The book Celebrated Cases of Judge Dee takes place in the Tang Dynasty in a region of China called Chang-ping. The time in which the book took place was a very Confucian society due to the resurrection of the Confucian Educational System. This society emphasized beliefs such as the importance of the government, education, filial piety, and the 5 relationships. It believed that the gentleman was the embodiment of all these characteristics and was held to the highest standards. Legalism was the practiced legal system at the time. In the legal system, it was expected that to those who were accused of wrongdoings were to be tortured into confessing their crimes and the punishments were very severe. One of the ways Legalism worked was that when one was suspected to be guilty, the confession would be tortured out of them, rather than searching and comparing all the suspects. The society of the time also practiced and believed in spiritual entities. They 'd pray in temples for answers to their questions and the response they 'd get were taken seriously. These were the common practices of the time. This novel focuses on Dee Jen-djieh, or more commonly known as Judge Dee. He is the magistrate of Chang-ping and is famous for solving many successful and puzzling cases. He is an honest, wise, benevolent, justice-loving magistrate, although some members of the public believe he is too rash in judgments and often jumps to conclusions. Judge Dee is a good magistrate because he is
In regarding the Marriage of Dougall, appellant Richard Dougall appeals the trial court’s denial of his motion for reconsideration challenging their post-dissolution-decree order of spousal maintenance arrearages to appellee Myrna Dougall. He argues that Arizona Revised Statute 25-530 prevents the court from considering Veterans Administration (VA) disability benefits as income when calculating and determining the payment of arrearages of an award of spousal maintenance.
The book “Judicial Tyranny The New Kings of America?” is a compilation of articles and speeches. It is compiled by Mark Sutherland and includes writings from famed Christian personality James C. Dobson Chief Justice Roy Moore, Ambassador Alan Keyes, U.s Attorney General Ed Meese, among others. The book is a call to political action. It is aimed at Christian readers and the writers all argue that Christian politics equals constitutional purism. It is specifically meant to invoke constitutional responses and activism. Each chapter, twenty in all, are a few pages long and systematically decry the current judicial system and explain the lack of constitutional basis for their current level of power.
In Judicial Tyranny the New Kings of America, Mark Sutherland proposes his ideas on how America is now being heavily influenced by tyrannical judges who pervert the constitution, to support their individual positions. According to Cambridge Dictionary, tyranny is defined as, “unlimited authority or use of power, or a government which exercises such power without any control or limits” (Cambridge 2015). There is, in our society, an over-reaching judicial branch ran by judges who are consumed by the idea that they are the resource which can establish or re-define the law. The three fallacies with our society is tyrannical judges who impose man’s law above sovereign law , citizens who don’t know about the un-constitutional rule that judges are imposing over the courts, and those who know about it but don’t know how to react when facing a tyrannical judge.
The author, Phyllis A. Roth, is not your ordinary feminist, because she is also a Freudian. A better term to describe Roth would be a psychoanalytic feminist. One of her works as an author can be found in the back of the book Dracula: A Norton Critical Edition. Her criticism article is titled Suddenly Sexual Woman in Bram Stoker’s Dracula. In her article she analyzes the famous novel Dracula. She explores how gender plays a role in the novel and the concept of femininity. She writes about the transformation that takes place when a proper lady turns into a sexual vampire. Her article points out where hostility toward women 's sexuality is displayed in the novel, that the average reader may not pick up on. Roth has a strong argument. Let us examine Roth’s case.
The role of the judge in the adversary system of trial, unlike the inquisitorial counterpart, has less involvement in the establishment of facts and the analysis of evidence in cases brought before the court. In the inquisitorial system of trial, the judge has a much more active role in relation to the handling and evaluation of evidence, and where relevant, can actually cross examine and question witnesses if they feel crucial evidence may have been missed. While the inquisitorial system of trial has a seemingly more intrusive judge, having an added legal expert questioning and raising areas where evidence may have been missed, is a significant improvement over a judge who may know evidence has been missed but cannot intervene such is the
I do agree that it’s not too many layers and that it’s a good system. It gives us balance between the state and federal. The state is allowed to handle local issues that deals directly with it local citizens and that federal courts helps out to interpret the constitution to ensure that citizens’ rights weren’t violated by the states courts.
“Peace is not the absence of conflict, it is the ability to handle conflict by peaceful means.”(Ronald Reagan).Peace can be seen as freedom from fear of violence and lack of conflict. Commonly understood as the absence of hostility, peace often involves compromise, and is initiated with thoughtful listening and communication to enhance and create a common understanding of the issue. In Arthur Millers “The Crucible”, although John Proctor and Reverend Hale both display virtuous qualities, John proctor excels at promoting peace within Salem through his acts of justice and fortitude. Both John Proctor and Reverend Hale show displays of justice however John Proctor’s acts of justice played a larger role promoting peace in Salem. John Proctor and
It is believed to be said that people commit crimes because of various reasons and aspects in their life. The community offers their citizens a secure and safe residence to live in. However, some argue that particular individuals are born with specific traits that determine how they react in a negative condition. Individuals make decisions in life that can lead them down the wrong path. An individual may choose to commit a crime, only looking at how it will benefit them. I also believe that people think before they commit any criminal activity. When an individual commits a crime, they act on their own free will. They’re aware of their consequences of their punishment. Also, people can commit crimes due to their society. Such conflicts arise
Many years ago, before courts existed matters was handled in a privately or informally. This often led to violence and unjust treatment of innocent people. During the rise of the Greek City States and the Roman Empire law enforcement became a public affair instead of private. (Siegel, Schmalleger, & Worral, 2011). Along with this movement became formalized courts and other criminal justice institutions. This allowed for law enforcement matters to be handled in a more civilized manner for resolving human conflict.
Execution of Justice is a play based on the assassination of George Moscone, mayor of San Francisco from 1976 to his death in 1978, and openly gay city supervisor Harvey Milk by Dan White. Written by Emily Mann, Execution of Justice focuses on the aftermath of the assassination through the reenactment of the trial The People of California vs. Dan through the voices of citizens of San Francisco integrated into the official case transcripts (Program Notes). Additionally, unique spectacles were used in Tom Dughale’s, the director, version of the play such as the use of videos and pictures from the time of the case and creating a video of their own creation to begin the show. Pictures and videos used in the original case were shown throughout
In the play The Crucible, the author Arthur Miller displays an unfair treatment of humans when it comes to justice. Characters who live in Salem, Massachusetts, receive improper punishments for their sins of witchcraft and are being accused of crimes they did not commit. The justice system in the play is based on the maxim “guilty until proven innocent” which portrays unjust human rights due to executions of individuals without evidence. The accused characters attempt to defend themselves in court but it is ineffective because the only way to survive is to confess to witchcraft. Miller presents a cruel approach in justice systems and proves them to be unjust through the characters Giles Corey, Tituba, and Rebecca Nurse, who all suffered
After spending 26 years behind bars for a crime he did not commit, Dwayne Allen Dail, was exonerated yesterday after DNA testing proved his innocence.
There are three women on the Supreme Court, one of whom is Latina, and there is one black justice serving on the Supreme Court (Brown, 2016). This is a major issue. The United States, the “melting pot”, has an extreme lack of diversity in their court system. This is an issue that affects several aspects of society. Decisions made by judges will affect the lives of men, women, and their families. The decisions made by judges can also create law. Unlike political officials, the people do not always have the power to vote judges into their positions. Instead, the people hope that their peers with the power to affect the system choose a candidate that will fight for them. Often times, this does not happen.
