Canada is a nation renown as a liberal-leaning, forward nation; promoting the advancement of women in all parts of the world. However, it is a nation guilty of punishing women for the circumstances in which they find themselves with laws showing an antiquated view on the issue of prostitution—one that prosecutes sex workers instead of those who take advantage of women’s situations and buy sexual services. BY examining the origins of current-day laws concerning prostitution in Canada and looking at European legislation as well as its successes and failures made it is possible to find a middle ground that will suit Canada should it ever decide to change its laws concerning prostitution.

Prostitution has been a part of our world's culture since the beginning of time, and is the world's oldest profession. Prostitution is defined by the Webster dictionary as “the act or practice of engaging in promiscuous sexual relations especially for money.” If prostitution were legalized, there would a reduction in sex crimes, American citizens would have the freedom to choose any profession within the sex industry and it would provide economic benefits for the local and federal governments, as well as the population.

Prostitution is one of the oldest and most controversial professions on earth. According to records, prostitution was a normal practice of the earliest known civilizations. Ancient Greeks and Roma governments went as far as sponsoring brothels to ensure their citizens could afford a prostitute. The emergence of religions like Christianity and Islam transformed the moral views on prostitution. Following a tremendous pressure from the religious authorities, many European countries started to ban the practice on the bases of being immoral and harmful to society. The king of Spain made prostitution punishable law. Those caught could face a harsh punishment or they could be exiled. Pope Sixths of Rome went as far as making prostitution punishable by death .Despite the laws drafted by the authorities, people continued to provide and use sexual services. In this modern era, we are still debating the ethics of prostitution. Most people claim that prostitution is morally degrading and harmful to the wellbeing of society. While others claim that legalizing prostitution can help create tax revenues, undermine organized crime and reduce the spread of disease. Using utilitarianism, virtue ethics and Kant deontology I will prove that prostitution is immoral and it should be banned.

Throughout America and the entire world, prostitution flourishes. Prostitution is another never ending war like abortion, which society feels is immoral. This immorality leads functionalists, who apply functionalism to this social problem, on a chase to figure out why prostitution is what it is today. Functionalism is the best theory for looking at prostitution. It allows us to see how prostitution changes along with other aspects of society.

Imagine driving down the street at night seeing no one on the corner half dressed trying to get money, or scrolling through a website and have a pop up come up about buying someone. Sex trafficking has become apart of everyday life. Many people are taken everyday and forced into the ring of sex trafficking. One girl spent her whole childhood getting raped by her father and then forced to go out to bars every night and sleep with other men, then go to school the next day (Sher). Sex trafficking is a problem in the United States that can not be ignored no longer.

Those opposing the legalization of prostitution believe that there are several reasons why the United States should not legalize the buying and selling of sexual acts. If prostitution were legal, sex trafficking in the United States would surge (Bruckert and Hannem 47). In order to avoid being taxed, entrepreneurs would simply kidnap girls and sell them into an underground trafficking system, making a business of their own (Perer 829). Children and teens would be abducted, forced to take drugs, and forced to prostitute themselves for the profit of their kidnapper (Bruckert and Hannem 47; Perer 829). Sex trafficking would be used to avoid the use of sexual protection. Johns will pay more for a girl who does not make them use a condom, and this alone could spark a new interest for sex trafficking (Perer 830). Sex trafficking is a horrible industry that most abducted girls never make it out of, and legalizing prostitution will only make it worse (Wagenaar and Altink 280).

Most people throughout the world would think of slavery as an issue of the past, but sex trafficking is today’s form of “modern day slavery” (Countryman-Roswurm, 2014). Sex trafficking has become the fastest growing and most profitable criminal enterprise in the world due to the fact that people can be sold over and over again. Corrupt governments have tried to cover this issue up and have worked alongside traffickers to help them obtain illegal documents to continue operating (Deshpande et al., 2013). The effects of this crime causes victims of trafficking to have many emotional, physical, and mental traumas (Deshpande et al., 2013).

There is a widespread discrepancy in the definition of prostitution, most would agree that it is: sexual in nature, and the compensation for performing the sexual act is either money or other material goods; however, these transactions vary, ranging from specified sexual acts and goods, which can be exchanged to broader context. These transactions occur in the street, bawdyhouse, massage parlour, and inside private residences or hotels.

But when men or women do want to sell their bodies, they should have that full right without encountering punishment or discrimination.” Prostitution, often described as the world’s oldest profession is a legitimate criminal offence in 109 countries of the world today (“Human Trafficking Statistics”). Laws on prostitution vary considerably from country to country: in some countries it is punishable by death penalty ("Iran - Facts on Trafficking”), in some it is a crime punishable by prison sentence, while in other jurisdictions, it is a lesser administrative offense punishable only with a fine ("The Sentencing and
