In light of your recent problems with mold in your bathroom, you have asked me to research who is responsible for paying for mold removal and what the procedure would be. After reviewing information from several sources I have drawn some conclusions for you that you can bring up in your next discussion with your landlord: Responsibility When discussing the situation with your landlord, it is important to know that, assuming the mold was not present when you moved in, you are going to be responsible. Given that you have not addressed this situation before, and you state in your situation that the spring weather has changed the color of your water, the mold must be a somewhat new addition to your bathroom decor. It is important to note that indoor mold grows in areas which are unclean and highly humid, making the bathroom a perfect breeding ground for the bacteria. To further your landlord's case, the section of the lease titled cleanliness and safety states that you (the tenant) “shall use in reasonable manner all electrical, plumbing, sanitary, heating, ventilating and other facilities and appliances on the premises…” It is your responsibility to use the fan to properly ventilate your room so that mold doesn’t grow. Because there is mold, you are in violation of the cleanliness and safety section. You probably want to argue that the bathroom should have a window for further ventilation, but since this particular room is excluded in Rhode Island’s Housing Maintenance and Occupancy Code definition of a “habitable room,” a window is not required.
