Prison overcrowding is a major problem in our criminal justice system and it continues to be a hotly debated topic as to how we should address the problem. One of the main reasons our prison systems have a problem with overcrowding is drugs. More specifically, the "war on drugs" started by President Reagan in 1982 brought a dramatic increase to the number of people put behind bars for drug offences. Mandatory minimum sentencing and truth in sentencing are two policies which have sent drug offenders to prison and kept them there for longer periods of time. The continuing crusade against drugs has apprehended hundreds of thousands of suspects who spend millions on drugs but the cost to incarcerate these non-violent offenders exceeds billions of dollars and much of that money is coming from the taxpayers ' pockets. One way to address this problem is to reverse the current trend of putting first time, non-violent drug offenders in prison and instead sentence these offenders to boot camp and counselling combined with family support.
There are currently over two million people in our nation 's state and federal prisons and jails. Nearly one and a half million of these offenders occupy state and federal prisons, serving over a year in detention for felonies.(1) The most alarming statistic is the fact that the United States houses twenty five percent of the world 's inmates. Many different states have begun sending nonviolent drug offenders to various kinds of drug treatment program the state offers. By doing this, it has significantly reduced the problems with overcrowding. If an individual is arrested and charged with simple possession of a drug and no other crime is being commented, then this person is doing no harm to anyone else. They should be given the opportunity to try and make a change in their life and beat the addiction. Instead, if this person is thrown into jail, they are still going to be an addict with a criminal record now and will not be able to be a contributing member of society. (Everett 1 ).
The United States has the world's highest incarceration rate. With five percent of the world's population, our country houses nearly twenty-five percent of the world's reported prisoners. Currently there are approximately two million people in American prisons or jails. Since 1984 the prison population for drug offenders has risen from ten percent to now over thirty percent of the total prison population. Federal prisons were estimated to hold 179,204 sentenced inmates in 2007; 95,446 for drug offenses. State prisons held a total of 1,296,700 inmates in 2005; 253,300 for drug offenses. Sixty percent of the drug offenders in prisons are nonviolent and were purely in prison because of drug offenses (Drug War Facts). The question then arises,
There has been debate over whether non-violent drug offenders belong in prison. Some believe all drug offenders should be put in prison, others believe that it depends on circumstances, and, still others believe only violent drug offenders should be incarcerated. Overcrowding is one point of contention. It seems as though the slightest infraction can land a person in prison. Violence is rampant, whether inmate versus inmate or inmate versus guard. Rehabilitation or education is practically non-existent, unless an inmate teaching another inmate how to commit the ‘perfect’ crime is counted. Evidence shows being in prison does little to rehabilitate an inmate. Clearly, the system does not work.
As of 2015, 2.7% of adults in the United States were under correctional control, the lowest rate since 1994, however that is still roughly 6.7 million adults (Kaeble & Glaze, 2016). While the correctional population has declined, correctional facilities in the United States are still grossly overcrowded, with many facilities at or surpassing capacity. A report in 2010 by the California Department of Corrections and Rehabilitation showed that on average, facilities were at 175% capacity (Brown, 2010). However, as of midnight on October 31st, 2017 the California Department of Corrections and Rehabilitation reported that their facilities, on average, were 132% occupied (Brown, 2017). Not only is prison overcrowding a burden on the facilities themselves, but also on the inmates. Prison overcrowding, that is, housing more inmates than the facility can humanely facilitate (Haney, 2006), places a strain on all resources throughout the correctional facility, including on the healthcare that’s offered, educational programs, and most dramatically on the physical space available to house inmates (Ekland-Olson, 1983).
The War on Drugs is one cause for the mass incarceration that has become apparent within the United States. This refers to a drastic amount of people being imprisoned for mainly non-violent crime (“Mass Incarceration” 2016). In addition to people who are not an immediate threat to society being locked up for a substantial duration of time, the economic consequences are costing states and taxpayers millions of dollars. Tougher sentencing is not likely to reduce illegal drug use or serious crime associated with drugs (Alexander, 2010; Mauer, 2009; Whitford & Yates, 2009). Despite that, politicians and law enforcement personnel continue to advocate for stronger sentences for those who take or sell drugs of any kind. The jails and prisons across the United States are filling up with drug offenders, and some believe that there are better uses for those jail cells and that there are many crimes that are more severe and significant. These are the crimes that should be provided with tougher sentencing guidelines, but yet illegal drug use is still a serious crime and should not go unpunished. What should be done, and how should changes be made? Those are tough questions that have to be explored and that do not have any easy answers for those who make the laws and those who enforce them. Drug incarceration has been on the rise, with mixed results. According to King (2008), "overall, between 1980 and 2003, the number of drug offenders in prison or jail increased by 1100% from 41,100 in 1980 to 493,800 in 2003, with a remarkable rise in arrests concentrated in African American communities."
