Social And Criminal Justice System

Any criminal justice system reflects its society and its times. Currently, in my culture, the African American culture, people commit crimes for the number one reason being to feed their families. What is considered a crime? How does the Criminal Justice System work? How is the amount of time determined? Why do African American get more time than the white man? Why are more black men in prison than any other ethnicities? The Criminal Justice System is a social problem within the African American community. The following are the social problems within the CJS, how they became social problems and why is the Criminal Justice Systems (CJS) bias towards African Americans.

There are many key issues impacting minorities and women in the criminal justice system . Sexism still exists in the United States. Sexism against women is shown in the media and indicates that sexism still pervades in our society. Another key issue is the overrepresentation and disparities among minorities in the criminal justice system. After the act of September 11, racial profiling and other acts of racial hate crimes suggests that racism occurs. Another key issue that indicates that racial disparities occur in the criminal justice system is the overrepresentation of minorities in the Juvenile Justice system.

In the criminal justice system there is very rarely a single linchpin that can be pointed to and held responsible for the failure to convict a seemingly guilty person. This reigns true for the very public prosecutions of both Casey Anthony and George Zimmerman. In the eyes of a vast majority of the public, fueled by media spectacle and opinion, Anthony and Zimmerman were guilty even before they ever saw the inside of a courtroom. There simply could be no other answer. The public was subsequently outraged when, after what seemed to be trials of certainty, juries acquitted each. The public sought to find someone, or something to blame. The verdict could not be accepted and many turned their focus to condemn the workings of the criminal

The population of offenders in correctional institutions in the United States is at an alarming amount, and it doesn’t have to be. Each year 7 million offenders are absorbed and expelled from correctional institutions and jails, placing a heavy burden on the criminal justice system (Morgan, 2011). Many of these offenders will recidivate, and with rates that are estimated at 70%, means 4.9 million will eventually return to the criminal justice system, creating a vicious cycle of arrest, re-arrest, and imprisonment (Morgan, 2011). Among this population are offenders with mental illnesses that need to be addressed, or specialized care that needs to be administered. The U.S. criminal justice system is responsible for those who violate the law and to be punished according to the crime committed. The controversial issue between the extreme cases and justice served is whether or not capital punishment violates the 8th amendment. For the extreme cases that result in the death penalty punishment is brought upon by a 3 drug protocol also known as, lethal injection. Until 2009, majority of the states used a 3 drug protocol, including sodium thiopental used for anesthetic, pancuronium bromide for a paralytic agent, and potassium chloride to stop the heart (DPIC, 2016). In the United States the criminal justice system does not always create policies that affect everyone equally. There are many policies that seem to target a specific group of people, whether this is intentional or not is beside the point. The important thing is to change the criminal justice system in order to stop race disparities. Marc Mauer in his lecture speaks of the reason for the disparity between races when it comes to the incarceration rate, as well as steps that can be taken in order to elevate, and or stop the disparity in the criminal justice system. Other topics that Mauer covers are the impact that policies can have on a specific group in the United States, and the overwhelming disproportion when it comes to drug arrest, and the people who get arrested.

There are victims who never receive justice because of the expenses of it or they are wrongfully accused of a crime. Some people who commit non-violent crimes and are thrown into jail or prison endure abuse or rape. Non-violent and violent offenders need to be separated for their own safety. Correctional Agencies. Correctional agencies are all those in correction and they include prison, probation, jail, parole, community-based sanction such as house arrest and electronic monitoring. Their primary purposes are to punish, rehabilitate, and to ensure public safety [ (Shilton, 1992) ]. Responsibilities as stated by Professor Daly (2012) are to hold people on remand, hold people who are sentence to a term of imprisonment, maintain appropriate conditions for those in custody, provide activities that encourage learning and life skills, prepare inmate for release.

Violence in the criminal justice system is often tied to the military structure of police organizations. In such organizations officers are discouraged from providing input on how to perform in their jobs. Violent confrontations between police and citizens in particular have been targeted with corrective measures (Stojkovic, Kalinich, & Klofas, 2011). Throughout the course, we have analyzed the different levels of the criminal justice system and have broken down where the criminal justice excels, such as the different courts for juveniles that work to meet the needs of children, and other areas that need improvement. After researching many different healthcare systems around the world, it has been discovered that they all are far from perfect. Currently, the United States operates in a way in which the principles of a market justice and social justice system complement each other (Shi & Singh, 2017, p. 40). On 19 April 2017, a visit was made to the Ipswich Magistrates Court to observe and report on a matter being tried. The subject matter that was observed was a property damage and drug related offence involving the accused, Mr T and the Queensland Police Service. Both parties appeared either personally or by their lawyers. Although the offences in this matter were indictable, the trial could be dealt with before a magistrate. The matter was heard before His Honour Magistrate Aaron Simpson. The attendees present included: Senior Constable M, the police prosecutor; Ms O, the defendant’s lawyer; and the accused Mr T. The matter firstly heard all material facts, followed by the defence and lastly Magistrate Simpson attended

Criminal Justice in general terms refers to the agencies of government charged with enforcing law, adjudicating crime, and correcting criminal conduct in the society. The criminal justice system is essentially an instrument of social control used by the government. Society considers some behaviors so dangerous and destructive that it either tries to strictly control their occurrence or outlaws them outright. It is therefore, the job of the agencies of justice to prevent these behaviors by apprehending and punishing transgressors or deterring their future occurrence.
