Assembly Bill 60: Driver’s Licenses
In the years prior to 1994 immigrants were permitted access to a driver’s license in the state of California, no matter what their immigration status was. Having access to a driver’s license enabled them to run everyday errands without the fear of being pulled over such as driving to work and dropping off and picking up their children to school.
In 1994 the the ability to apply for licenses in California was revoked. Immigrants were relegated to continuing their daily lives which meant operating a motor vehicle without a license. Regrettably, this has resulted in deportations, arrests, vehicle impoundments and even some tickets.

Under the prior law, in the case of a legal, non immigrant driver’s license applicant, the DMV was required to issue a temporary license if the applicant successfully completed the application and related requirements. The term of the driver’s license coincides with the dates a person is authorized to work in the United States.
AB 60 made several changes regarding the eligibility requirements for an original driver’s license or state identification. The legislation will allow persons who do not have legal presence in the United States to be eligible to apply for a California license.
AB 60 also, permits applicants to submit a federal taxpayer number rather than a social security number, as required by the department. The bill will increase fees for a specified driver’s license, and delete fees for senior ID cards.a)

The new guidance from USCIS creates a dilemma for employers who on the one hand are prohibited from hiring illegals and on the other hand are required to accept documents uniquely issued to undocumented immigrants.
While employers must now accept driver’s privilege cards, doing so does not necessarily expose them to prosecution should they hire an illegal alien, according to the USCIS guidance.

The writer, Maribel Garcia Ochoa, begins her piece with making the claim that because of Donald Trump being elected, California shaped this “defensive” attitude. Then Ochoa supported her claim with the evidence of the immigration policy issue. In addition, she believes that, “SB 54 would prevent the use of state and local resources to assist federal deportation efforts.” In fact, SB 54 has been recently amended in Senate on March 6, 2017. There has been many laws and regulations passed, to try and prevent illegal migrants from working in the United States. In all states, businesses “Are required by federal law to check the legal status of all new hires. They must fill out federal form 1-9 to show that each worker holds federally acceptable residency documents, like a driver’s license or social security card” (Speizer 1). Although they must do all of those things, they are not required to check the authenticity of the documents. In Arizona that has all changed, a new law has been passed that makes it mandatory for all employers to participate in E-Verify “in which information from 1-9 documents can be checked through databases at the Social Security Administration or the Department of Homeland Security” (Speizer 2). This used to be something businesses could voluntarily partake in, but has now become mandatory in Arizona. Under this law they have created harsh punishments for employers who knowingly hire undocumented migrants. One of these harsh punishments includes the loss of the employer’s business license, if it is a reoccurring issue. They hope that this new law will decrease the amount of undocumented workers in the state and create more jobs for their own U.S. citizens.

An anti-illegal immigration legislative act in 2010 in the state of Arizona. The Support Our Law Enforcement and Safe Neighborhoods Act or Arizona Senate Bill 1070 required all aliens over the age of 14 residing in the country for more than 30 days to have registration documents in their possession at all times. This policy allowed law enforcement officers to determine a person immigration status whenever there was a reasonable suspicion of the individual being an illegal alien. According to the Legal Arizona Workers Act, which is also sometimes referred to as the “Employer Sanctions Laws,” came into effect on 1st January, 2008 (Legal Arizona Workers Act, n.d.). Although companies ask new employees for proof of authorized employment, if the employer determines that the documents appear to be genuine then employers are not held legally responsible for receiving false documents.
10) There is a group called the Mexican American Legal Defense and Education Fund that supports Cedillo 's idea of allowing illegal aliens to posses driver 's licenses, but feel that there should not be any background checks or other restrictions(Kline par. 13). The MALDEF feel that every citizen of Mexico coming into California should receive a license, whether they are criminals or not. The old bill, AB 1463, was vetoed in the year 2000 by former Governor Gray Davis. Davis stated that AB 1463 was an "invitation for fraud (House par. 9)." However, recently the new governor of California, Arnold Schwarzenegger, has been trying to bring a new a bill with more qualifications ,such as a special mark on the licenses to indicate that the holder is illegal, to help bring driver 's licenses to illegal immigrants (Kline par. 12). With this bill in effect, illegal immigrants would have the opportunity to vote for an official of the state and country they are living in illegally.
