As outline by the Webster dictionary civil liberty is the fundamental individual right protected by law and expressed as immunity from unwarranted governmental interference. Civil rights on the other hand per Webster is the right or rights belonging to a person by reason of citizenship especially including the fundamental freedoms and privileges guaranteed by the thirteenth and fourteenth amendment and subsequent acts of Congress including the right to legal, social, and economic equality. 1 Similar in meaning both civil rights and civil liberties are slightly different as well. I will first explain the similarities and differences between the two. After explaining this I will give examples of two court cases that represent both a civil right and civil liberty situation.
To start, civil rights and civil liberties are both basic rights that you have being a United States citizen. Both protect you legally by law from unequal treatment.
In contrast, they are both different because civil rights are characteristics that allow you to be free of unequal treatment. These rights include sexual orientation, gender, race, religious preference, and disabilities. 2 However, civil liberties are rights that are guaranteed by law either in the Bill of Rights or the Constitution. Civil liberties include the right to vote, bear arms, marry, privacy, speech, remain silent in an interrogation, the right to a fair trial,
