Who would have thought that a school administrator would have to worry about law as much as they do today? I knew being an administrator required knowing the school laws and other education related legal information. What I did not realize was the depth of knowledge that it involves. This course as well as an interview with my principal opened my eyes to this truth. I interviewed Mercy’s principal, Ms. Sarah Regan, which allowed me to gain different perspectives on everyday situations. First, I will discuss some school law issues that will impact the future, then share some advice for upcoming administrators, and lastly, make some notes on handbooks and how to make effective changes.
Future Issues in School Law
One issue that Ms. Regan foresees involves transgender laws. These types of laws would affect many aspects of the school, in particular, single sex schools and athletics. With Mercy being a same sex (all girls) high school, we have not run into an issue thus far but she predicts this will become an issue soon as well as becoming a more prevalent issue in the public school system (S. Regan, personal communication, November 1, 2016). Once this situation arises at Mercy, we will want to make sure we have all of our legal issues in order and watch for any discrimination. According to Cambron-McCabe (2014), “students are protected against discrimination based on sex, including sexual harassment by educators and peers” (Cambron-McCabe, 2014, p. 133). This could

Attempting to obtain information about the district lawyer was harder than I thought. Not lot information was provided. According to the administrators usually in an elementary setting are not so common encounter litigations. Because I was not able to contact the district’s lawyer, the administrator assist me answering some of the questions presented here. The relationship between the law and my school are base in basic standards as curriculum adoption, testing and establishing standards, free and appropriate public education, determining where students can attend school, but nothing as a big litigation against the school. One current court case is dealing with a federal judge releasing an injunction to momentarily restrict transgender students from using school bathrooms as well as locker rooms of their choice (Eldeib). In blocking students from using something as simple as a restroom or locker room, a student’s identity can be misconstrued. Especially with a student who may already feel differently about their identity. A mother in Denton, Texas, hopes to change the legal problems revolving around the controversy of bathroom laws in Texas schools. Amber Briggle states her 8-year-old transgender son has felt he needs to wait to use the restroom until he would arrive home. As well as this, Briggle confirms her son, MG’s grades dropped drastically. His grades continued to worsen until he was given a restroom alteration, allowing him to feel comfortable. (Wright). Along with MG, many students do not feel safe in their schools because of having to hide their transgender identity. Students may not feel safe just because Texas is such a conservative state. Ken Paxton and other state leaders even exchanged in transphobic rhetoric at the 2016 Texas GOP convention. Because of the strong conservative viewpoints in Texas, young people as well as students in the area may not feel accepted as who they are, leading them to disguise their true self. School is already a tough time in a child or teens life, and being discriminated against because of how one identifies does not make a student’s lifestyle any easier. Because transgender students in Texas schools are entitled to free expression of gender identity, they are also permitted to dress how they please. People generally think that it is wrong to go through someone else’s stuff without their permission. This usually continues when you are in high school and the school administrator goes through your purse. This is what happened for T.L.O. when she was a freshman caught smoking marijuana in the bathroom and the vice principle thought that it was okay to look through her purse for proof of what she had done. They both obviously did something that was going to be seen as wrong to different people. Today we will discuss how the T.L.O. V. New Jersey court case was created, the steps that it went through and the final decision and how it still impacts lives today. The T.L.O. court case made an impact on schools especially students and their administrators.
Transgender LGB and transgender students face discrimination and harassment at school all too often. The benefit of becoming a school administrator will allow me to touch the lives of many students to help them achieve their life’s goals. Throughout the United States there are many different laws among the fifty states that make up this union. The laws are different throughout the states because of the need of the laws. Living in one state and not having the advantages or disadvantages of a law in another state would not be that unfair or unequal. This is true because if you don’t like a law in your state you could always fight it and try to change it or you could always move out of that state and go to one that has the laws that you like.
Student behavior and discipline in the classroom have been impacted by legislation and litigation as was discussed in an article written by Mitchell Yell and Michael Rozalski, The Impact of Legislation and Litigation on Disciple and Student Behavior in the Classroom. The authors believe that all students should receive their education in safe, orderly, and well-disciplined schools but maintaining these environments has become a major challenge for educators (Yell, M & Rozalski, M, 2008). Most states have laws that govern discipline in schools which also protect the rights of students in public education (Yell, et.al, 2008). These state laws control the actions of school officials when they carry out certain discipline-related functions, such as gathering evidence (e.g., searching students, their lockers, or their personal property), seizing contraband from students’ backpacks, or conducting any administrative actions that restrict a student’s property interest to attend school (e.g., suspension, expulsion) (Yell, et.al, 2008). When it comes to following school policies every teacher should be aware of what is in the student handbook. This tool is used to shed light on the different policies that the district holds parents, students and teachers accountable to. I am going to be honest and say before this essay I had not looked at the Round Lake Area School District 116 School Handbook. The reason why I have not looked at the handbook is the fact that almost all handbooks spell out the same policies. In this essay I will discuss the different policies and how I think my school district could improve on their policies.
