Should Gay Marriage Be Legal? Essay

Gay marriage should be legal because as woman and man, all individuals have the same right in society; because same-sex couples can constitute a good based family; because it is just a way to make official a common union nowadays, even with the religious issue; because it is not related to polygamy; and because love matters and it does not differ in nature according to the sex of its object or the person who experiences it.

While it is not a personal choice for me, I see it best to support it for those who make that choice. In the Constitution marriage is not defined as the unity between a man and women, but the unity of two persons. As long as those two persons are both legal citizens of the United States then they should have full protection under the Constitution. This would include their fundamental right to marriage. Same-sex should be seen equal to opposite-sex marriage because the standards are no different. Just like in the case of Loving v Virginia, once you take away the factor of race or sexuality, you are left with the same principal foundations as you are of a hetero-sexual couple. Therefore it would be an act of discrimination to deny legal marriage to same-sex partners. Some will argue that the Bible defines marriage as between a man and women, and while that is true, it is not recognized by the court. Because it is stated in a religious doctrine and the United States has freedom of religion, this point can not be made legal valid in any situation and therefore is irrelevant. Another argument also commonly made in opposition to same-sex marriage is that its legality is within the power of the states and not the national government. While the power to issue marriage licenses is given to the state, that's not all that the case argues. It argues that

Same-sex marriage should be marriage because everyone is equal, love is always right, and people have a right to choose their own soulmates. First, equality is a basic right, which means everyone should get the same treatment. The restriction against same-sex marriage is an offense to the dignity of lesbians and gays, because it limits the range of relationship options open to them (Mello). The limit of same-sex marriage is against homosexuals to enjoy the same right as heterosexuals. It is not fair for homosexual to get the different treatment. I support same-sex marriage because I see no valid arguments against it. The majority of arguments against gay marriage are based on religious perspective. In the United States, the First Amendment to the Constitution guarantees separation of church and state. Therefore, religion should not have a place in either the formulation or implementation of legislation, including questions of who has the right to get married in this country.

With the issue of gay marriage, lines get blurred and religion rears its head to influence a government's decision of who shall be married and who will be refused. Denying the authenticity of one group of people's love is claiming that their love is inferior, which is just not the case. Love is central to everyone's life (Moats, 2004), not just those who others deem worthy. If gay marriage were to be legalized, people would gradually become more accepting of it as it becomes more commonplace. "‘People's minds are changed through observation, not through argument'" (Rogers, 2005, from Mohr, 1994). The more visible gays and lesbians become, the more accepting people would be of homosexuality as a whole- a principle that is already beginning to take effect in society today. We can go back, decade after decade, and see how our country has taken many strides in overcoming prejudices, such as civil rights, women’s rights, and interracial marriage. It thus prevents people from thinking that same-sex marriage makes homosexuals sinners. Marriage is a right that should be afforded to every individual whether they are gay or straight. Same-sex marriage thus helps solidify the appropriate social norm of sexual restraint and care-giving within the family. When a gay couple is legally allowed to get married, it saves them from having to sneak around and hide the relationship. Being forced to live a life of secrecy can take an immense psychological pressure on a person and places an unnecessary level of stress on the relationship. Having the chance to celebrate a relationship on a public level is great for anyone, gay or straight.

Since 1971 when the first same sex couple Richard John Baker and James Michael McConnell applied for a marriage license and were denied in the Baker vs. Nelson ruling, America has been forced to debate whether homosexuals should be allowed to be married even though they are not the classical definition of a couple. There are many opinions about this subject from government officials, religious leaders and even the president of the United States. Gay marriage is one of the most controversial issues in this modern world. In my opinion I do not consider “gay marriage” marriage, because marriage has always been a covenant between a man and a woman by its nature. When two men or two women “marry” it denies the reputation of keeping the human race and the raising of children. Gay marriage also violates the natural law, and we should follow “avoid evil and do good”, the natural law is for every human being in the world and we should follow it by marrying the opposite sex.
