APR 2006 Achievement #3). This is the first and only time I ever been diagnosis with any neck injury or problem by a VA doctor. I was also unable to navigate my own vehicle to the hospital from excruciating pain and assisted by my younger brother. I was not discharged from HackensackUniversity Hospital until Friday, 7/22/2016 at 5:30am which I followed at 10am in contacting Joann requested a sick day. The pain did not decrease and remained through the weekend where I was unable to perform any workload. I was finally able to have some sensation and movement on my left arm on Monday, 7/25/2016 in which I notified CMS I was not able to complete any work from home and provided hospital discharge documentation. I attempted to complete as much paperwork in a timely manner while still experiencing pain. I acknowledge the tardiness in workload; however, felt my health wasn't taken into consideration. In this case, the veteran wants to apply for a supervisory position. With the details about him suffering from back pain do to his Vietnam conflict experiences, employers most likely would not promote him. However, under the Americans with Disabilities Act, employers are not allowed to discriminate anyone based on a disability. So in this case, employers have to see past the disability and focus on his credentials and skills.
Some veterans who become disabled cannot return to their prior professions after being discharged from the military due to severe handicaps. The VA has set up job placement programs and extended education if the veteran qualifies. The vocational rehabilitation program provides the guidance needed from councilors who help administer interest and aptitude tests to steer the veteran into a compatible career field. Depending on the veteran’s aptitude test, it will determine if they qualify for vocational training or monetary compensation to further their educational goals. In rare cases, a veteran can apply for a small business loan instead of seeking vocational rehabilitation. The veteran must provide an in-depth business plan and have the education or vocational training to be deemed competent in their business endeavor. To qualify for this service the veteran must have a disability rating of ten percent and have another than dishonorable discharge
During my sixth week doing the internship at the DOL (VETS), the team and I was looking at students resumes to see who are the best candidates to be potential interns and work studies for the summer semester. Since I completed this form my conditions have become worse. My new present illnesses, consists of obstructive sleep apnea (CPAP), heart condition (PTCA STENT), cardiac catheterization, hypertension, and cholesterol/dyslipidemia. With all of this and including my other illnesses, this could cause serious problems in the workplace, and have limited my ability to work. Because of my sleep apnea, (it effects my mental abilities like memory, concentration) I reacted slow when it comes to time, have vision problems, sleep problems, (causes me to fall asleep during the day) and my fatigue, (tired, sleepy, and can only walk 10 to 15 minutes) all affects and limit my ability to work and I have another impairment such as heart condition that limit my ability to exert myself physically. Without adequate sleep, I have more difficulty concentrating, learning, and communicating. Memory lapses have increase; my problem-solving ability and social functioning) have decline. I Can be moody and less tolerance of people, differing opinion, making me more prone to outburst. According to my doctor my driving ability I have to be caution. Also I have hypertension, the doctor limit me to lifting only a few pound.

In the community assessment of San Fernando valley part, A, it was mentioned that there are many chronic illnesses such as heart disease, asthma, diabetes and obesity that are caused by poor health management, high cost of healthcare and inadequate knowledge of the disease. One factor that could cause these chronic diseases is the Tobacco usage among adults. According to Centers for Diseases Control and Prevention (CDC) (2017), Smoking may cause cancer, heart disease, stroke, lung disease, diabetes and COPD which includes emphysema and chronic bronchitis.
Albert Schweitzer once said, “Success is not the key to happiness. Happiness is the key to success.” Voluntary work is work that is done by choice, but the title “voluntary” does not always make sense because sometimes voluntary work needs to be done which can be frustrating at times. For example, some schools require that students do a number of hours before they are allowed to graduate. That does not sound voluntary, does it? Does that emphasize the fact the happiness needs to be present to succeed? Benefits of volunteer work include being qualified for more scholarships, being a role model to others, and gaining more experience in certain fields.
Smoking has broad consequences for the US military, including adverse effects on the readiness of its forces, the health and welfare of its beneficiaries, and the costs incurred from health care and lost productivity. It affects military readiness by impairing physical performance and endurance, vigilance and cognitive function, risk of motor vehicle collisions and other unintentional injuries, and increasing work absenteeism.1 The effects of tobacco on the health and welfare of military beneficiaries include not only long-term consequences such as cardiovascular disease, respiratory disease, and cancer, but also short-term effects such as respiratory effects, impaired wound healing, periodontal disease, and peptic ulcer disease.2 Tobacco use accounts for one-sixth of the deaths which occur among DoD beneficiaries, primarily among retirees.3 The estimated costs resulting from tobacco use to the DoD exceed $1 billion per year.3,4
