The Importance Of Torture In The United States

Torture is something that is known as wrong internationally. Torture is “deliberate, systematic or wanton infliction of physical or mental suffering by one or more persons acting on the orders of authority, to force a person to yield information, to confess, or any other reason” (World Medical Association, 1975, pg.1). There is a general consensus that there is a right to be free from any kind of torture as it can be found in many different human rights treaties around the world. In “The Case for Torture”, philosophy professor Michael Levin attempts to defend using torture as a means to save lives is justifiable and necessary. Throughout the article, Levin provides persuasive arguments to support his essay using clever wording and powerful, moving examples. However, the essay consists heavily of pathos, fallacies, and “What if?” situations that single out torture as the only method of resolution, rendering the argument hypothetical, weak, and unreliable for the city of San Jose as a whole community to follow.

The topic of torture is a controversial topic in our society today. The primary reason that torture has been debated recently is due to terror atacks against United States citizens. The debate has once again been thrust into the forefront due to the rhetoric of then presidential candidate Donald Trump. On the campaign trail, Trump stated that he supported the waterboarding techniques used on terrorism suspects during the Bush administration

Torture is known as the intentional infliction of either physical or psychological harm for the purpose of gaining something – typically information – from the subject for the benefit of the inflictor. Normal human morality would typically argue that this is a wrongful and horrendous act. On the contrary, to deal with the “war on terrorism” torture has begun to work its way towards being an accepted plan of action against terrorism targeting the United States. Terroristic acts perpetrate anger in individuals throughout the United States, so torture has migrated to being considered as a viable form of action through a blind eye. Suspect terrorists arguably have basic human rights and should not be put through such psychologically and physically damaging circumstances.

Torture has been a sensitive subject in our government and among the people of the US. The article “Torture is Wrong-But it Might Work” Bloche about how even though torture is not moral to some, it can still provide effective results because of advanced techniques and psychological studies. He goes on to say that many believe it is effective but others will say it does not provide adequate results in interrogation efforts. Senators such as John McCain (R-Ariz.) believe it does not help at all; however, other government officials, such as former attorney general Michael Mukasey and former vice president Dick Cheney, believe it does (Bloche 115).

The War on Terror has produced several different viewpoints on the utilization of torture and its effectiveness as a means to elicit information. A main argument has been supplied that torture is ineffective in its purpose to gather information from the victim. The usefulness of torture has been questioned because prisoners might use false information to elude their torturers, which has occurred in previous cases of torture. It has also been supposed that torture is necessary in order to use the information to save many lives. Torture has been compared to civil disobedience. In addition, the argument has been raised that torture is immoral and inhumane. Lastly, Some say that the acts are not even regarded as torture.

Pfiffner points out that the United States Military, Secretary of State Donald Rumsfield, and President George W. Bush assumed a role in the events leading up to the exploitation, even though it has never been corroborated that President Bush or Secretary of State Rumsfield directly condoned the abuse.

The United States citizens have been wrestling with the question of, whether their government intelligence agencies should be prohibited from using torture to gather information. However, this all changed when in May 2004, The New Yorker released photographs from the Abu Ghraib prison in Iraq. The disturbing pictures were released on the internet showing bodies of naked Iraqis piled onto each other, others showed Iraqis being tortured and humiliated. There was a huge up roar, which caused the President at the time George W. Bush to publicly apologize, and threaten the job of Defense Secretary Donald Rumsfeld. Soon after, the CIA Conformed the use of waterboarding on three Al-Qaida suspects in 2002 and 2003, which further annihilated the topic. Since these reports, torture has been in the forefront of national politics, and the public opinion has been struggling to commit on whether torture is right or wrong.

Interrogational torture is one of the many tough ethical questions that people debate about in the United States. Is it right or is it wrong? Many believe that the United States does not practice intense interrogational acts such as torture. Many people have fought to abolish any form of torture while many fight to keep some forms of it to help keep the peace. Whether you believe in it or not, torture is and will always be an ethical dilemma that comes up.

