Ever since the first prison opened in the United States in 1790, incarceration has been the center of the nations criminal justice system. Over this 200 year period many creative alternatives to incarceration have been tried, and many at a much lower cost than imprisonment. It wasn’t until the late 1980’s when our criminal justice systems across the country began experiencing a problem with overcrowding of facilities. This problem forced lawmakers to develop new options for sentencing criminal offenders.

For over centuries, the only form of punishment and discouragement for humans is through the prison system. Because of this, these humans or inmates, are sentenced to spend a significant part of their life in a confined, small room. With that being said, the prison life can leave a remarkable toll on the inmates life in many different categories. The first and arguably most important comes in the form of mental health. Living in prison with have a great impact on the psychological part of your life. For example, The prison life is a very much different way of life than what us “normal” humans are accustomed to living in our society. Once that inmate takes their first step inside their new society, their whole mindset on how to live and communicate changes. The inmate’s psychological beliefs about what is right and wrong are in questioned as well as everything else they learned in the outside world. In a way, prison is a never ending mind game you are playing against yourself with no chance of wining. Other than the mental aspect of prison, family plays a very important role in an inmate’s sentence. Family can be the “make it or break it” deal for a lot of inmates. It is often said that “when a person gets sentenced to prison, the whole family serves the sentence.” Well, for many inmates that is the exact case. Mass incarceration follows those who are released from prison through exclusion and legalized discrimination, hidden within America. The New Jim Crow is a modernized version of the original Jim Crow Laws. It is a modern racial caste system designed to keep American black men and minorities oppressed with laws and regulations by incarceration. The system of mass incarceration is the “new Jim Crow” due to the way the U.S. criminal justice system uses the “War on Drugs” as the main means of allowing discrimination and repression. America currently holds the highest rate of incarceration in the world, and even more African American men imprisoned, although white men are more likely to commit drug crimes but not get arrested. In prisons today, rehabilitation, deterrence, incapacitation, and retribution are all elements that provide a justice to society. Prisons effectively do their part in seeing that one if not more of these elements are met and successfully done. If it were not for these elements, than what would a prison be good for? It is highly debated upon whether or not these elements are done properly. In America, crime rates are going up and prisoners are being released from prison with a wrong sense of direction resulting in their finding themselves back behind bars within a short period of time after being released for an action that could have been prevented if the proper precautions had been taken. Prisons need to put forth the effort to resolve these issues and make America’s streets secure again. The criminal justice system in prisons is a rising concern in this country that is affecting many and it is time it was improved by reforming the inside of prisons, providing prisoners with more when released, and keeping them under surveillance after release to help ensure they will not return to prison, thus keeping crime at a lower rate.

The United States prison system struggles eminently with keeping offenders out of prison after being released. According to the Bureau of Justice Statistics, more than third of all prisoners who were arrested within five years of released were arrested within six months after release, with more than half arrested by the end of the year (Hughes, Wilson, & Beck, 2001). Among prisoners released in 2005 in 23 states with available data on inmates returned to prison, about half (55 percent) had either a parole or probation violation or an arrest for a new offense within three years that led to imprisonment (Durose, Cooper, & Snyder, 2014). Why are there many ex-offenders going back to prison within the first five years of release? Are there not enough resources to help offenders before or/and after being released from prison.

In “How to Lock up Fewer People,” Marc Mauer and David Cole argue that the prison system in the US needs to be improved. America’s incarceration rate is far too high, and it must be reduced. To make their argument, they use many facts and shocking statistics. The authors state the problem at hand, recognize the obstacles, and push for reform.

Within this paper, you will find a comprehensive review of the United States prison system, and why it needs to analyzed to better support and reform the people of this country. I plan to persuade the other side (politicians and society) into seeing that the way the prison system is now, is not ethical nor economical and it must change. We have one of the world’s largest prison population, but also a very high rate of recidivism. Recidivism is when the prisoners continuously return to prison without being reformed. They return for the same things that they were doing before. So, this leads us to ask what exactly are we doing wrong?
