Adam got an invitation from his friend to go to a baseball game. Adam is not familiar with the game of baseball and has no knowledge of the game or know what happens at baseball games. Because he immigrated to the United States. His friend purchased some seats just a few rows up from the field, along the first base line. Majority of baseball stadiums have nets hung behind home plate and not along the baselines. While enjoying the entertainment of the game.
Bradley Jones, a player got into an argument with the first base umpire who called him “out” because he thought he was “safe”. Bradley got upset and threw his batting helmet to the ground. The helmet bounced off the ground and flew into the stands, striking Adam on the side of the head causing serious injury. Adam never saw the helmet coming be he was looking around the stadium.
Bradley Jones should not have been that upset. He should have left it up to the manager to handle that situation. Bradley owe Adam a duty because as a player, Bradley duty is to act as a reasonable and prudent person. Bradley was the one doing the action that injured Adam. As for an invitee the owner must maintain the premises in a reasonability safe condition under the circumstances. The owner of the stadium could have prevented this type of situation from happening. Like some baseball stadiums they have small nets up along the first base line. Also as for tickets that states in very small font “fans and spectators should be attentive and aware of potential objects coming into the stands, such as foul balls. “ The owner should have make it more clearly and large able and not put it on a ticket.
