Assembly Bill 60: Driver’s Licenses

In the years prior to 1994 immigrants were permitted access to a driver’s license in the state of California, no matter what their immigration status was. Having access to a driver’s license enabled them to run everyday errands without the fear of being pulled over such as driving to work and dropping off and picking up their children to school.
In 1994 the the ability to apply for licenses in California was revoked. Immigrants were relegated to continuing their daily lives which meant operating a motor vehicle without a license. Regrettably, this has resulted in deportations, arrests, vehicle impoundments and even some tickets.

Under the prior law, in the case of a legal, non immigrant driver’s license applicant, the DMV was required to issue a temporary license if the applicant successfully completed the application and related requirements. The term of the driver’s license coincides with the dates a person is authorized to work in the United States.
AB 60 made several changes regarding the eligibility requirements for an original driver’s license or state identification. The legislation will allow persons who do not have legal presence in the United States to be eligible to apply for a California license.
AB 60 also, permits applicants to submit a federal taxpayer number rather than a social security number, as required by the department. The bill will increase fees for a specified driver’s license, and delete fees for senior ID cards.a)

The new guidance from USCIS creates a dilemma for employers who on the one hand are prohibited from hiring illegals and on the other hand are required to accept documents uniquely issued to undocumented immigrants.
While employers must now accept driver’s privilege cards, doing so does not necessarily expose them to prosecution should they hire an illegal alien, according to the USCIS guidance.