With California jails and prisons still struggling with finding a reform for non-violent drug offenders the states recidivism rates continue to reach unprecedented numbers. Between 1983 and 1998, drug admissions to state and federal prisons increased sixteen-fold, from over 10,000 drug admissions in 1983 to almost 167,000 new prison entries for drug offenses in 1998 (Worrall et al, 2009). This has been a direct result of our legal system incarcerating offenders who have substance abuse related issues instead of providing a way for treatment or rehabilitation outside of incarceration. Through public policies regarding criminal justice interventions that address drug use and crime, an initiative was created to provide treatment services
This report starts off with an overview of drug courts are, then moves into the overall problem with drug control in the United States. They talk about the history and the rise in drug offenses during the 1980’s causing the prison populations to rise. When comparing the rise of drug offenses, they found it was both state and federal level. The growth of drug offenses became approximately one in every 198 persons was incarcerated. About nine years later, the first drug court was established. Courts, jails, and prisons were seeing a pattern with the number of low level repeat drug offenders and street dealers starting to cause problems with overcrowding . The drug court movement was a shift from law enforcement’s emphasis on reducing drug use.
When the term corrections is mentioned, the thought of incarceration is the first to come to mind. This is the case for as of the end of 2013, there were 1,574,700 people serving time in state and federal penitentiaries (Carson, 2014, p.1). This alarming number gives reason for the need of alternatives to incarceration. Avoiding imprisonment does not translate to a lenient punitive sentence for the alternatives can just as easily repair harms to the victims, provide benefits to the community, treat the drug addicted, and rehabilitate offenders (FAMM, 2013, p.1). The use of programs that offer an alternative to incarceration can reduce the amount of people in the prison system that is living on taxpayers’ dollars.
The number of people incarcerated in America has steeply risen since the beginning of the War on Drugs. In 1980, about 300,000 individuals were in jail. (Alexander, 2010) In 2000, the number rose to over one million, and at the start of 2008, there were 2.3 million adults in prison in America (Pew Center on the States, 2008). These increases in the rate of incarceration are traceable to the War on Drugs (Nunn, 2001). “Convictions for drug offenses are the single most important cause of the explosion in incarceration in the United States (Alexander, 2010).” Drug offenses account for two thirds of the rise in the federal prison population between 1985 and 2000 (Nunn, 2001).
We jail a grand amount of the population most times, who don’t necessarily produce any harm or those who have not committed violent crimes. Most arrest, convictions, and sentencing are a product of drug related issues. “Sentencing policies of the War on Drugs era resulted in dramatic growth in incarceration for drug offenses” (The Sentencing Project, 2016, p.3).
The United States government has a high mandatory minimum for first time nonviolent drug charges. Therefore, offenders stay in the prison system longer and facilities are not able to properly provide the necessary accommodations to catch up due to the increase of non-violent prisoners that fill the system. According to the article “Tests for Reducing Prison Populations” by Erik Eckholm, one of the problems is that the United States government is trying to come up with better mandatory sentencing and strengthen the crumbling rehabilitation system for nonviolent prisoners (1). The Overcrowding of prisons within the United States is an issue that needs to be addressed because there are too many tax dollars being spent, prison sentences change or do not necessarily fit the crime, and drug offenders and nonviolent criminals, who need services other than prison time, are draining the system.
First and foremost, in order to produce and educated opinion on the possibility of the over-incarceration of drug-offenders, we must first analyze the laws that land individuals in prison. In the early and mid-1970s the crime rate was skyrocketing, people were being murdered, and mothers were neglecting their children in order indulge in drugs. The primary culprit for the erratic behavior was crack-cocaine. The drug swept the streets as a more affordable substitute for powered cocaine that could be smoked instead of injected; the only difference between the two was the addition of baking soda, water, and heat from a stove or microwave. The ingenious combination of cocaine and household chemicals gave birth to a narcotic that the government
Prison overcrowding in the United States is due to many reoccurring charges that is being sentenced to inmates that have been released and returning. As the increasing inmate population is a growing concern in the U.S, many law enforcement agencies and academic expert have analyzed data about the situation and are working to combat it. Research shows that Drugs are mainly to blame. Of the inmates in federal prison as of September 2011, more than half or 50.4% was serving sentences for drug offenses that were committed including simple offenses. Out of 24,366 related drug offenders, 6,336 were marijuana related offenders and 4,309 were Methamphetamine related offenders. This does not only show that more than half of the prisons are filled with drug offenders but it means that the cells are being used by people who are most likely addicted to the substance. When there are cells being wasted by people who do not or would rather not change their ways, then it is useless. Overpopulated drug offenders are the result in prison overcrowding in the United States. In this research paper I will be reviewing the main cause for overcrowding, what overcrowding causes, crime rates and costs, proposition AB 109, and potential solutions to the overcrowding of prison system.
The United States Correctional System is often challenged as to whether it wants to rehabilitate drug offenders or punish them, and because of this it mostly does neither. Even though drug abuse and drug trafficking are widely spread national issues, the mental, social, and economic costs of "healing" through incarceration are only making the "disease" worse. Never before have more prisoners been locked up on drug offenses than today. Mixed with the extremely high risks of today's prison environment, the concept of incarceration as punishment for drug offenders cannot be successful. Without the correct form of rehabilitation through treatment within Michigan's Correctional System, drug
