Juveniles can be seen as a danger to society. Many people dislike childish kids that do not behave and that are a bother to society. But we should stop and think and ask ourselves, do we really know what they are going through in their household or at school? Society should not judge the juveniles by the way they look, dress or even by the way they interact with people. A juvenile should be should be convicted as an adult by court until found guilty. Violence is endorsed and can be easily captured onto a child's mind and therefore can be put in play in a little scenario later down the road. Lionel Tate was charged with 1st degree murder as he had a girl on a headlock and slammed her on the floor and afterwards he stomped on her with no mercy. Tate decided to mimic a wrestler, what is this saying about our juveniles. Television is not providing the best source of inspiration to our young ones. Many of these juveniles are the ones forming gangs. They also the ones drug dealing,enacted in robberies and are mostly like to be the ones committing murders. Therefore if they were to be tried as as adults and put in adult prisons, they would probably think more seriously about their acts and next time think twice of what they are going to do.
First off, their brains are lacking the cells to inhibit violent expressions and self-control which explains their hostile nature. An adult conviction would be open to the public which will most likely create a barrier to employment. Juveniles should never be put into adult facilities, due to the lack of proper care for the youth in these buildings. For example, most adult facilities do not provide proper education. Some don’t even provide any at all for the juveniles. “A 2005 survey of adult facilities found that 40 percent of the jails and prisons had no educational services” (Curley). Therefore, the educational lag could impact their future career options, and could make them indigent for the rest of their life. “Many juveniles are placed in isolation, which can severely exacerbate or even cause mental disorders that have the potential to affect them for the rest of their lives.”(Curley). Juveniles and adults have been segregated in just about every aspect of life for most of this country’s history. Juveniles are equal to adults, obviously, but they are not entitled to the same privileges and are not subjected to the same responsibility as adults are. But for some reason, juveniles must be considered as adults when it comes to the court system. Adolescents should definitely be punished for their inexcusable actions, but they still have lots of years of maturation ahead of them before they are fully developed mentally.
Distinguishing between juveniles and adults has not happened in years and it will continue as young children are being charged as adults and that’s because the system has not changed. Heinous crimes are committed every day in the United States. Each year thousands of juveniles under the age of 18 are arrested. The debate of “should a juvenile be tried as an adult” is one of the ages. Many would like to argue against the idea as they believe firmly in rehabilitation. But what happens when the crimes are so violent the family is unable to recognize the victim, or when the juvenile shows no remorse and then goes on to harm others. At what age should one be held accountable for their actions? At what age is a person taught right from wrong? A juvenile is someone in many states age 18 and under, but here in the state of Texas a juvenile is consider 17 & under. The people who agree that juveniles should be sentenced or tried as adults are the families of the victims, and the majority who acknowledge an adolescent should know right from wrong. I believe that juvenile offenders should be convicted on a case by case situation, not being judged on a rigid scale that can’t be altered. On one hand juveniles shouldn’t always be convicted as adults. On the other hand, they shouldn’t always be sheltered from that possibility.
Juveniles can not account for their own actions due to a lack of mental maturity. “Adolescents are less mature than adults in ways that make them more impulsive, more short-sighted and more susceptible to peer influence” (Steinberg). As such, Juveniles are less mature and do not process the possible consequences. Although juvenile crime tends to go unrecognized, it is a major issue in America and happens to go unrecognized. There once was a time when society did not place emphasis on the special needs of juveniles. In most cases children were taking on adult roles to help their families survived, which caused them to struggle with identifying themselves in society. They were also subject to the same consequences that adults received when they did something that was considered morally wrong, forcing them to grow up before their time.
Juveniles should be able to face life imprisonment because adolescents who have committed major crimes need to learn that with a serious action, comes a serious consequence. I was extremely convinced of this after reading the article “kids are kids- until they commit crime” by Marie Lundstrom. She claims that juveniles are really are just children however we continuously push for harsher sentencing on them (Lundstrom Par. 5-6). It’s honestly disgusting how harsh society can get pushing life sentences on twelve year olds Lundstrom and many others have stated that their reasoning has not fully developed yet (Lundstrom Par.14) . We see juvenile offenders as monsters and try to lock them up for the rest of their lives when they haven't gone through even a quarter of it. Gail Garinger is a juvenile court judge who was appointed by the governor said something very relevant to this case. Garinger believes that we cannot place these juveniles into the system with fully fledged adult criminals (Garinger Par.7) . This is the worst thing we can do for them, instead of giving them a chance to correct their wrongs we place them among societies worst influence and leave them to the animals in prison. This is truly giving up on the juveniles because here they are exposed to the negative influences for the rest of their lives.
In our society, violent crimes are a big problem and some are caused by juveniles. These juveniles are even tried for an adult conviction which they don't even deserve. They go to prison for life without parole for not having the chance to correct their mistake. I agree with the majority of supreme court justices banning the cruel and unusual punishment for juveniles who committed murder. Juveniles who committed such crimes don't have a fully developed brain and they have a rough family background.
In the society we live in today, juvenile justice is a nation wide concern of law enforcement. A juvenile is a person that is seventeen years old and under. In august of 2005, the United States Supreme Court agreed to consider the constitution of adding a death penalty for juveniles who do heinous crime but only in certain states . The recklessness of juveniles leads them to committing violent crimes is due to the fact that they are still biologically mentally developing. Another reason juveniles should not be tried as adults because they are influenced by what they see. If we were to charge juveniles like adults studies shows that they would be in more danger and also less of a chance for rehabilitation . Juveniles are going through a lot of development biologically speaking, it would be unjust to impose adult sentences because it would not help them rehabilitate, but it will result to a dangerous outcome of their future.
Crimes can be committed by everyone. The age of criminals have decreased as the crime committed increased in violence through time. Innocent lives are often lost in acts of violence, such as what had happened at Columbine. Children who commit malicious crimes can either be tried as a child or an adult. Children tried in the juvenile court systems are able to get out of jail around or before they turn 21. Juvenile courts are meant to rehabilitate children who are said to be too young to understand their actions. Adults who commit the same crime as children are believed to be fully aware of their actions and the repercussions. If a child is tried as an adult, then the child can be given a longer sentence. Children who commit serious crimes should be tried as adults.