As the country goes through its tenth year of the war on terror one can look back and see some of the policy differences that has plagued this country when, as a nation, our young men are sent to war. Gaul Rahman, a suspected Afghan radical, was arrested and brought to a CIA-run prison within six weeks of the 9/11 attacks. Rahman was detained for the purposes of providing inside information on the bombings, as well as to shed light on possible future terrorist attacks to be committed on United States soil. A month after his arrival at the prison, guards entered his cell to discover a gruesome sight. As quoted by the Senate Intelligence Committee Report on Torture, “In November 2002, Gaul Rahman was shackled to his cell wall and made to rest unclothed on the bare concrete floor. The next day, the guards found Gaul Rahman’s dead body.” The junior officer that insisted on such treatment of Rahman was recommended by the CIA to receive a cash award of $2,500 for his superior work. Though the CIA praised the officer, many American citizens were appalled at Rahman’s treatment as detailed in the report, and the public became divided over whether Rahman’s treatment was humane. The concept of torture as a just means of security has become a significant source of dispute among the American public. With such divisiveness having the potential to create further discord in regards to the justice system and additional situations in which the use of torture is considered, a re-evaluation of interrogation policies is crucial to gain a position of solidarity on the issue. Is there a case for torture? Throughout the world for many centuries torture has been a highly debated and very controversial topic. It all started in Greece when slaves would get tortured to collect evidence for trials, crimes against the state, and treason. Not long after, the Roman Catholic Church and the Nazis’ began to use torture as well. During this time witnesses noticed what was going on and did not agree with it but had no way of stopping it. All across the world, a group of nations came together to make an agreement in opposition to torture. Not all nations were agreeing to not allow torture in their country, yet the majority of countries did agree. Even today it is hard to make the whole world agree to not doing something but making these agreements allow individual countries to comprise a support system. Many public figures and educators have made their opinion public but it has not yet evoked a change in the agreements originally set by the Geneva Convention. Torture is still today a very controversial topic with compelling arguments for both sides of whether to torture or to not.

In “The Case For Torture” an article written by Michael Levin, he attempts to justify the use of torture as a means of saving lives. Throughout the article, Levin gives the reader many hypothetical examples in which he believes torture is the only method of resolution. Though I agree with Levin, to some degree, his essay relies heavily on the fears of people and exploits them to convince people into thinking pain is the only way. In certain aspects, I could agree entirely with Levin, but when one reads deeper into the article, many fallacies become apparent. In this article, Andrew Sullivan, is an advocate for the abolition of torture against terrorist in the United States. During the time that this article was written, the McCain Amendment (which banned torture) was on a political limbo. What this author talks mostly about is the choice that we have to make things right, therefore ban the use of torture against terrorist. This debate takes place after Bush administration defined "torture" and permitted coercive, physical abuse of enemy combatants if "military necessity" demands it. Also after several reports found severe abuse of detainees in Afghanistan and elsewhere that has led to at least two dozen deaths during interrogation, secret torture sites in Eastern Europe and innocent detainees being murdered.

After the events of September 11, 2001, the United States had a unique dilemma. America was engaged in what would be called a “War on Terror”. This new conflict was unlike any in American history. Previously, in the context of war the United States had always fought a nation or group that had defined boundaries as to where they resided. This new conflict went away from these rules of the past. Terrorist groups were not bound to a region, but were instead united by an ideal. September 11 marked the first time in which terrorism would rise to the forefront of the nation’s agenda. This emergent wave of conflict required a different strategy than the those of the past because of the unorthodox nature of the opponent. One of the major innovations fostered by the “War on Terror” was the expansion of torture. The dramatic rise in terrorism sparked the unethical advancement of interrogation techniques in order to more effectively acquire information. The emergence of the “War on Terror” required government officials acquire intelligence in a new way thus spawning the emergence of “enhanced interrogation” methods, however, the morality of these techniques would come into question as they were revealed to the public.
