On Decemeber 15, 1791, the First Amendment was passed along with 9 other amendements in the "Bill of Rights." The purpose of these amendments were to address the concerns of the Anti-Federalists that the "U.S. Constitution" did not protect the citizens from the government infringing on their rights. The Freedom of Speech is defined as the right to express any opinions without censorship or restraint and has been at the center of many heated cases in the United States and across the world.
After reading the transcript of the speech, “The Spirit of Liberty”, given by federal judge for more than 50 years, Learned Hand, who served most of the time on the U.S. Court of Appeals for the Second Circuit in New York, my idea of what it means to be an American was slightly shifted. The statement made by Hand which really caught my attention was, “What do we mean when we say that first of all we seek liberty? I often wonder whether we do not rest our hopes too much upon constitutions, upon laws and upon courts. These are false hopes.” I agree with Hand in the sense that the constitution can only serve purpose to our country if we, as Americans, learn to be truly accepting.
I am writing this letter with concern to two of the amendments written on the US constitution.
The freedom of speech protected under the Frist Constitution in addition to other beloved values has often struggled in the world with its concept of what’s exactly determined as free speech and what’s not. In other words what’s free speech meaning that a person can state his or her personal opinion as opposed to Hate speech which is meant to offend threatens and insults groups, based on race, color, religion, national origin, sexual orientation, disability, or other traits. It seems that in some circumstances the law has to decide to protect some and not others. Take the case Miller vs Davis (2015) as an example of the law deciding which person to protect. A woman named Miller Davis a country clerk of Rowan County, Kentucky refused to issuance marriage license to same sex couples. She claims to as, doing so would go against her religion and would continue to not give out licenses as she was protected under the Frist Constitution. Davis said in a Kelly File Interview,” Same sex unions destroy the sanctity of marriage”. To some this may have been seen as someone just practicing their right but denying someone their right to marriage based on sexual orientation is a hate crime. That was the difference that made the couple Carmen and Shannon Wampler-Collins and three other anonymous couples file a lawsuit against Davis. The lawsuit claimed that Davis was breaking the law by not giving all couples including same sex couples a license for marriage. Admittedly that’s where this
I am writing about the first amendment which gives people the freedom of speech and it gives people freedom of practicing any religion they want. “Congress shall make no law respecting an establishment of religion, or prohibiting the free exercise thereof; or abridging the freedom of speech, of the press”. To some people the first Amendment is one of the most important Amendments because it gives people the right to say things they want to say, and it gives people the right to practice any religion they want. Established in the Constitution, written in 1787, the Constitution guaranteed the citizens of the United States the rights of freedom of speech, religion, press, and assembly in the First Amendment etched in the Bill of Rights. Throughout history, many Americans have experienced restrictions of freedom of speech during the United States earliest years as a country. John Adams, the second president of the United States, established the Alien and Sedition Act, which impeded upon Free Speech by restricting citizens from criticizing the government and president of their actions. Therefore, through the 1st Amendment, citizens should remain protected of their liberties in every aspect until they confiscate others of their liberties, and it should protect hate speech unless an individual’s liberties are in danger or under threat. The Supreme Court should define hate speech as threats that present another individual in obvious peril.
Free speech is something the constitution promised, but it seems as if the people of this country suddenly forget about it. Free speech is a given with America, as most countries do not have free speech. Some people may even immigrate to America for free speech rights. Now, apparently, free speech is offending so many sensitive teens, and all who offend others another shall be “silenced” by their peers. As people of the United States, since we were first formed, we have stood up and put our hands over our hearts for those who have lost their lives for our country, but as time has passed, some of us have stopped standing and or putting our hands over our hearts and holding up fists instead. Is this such a bad thing to do? We as people are required to do the same thing and live the American dream. Every. Single. Day. Ever since preschool or kindergarten, we are supposed to stand up, say the pledge and do it with our hand over our heart. There have been some issues with students sitting down or holding up a fist at the side of them, this is seen as a problem, but as always, there are two sides to everything.
The right to freedom speech is one of the many great reasons America is one of if not the best country on this planet. America for ages has been a home for all and place where anyone can be themselves. However, what happens when these rights are tampered with and questioned? What happens when freedom of speech is no longer a guaranteed right? The supreme court case Island Trees School District v Pico dealt with a scenario where this right was essentially dissected. The Island Trees School District board made the claim that specific books amidst the school library were promoting anti american, anti-christian, anti-semitic, and just plain filthy ideological constructs. You are wrong when you say that we should shut down news outlets when they broadcast information that you do not like because freedom of speech applies to news outlets.
Being citizens of the united states of America, American people given certain rights and privileges. Imagine that a group of students are interested in the same things but the school will not allow them get together and talk about their interests. This makes students and parents furious and they disagree with the school. School clubs should not be monitored because it violates the the First Amendment, it demonstrates valuable skills,and it enables children to develop character.
It is thoroughly stupid to philosophically argue for or against something on the basis of law. After all, laws are man made, and if it were always right and just for one to argue a side using the premise that it is the law, then it would still be legal to enslave our fellow man. Thus, for the purpose of discussing the merits or faults of free speech, any legal argument shall be abandoned. This includes the anti-free speech argument that private entities have a right to restrict free speech since their very privity protects them from government intervention as well as the pro-free speech argument that the First Amendment to the Constitution protects these rights of free speech. Instead, free speech will be examined for what it is in the most general sense. We shall examine why we have come to cherish free speech in the first place and if we are right in doing so.
What exactly entails of freedom of speech? It is the right to communicate fully your ideas and opinions without having to be afraid of how the government will retaliate or censor your words or sanction by the society at large.
