Probation Is Inhumane

Despite the fact that my parents have worked in the criminal justice system for many years, I have never given much thought to the treatment of prisoners. As we learned from the readings, the current state of the United States criminal justice system is imperfect to the point of cruelty to those involved in it. This is truer for individuals with a mental illness. Due to a lack of psychiatric facilities throughout Alabama and overcrowding of those that do exist, many criminal offenders with mental illnesses are sent to prisons instead. State prisons are currently overcrowded, leading to substandard conditions such in almost every aspect.

Incarceration is thought of as a positive form of punishment, and negative form of punishment. The opinion varies with the type of person, and their experience from jail if they have gone. Most inmates while in prison will tell you it is a horrible place that should be gone. That would allow criminals to be free and that would let them cause harm to others or other illegal activities. Incarceration was not designed to be a paradise, it is a detention center for the bad, and meant for them to be punished. Without jails the world would be filled with even more evil, and would leave people in more danger than they already are.

When we think about solitary confinement we probably think of a killer or rapist getting what they deserve. What we don’t see is another human life being psychologically destroyed. Some of these prisoners have been in solitary confinement from a couple of years to decades. It is true that these are not honorable or peace keeping men, but a human life being tortured by solitude is a torture no one deserves.

Probation serves as the most frequently used sentence for those convicted. This is evident when you consider that the United States justice system oversees nearly 7 million people. Over half of those, a staggering 3.7 million people, are on probation with another 840,000 on parole (Rabuy, 2017). With those individuals representing the largest percentage of the American corrections system, it is important that we learn as much as possible about probation in order to improve the success of these programs. The process of filing a violation with the court can be a lengthy one with a massive amount of paperwork. As a result of the excessive work required, many probation officers will avoid this process at all costs. Instead the probation officer may require that the individual increase the frequency of the meetings and/or require other changes to the probationer’s guidelines.

On April 14, 2014; the offenders probation complaints were received by the Probation office’s intake department. Thus community supervision had commenced. Ramsi, great job on this discussion. I think that you did an amazing job at making valid points throughout your post as to why you would file a violation report. I agree, as an officer you take an oath to uphold the law and all that comes with it. As a parole officer it is your duty to ensure that the offenders are following the guidelines issued by the judge and if the offender does not comply with the terms they will be sentenced back to person. In addition, in this situation the mother is smoking marijuana which is in violation of her probation. Therefore, I agree that she needs to be punished because was aware of her terms and conditions, but decided to smoke. In my opinion, there are other ways to cope with stress besides smoking marijuana.

A crucial part of the criminal justice system includes probation. Probation is the release of a criminal offender from detention or incarceration. At this time, the offender is subject to a period of good behavior under supervision. Probation is also referred to a kind of punishment that is giving as part of sentencing. Instead of giving an offender a longer sentence, a judge will order the defendant to report to their assigned probation officer on a regular basis, where the offender will receive a schedule instructing him or her of their probation requirements. If the defendant does not obey a probation order, the defendant will automatically return to jail or to court, only to be given a longer sentence by the judge. A person on probation is not allowed to leave the judicial district without permission of the probation officer or court (Seiter, 2011). The probationer shall report to the probation officer as directed and shall submit truthful and complete reports (Seiter, 2011). A person on probation must also follow all directions instructed by his or her probation officer truthfully. When on probation, an offender must obtain employment and needs to notify his or her probation officer of all changes of address within a three-day limit. John Augustus were known as “Father of Probation." He released an adult drunkard into his custody rather than sending him to prison. Later on, he convinced the court to release more offenders to his supervision including children who had been accused of stealing. By 1846, about thirty children were under his supervision, and eleven hundred persons were bailed both male and female by Augustus (American Probation and Parole Association).

According to the Bureau of Justice Statistics, “probationers are offenders under adult supervision who are placed on supervision in the community by the court, generally as an alternative to incarceration”. Conditions of probation vary greatly among jurisdictions. Some offenders who receive probation may have a split-sentence imposed. This means they are incarcerated for a period of time and then are released on probation. Once on probation, an offender receives an order they will be on either active status or other orders may be deemed an offender as on inactive status.
