Everyday you consume things may it be food, drinks, or prescription drugs. Most people will just absent mindedly intake these products subconsciously knowing that they are monitored by government organizations ensuring your safety. It has not always been that was and has progressed greatly throughout the years. although all consumer safety organizations may not be reputable, they do much more good than harm. Consumer safety is something that is extremely important to the American family, and has help thousands of people survive. Consumer safety is something that has allowed America to progress to where it is today.

In 1971 President Nixon declared an all-out war on drugs, now over a million non-violent drug offenders live behind bars. The war on drugs has been the longest, most costly, and destructive war in the US history as of today (Booth , 2007). The war on drugs focuses on the poor people, and not the bankers that launder the money. In 1973 Nixon created the DEA, which stands for Drug Enforcement Agency. The DEA is a federal agency responsible for enforcing laws and regulations governing narcotics, and controlled substances. Their job is to immobilize drug trafficking organizations. When Nixon declared the war on drugs in 1971, the federal budget was 101 million dollars, going into the year 2000; the federal budget allegation was 20 billion dollars. Half of what we spend in the court systems and prison is drug related (Booth , 2007).

On January 17, 2006 in a 6-3 vote in favor of Oregon, the court declared that Congress intended the Controlled Substance Act (CSA) to only prevent doctors engaging in elicit dug activity and not to define the states standards of medical practices. Attorney General John Ashcroft made use of the CSA to prohibit certain medical practices illegitimate, including the allowance of doctors to prescribe lethal doses of medication to terminally ill patients (the Death with Dignity Act). The court’s ruling in favor of Oregon was a legitimate decision, because Attorney General John Ashcroft did not have the authority to declare certain medical practices illegitimate.

The history of drug use dates back for thousands of years with diverse purposes throughout humanity. According to Levinthal (2012), the drug-taking behavior gained federal awareness in the early 1900s, due to the lack of drug control regulations. Moreover, Levinthal (2012) mentions four major drug control laws which were established, including: (1) The Harrison Narcotic Act 1914, (2) The Marijuana Tax Act 1937, (3) The Boggs Act 1951, and (4) The Controlled Substance Act 1970. The drug control laws formed help regulate importation, manufacture, selling, or distribution of drugs within the United States (Levinthal, 2012).

The war on drugs has proven to be a long standing complex issue in today's society. Decades after Regan declared America's stand on the drug epidemic, this subject is still a topic of conversation amongst the government, local and federal, along with concerned citizens. America has made little to no progress in decreasing drug addiction and distribution in communities and has yet to find a solution on how to stop drug pollution. Many years later, with still or solution, one may ask, is this indeed a judicial issue? Or it is a legislative problem? Why has the government been ineffective 30 years later? Drugs have been used for hundreds of years for medical, religious, and psychotherapy purposes. As psychoactive drugs became more popularly used for recreational use and were being introduced in new ways, there became a strong need for control and regulation. The Controlled Substance Act was implemented to take a stronghold on the growing drug problem in the United States. The advancement of science and technology continuously present a need for new ideas and legislations; to keep a strong hold on the war on drugs. Whether the United States can keep up with the changing epidemics and tackle them head on, proves to be a main concern.

The Drug Enforcement Administration or the DEA is a federal law enforcement agency under the U.S. Department of Justice. The DEA was created to stop drug smuggling and the use of drugs in the United States. It was created by President Richard Nixon through an Executive Order in July of 1973. President Nixon created it as a response to what he had declared was “an all-out global war on the drug menace”. It took many months for the U.S. House of Representatives and the U.S. State Senate to look over all the testimonies on President Nixon’s plan to create one single federal agency to have control over the government’s drug control activities and was approved.

The National Drug Control Policy was created by Obamas Administration and focuses on areas such as substance abuse, drugged driving, and prevention. Other areas it focuses on are healthcare, marijuana, and methamphetamine. There are good policies recommendations such as preventing drug use before it begins, allow treatment for millions of Americans, and take a smart on crime approach drug enforcement. The policy does have some issues such as using words like addict to push people away from wanting to receive help because they do not want that label. In order to become a DEA Agent, a rigorous hiring process is needed to ensure only qualified applicants become part of the country’s elite drug-fighting team. The first step would be to meet with a recruiter. To join the DEA, a bachelor’s degree and/or experience related to the field is the first requirement (The United States Department of Justice: Careers). After this is met, one can contact their local recruiter and apply through them. Once the application is completed, a Special Agent Applicant Orientation is held at the closest recruitment office. The DEA actually stands for, “the Drug Enforcement Administration” this administration was created in 1973 by President Richard Nixon (DEA). The Drug Enforcement Administration was created to have greater impact on stopping drug deals and any type of drug distribution within the United States. Many people believe the DEA is separate from the other law enforcement agencies, but the Criminal Justice System all comes together to prevent any drug related incidents and stop them whichever way that they can.

Narcotics and Dangerous Drugs with various other law enforcement and intelligence gathering agencies, including the ODALE, was given the responsibility of enforcing the nation’s federal drug laws. It’s enormous sphere of influence is reflected in its Mission Statement which states among other things; “The mission of the Drug Enforcement Administration is to enforce the controlled substances laws and regulations of the United States and bring to the criminal and civil justice system of the United States, or any other competent jurisdiction, those organizations and principal members of organizations involved in the growing, manufacture, or distribution of controlled substances appearing in or destined for illicit traffic in the United States…”(15) The DEA was designed as an American agency with an international agenda.

In 1971, Richard Nixon declared a war against drugs. Today, it still continues to be a huge failure, leading to mass incarceration in the U.S., corruption, violence and human rights abuses across the world. The DEA, or Drug Enforcement Administration, focuses on eliminating the supply of drugs and incarcerating drug traffickers. This strategy is inefficient because of supply and demand. If one attempts to eliminate the supply, then new ways will be found or new producers will produce due to demand. An example would be crystal meth. the U.S. government tried to stop crystal meth’s production by outlawing or regulating the sales of chemicals required to make it (“Controlled Substances Act”). In response, thousands of small-scale meth production labs popped up using unregulated chemicals. The U.S. then regulated those chemicals, which then only let the cartel, of whom have more experience and skill, to take over. With a less than 1% success rate, the DEA is still being funded around 30 billion dollars (Performance Budget). The reason most of the drugs in the U.S. are illegal are due to racist ties, this includes heroin (opium), marijuana, and cocaine. The U.S. should end the war on drugs and instead focus on the rehabilitation and discharge of drug abusers, users and dealers.

FOOD DRUG AND COSMETIC ACT 1938, (FD&C ACT) according to this act it is illegal to import prescription drugs which are not FDA approved into USA by individuals or groups. We (FDA) are a federal regulatory body of United States responsible for regulating the use of the unapproved drugs in United States. The FDA has a ban for importing the unapproved drugs from other countries. The United States Federal Food, Drug, and Cosmetic Act (Act) (21 U.S.C. section 331) prohibit the shipment of unapproved drugs, which includes the importing drugs from other countries. The importer can be liable for prosecution by the FDA.
