Hubert Patrick O'Connor, a bishop who was accused of committing rape and indecent assault on both female students and female staffs at St.Joseph’s school at Williams Lake, British Columbia, during his time as principal in the early 1960s. During the pre-trial process, the defense counsel ordered the disclosure of all medical and therapeutic record of the complainants. Proceedings were stayed by the trial judge because the Crown had not made full disclosure of all records requested by the defence. A controversy was ensued over the balance of rights between the accused and the victim in legal practices, since sexual assault cases tend to discriminate against Aboriginal women. Despite of the inarguable importance of the right of the accused to
Sexual assault is one of the most challenging issues that must be dealt with within the Canadian legal system. Sexual assault is defined as sexual activity inflicted upon someone without their given consent. In order for a sexual assault to be eligible for that title, a person committing sexual acts must continue to engage without the consent of the other person. Sexual assault is also heavily related to the rape myths that exist within society and these are the decisive factors when resolving a sexual assault case. These rape myths generally target the victim of sexual assault blaming them for the actions that occurred. The first case involving consent and rape myths to ever reach the Supreme Court of Canada to be resolved is the case of
Whether it is walking home alone at night, or going to a party and having some fun on the weekends, sexual offenders will attack because their primary motivators are power, control, and anger. Sexual assault is an ongoing crime on campus at Cal Poly San Luis Obispo. It can happen to anyone, male or female, and that is why it needs immediate attention and a plan for resolution.
The central issue of the Duke rape case includes Duke University student, Crystal Mangum, as the accuser of several Duke University lacrosse players of having committed sexual assault during a party that the players held in their house, which allegedly followed a stripping job Crystal Mangum performed for the players. After the allegation, a sexual assault kit was conducted and processed. Following the processing, it was found that none of the Duke University lacrosse players’ DNA was found in the sexual assault test kit. However, multiple other men’s DNA was found in the sexual assault test kit. With this knowledge, Durham District Attorney, Mike Nifong, continued to pursue the case, ignoring the results of the DNA sexual assault kit.

It would be wrong to say violence ends when you turn the television off or act as if injustice didn’t exist anymore, but if you reflect back on 2016 so far, one of the biggest topics that often dominates the news and blogosphere concerned the high frequency of assaults on college campuses around the country. In the place where many young adults begin to learn who they are and who they want to be while enjoying a comfortable freedom and safety among their peers discovered freedom and safety could not always be guaranteed.
described as any sexual act that is unwanted by somebody else. These acts incompass penetration with genitals and/or objects without consent, rape, unwanted sexual acts such as oral sex and touching of somebody’s body without their permission and is all about “power and control” (Sexual Assault). It is important to note the misconception regarding rape. Rape falls under the category of sexual assault not every case is rape (Sexual Assault). These abusive incidents happen on a day to day basis and it is not getting the attention and awareness that
According to The United States Department of Justice, Sexual assault is any type of sexual contact or behavior that occurs without the explicit consent of the recipient. Falling under the definition of sexual assault are sexual activities such as forced sexual intercourse, forcible sodomy, child molestation, incest, fondling, and attempted rape. (Department of Justice) 90 percent of the victims of sexual assault are women and 10 percent are men, and nearly 99 percent of offenders in single-victim assaults are men (Bureau of Justice Statistics 2010). Sexual Assault can happen to anyone, not just women. Sexual Assault these days are a big trouble and it is not being addressed in good order, and it is especially a big problem at the University of Kentucky campus. Although, many people think sexual assault on campus is not a huge issue, it really is and it is not properly spoken of. Even though people have different opinions on sexual assault, sexual assault is a big issue on campus and alcohol is largely to blame.
help support rape victims. One incident that happened recently that shows more reform needs to be done on college campuses was the Stanford case. Marina Koren reported in her article “Telling the Story of the Stanford Rape Case” that at about 1 a.m. on January 18, 2015, two male Stanford students were out when they saw a man on top of women by a dumpster. When the two men approach the scene the man took off revealing an unconscious half-naked woman. While one of the male students remained with the victim the other chased down the rapist and held him to the police arrived. This rapist came to be known as Brock Turner. Later on, during the trial, the woman
Imagine beginning your day with a comfortable pair of sweatpants matched with a loose fitted t-shirt. It is just like every other day, you go to school, see your friends, and enjoy your day. There is just one thing different, you take a ride with a male friend. You are not afraid, nothing could happen to you, you are perfectly safe. The next thing you know he’s on top of you, forcing himself onto and into you. This type of behavior is known as sexual assault, which is defined as “any type of sexual contact or behavior that occurs without the explicit consent of the recipient” (Department of Justice). Sexual assault has become an increasing issue in the world according to the Huffington Post, “2,780,000 (is) the estimated number of men who have experienced an attempted or completed rape since 1998” (Alanna Vagianos). Some believe that the number of sexual assault is increasing due to the population growing, others believe that sexual assault cases increasing is a result of the increase in reports in general. Due to the increase in mental issues among millennials, an increase in crime such as sexual assault has become a larger issue, heavily affecting the way society is balanced.

Currently in society it seems like fewer people comprehend the simple meaning of the word no. Records of sexual assault are going through the roof, because of the fact people do not understand that no means no. The main victims of sexual assault are women and statics show one in four women have experienced unwanted sexual content. People come up with numerous excuses of why to blame the woman for the experiences they face, which is wrong and make women question themselves. Women who are sexual assaulted are judged by themselves and by our society, which leads to many psychological problems. Sexual assault can happen to any type of woman and causes many psychological, emotional, and physical problems for their futures. Instead of blaming the victim for being targeted, because of what they wore or said, we should lay blame on the person who could not control their urges to and forcefully violated a person and caused them emotional harm.
Women, girls, men, and boys are vulnerable victims of sexual assaults every day in our country. While females experience much higher rates of sexual assaults than males. The problem that this country faces is the lack of being able to track rapist, in addition to the victims that chose not to report their assault of being raped to the police. Issues of under reporting comes from the victims with multiple reasons that hinders them from reporting these heinous criminal acts. Thus, the sad realization is that the perpetrator is usually some one that you know, that you would of never of thought that they could and would, and do sexually assault you.
On September 22nd, 2017, the U.S. Secretary of Education, Betsy DeVos announced that the formal rescinding of Obama-era guidelines regarding sexual assault on federally funded college campuses. These guidelines, commonly known as the “dear colleague letter,” worked under Title IX federal law to require a minimum standard of action that must be taken when allegations are made by or against a student. The most notable characteristic of the guidelines was the lowered the standard of proof necessary for universities to take action against individuals accused of sexual assault.
Sexual assault and rape are on-going issues plaguing college campuses all across the nation. In part, I believe this is due to a lack of education on what sexual assault actually is. All too often, victims are leaving these situations feeling confused about something that they will forever deem "a weird night". It often isn't until much later that they realize what happened to them was a violation of their body and of their rights.
“Rapes have spiralled as a lost generation of jobless, ill-educated men has reached adulthood and sought refuge in violence."
