This paper documents the basic issues for the I-130 Marriage-based Study and some of the challenges which hamper the swift execution of the study. The paper begins with a brief description of the study purpose, follows by important definition of key study concepts for marriage-based IBFA and a discussion for the sample size needed to execute the study optimally. Recommendation solutions are provided at the end of the paper on how to specify the roles for OP&S and each stakeholder and members of the Technical Working Group to assist and ensure the successful execution of the study.
Purpose of the IBFA Pilot Study (For details see IFRET’s White Paper)
• Fraud estimate: The primary purpose of the pilot IBFA study is to fulfill Congressional request for USCIS to estimate a defensible “true” benefit-fraud rate within the Form I-130 marriage-based petitions.

• Estimate the actual resources required by USCIS if all suspected cases are investigated by Immigration offices and compared to the actual allocated resources for fraud detection
• Exploratory research: IFRET has designed the IBFA study with an objective to examine the sample characteristics, such as an overstayed visa status of the beneficiaries or non-cohabitating couples, so that a statistical model can be used to estimate the probability of fraud for the population given the sample characteristics.

Marriage has changed dramatically over time in the many years it has been around. What do think Marriage was like 100 years ago? The article, “American Marriage in Transition”, describes how many different types of marriage there are and how people have changed their view on it. Andrew Cherlin (the sociologist of the article) does a great job going in depth explaining American marriage. He arranges the different marriages in three different categories; Institutionalized which was the earliest type of marriage, then Companionship around World War II, and currently we are considered Individualized.
Marrying someone is a big decision and a life choice almost everyone must make. It is the most beautiful relationship anyone could ask for. One thing to never do is make this life decision with someone that you are not happy with. In the article “What if Marriage is Bad for Us?” Laurie Essig and Lynn Owens describe the ways marriage affects us negatively. In contrast, I believe that marriage brings positive influence in our lives. If marriage was bad for someone, would it make them unhappy? Will it make someone think different on how they view the person they married? Maybe even cause an emotional state that brings loneliness or sadness?
Cases of fraud have been increasing over the years, and different agencies and authorities that have the task of subduing fraud have to get involved and put a stop to it. In the instance of which fraud has been uncovered, it is crucial to be aware of the red flags that were present in relation to fraud and associate them to the factors related to the fraud risk assessment. On August 23, 2013, the Department of Human Services (DHS), Office of Program Review, Monitoring and Investigation (OPRMI), Fraud Investigation Division (FID) received a report of overpayment from the Economic Security Administration (ESA) for Suspected Intentional Program Violation (SIPV) for former District of Columbia (DC), Supplemental Nutritional Assistance Program (SNAP) and Temporary Assistance for Needy Families (TANF) recipient, Elva Hernandez (Ms. Hernandez). Data from the U.S. Department of Homeland Security (DHS) shows that approximately 4.4 million persons are in a visa limbo awaiting to be adjusted, which 97 percent have a qualifying family relationship to a U.S. citizen. After the preliminary information surrounding the need of the program is assessed, the most helpful information would be to find out how many cases of fraud there is in a given year. Knowing how relevant the problem is that exists would be a great place to start in finding a solution. Additionally, for the controversial solutions that have been introduced, such as the fingerprinting methods, more substantial data needs to be analyzed to determine the success of the program.
The first piece of information to be gathered would be centered on Charo’s visa status and the solicitation of an attorney as governmental processing of documents regarding immigrants can render chaotic by the loosing of documentations alone (Jasso, 2011).
The successful completion of the I-130 marriage-based Immigration Benefit Fraud Assessment requires our Field Operation staff to have sufficient time to conduct case review, systems check, interviews and site visit. In order to estimate a reasonable time line to complete the I-130 marriage-based IBFA, it is important to examine the normal production time line for USCIS to process the I-130 marriage-based petitions.
