One major problem with the Justice System is that law enforcement use racial profiling affecting many people of color on a daily basis. Racial profiling is when law enforcement believe that certain groups are more likely to commit a crime rather than other groups. This is a major problem because in many cases there are very tragic incidents and as NAACP stated, “ Mr. Garner’s tragic death shows that for communities of color, including women and LGBT people of color, immigrants and low income communities, racial profiling has been and continues to be a constant reality of life, often with tragic and deadly consequences,” (45) Explains how racial profiling has become an everyday basis to minorities affecting them in many ways and unfortunately ends with death occasionally. Second, police in our country do racial profiling. This practice of law enforcement is morally wrong and personally sickening. Racial Profiling is the idea that just because someone is a different race automatically makes that one person a suspect. Racial Profiling goes against everything that the United States Constitution is about. The constitution is about freedom, equality, and the pursuit of happiness. Our law enforcement is put into place to serve and protect the innocent. The constitution protects us of unlawful search and seizers as well. Racial Profiling is an act of automatically defining or identifying someone based on their ethnicity. This act was most recognized during the late 1800’s in the U.S. under the Jim Crow law. It was passed in order to segregate whites and the colored in America. It fundamentally made whites superior to all. Though, in 1964 the Civil Rights Act passed stating that anybody of any ethnicity or religion are to be equal and united. However, today this law has never been truly accepted when seeing the statistics of the type of people being stopped by the police. So before I can answer this million dollar question I need to establish what racial profiling is. According to the American Civil Liberties Union it is “when law enforcement and private security target people color for humiliating and often frightening detentions, interrogations, and searches without evidence of criminal activity and based on perceived race, ethnicity, national origin, or religion.” In plain English this means a person is perceived to have committed a crime only because of their race.

One of the most discussed about issues in our society today is profiling based on race or ethnicity. But what is racial profiling and why is it so important? Racial profiling occurs when law enforcement agents impermissibly use race, religion, ethnicity, or national origin in deciding who to investigate for different crimes and offenses. It is being used unjustifiably wrongly in our culture daily. Based on the status of racial profiling currently, it seems as if racial profiling will always be a part of our society and there is nothing people can do to change that. With people making assumptions based on unjust rules, it seems like there will be no end in sight for racial profiling. Law enforcement should be held accountable for their actions, mistakes, and unjustified assumptions. Many instances occur with police officers taking wrongful actions solely based on race or nationality. Police and their practices have been going on for many years with the same outcomes repeating consecutively. A real- life instance of this includes police subjecting people to police brutality just because they are a “person of color” or even a “person of interest.” This has sparked protests and movements such as “Black Lives Matter” or “Hands Up Don’t Shoot.” Many people who have fallen victim to racial profiling and were wrongly accused and lost their lives as a result. Some of these people include, Trayvon Martin, Mike Brown, Eric Garner, Oscar Grant, with the list continuing on. Trayvon Martin was shot and killed at seventeen years old for “looking suspicious.” Mike brown was shot six times for supposedly running away from a police officer. Eric Garner was put in a chokehold and subdued by a police officer for selling cigarettes illegally. Oscar Grant was already placed in handcuffs and lying flat on the floor when he was shot by a police officer that only served five years in prison. With countless others’ lives lost the list going on and on, it appears that racial profiling and bias have impacted affected a wide group of people and their families who have also suffered from this widespread issue. Racial profiling isn’t something new to today’s society. Most recently there were incidents in which the officers were accused of mistreating blacks such as Michael Brown and Freddie Gray. “Racism versus professionalism: claims and counter-claims about racial profiling” written by Vic Satzewich and William Shaffir discusses racism versus professionalism with officers. Their argument is more biased towards the police force and they argue that it’s part of their job. “

An article written by the Toronto Star outlined the statistics behind just how common racial profiling is. The article was very alarming, especially because Toronto is an acclaimed to be on of the most multicultural cities in North America. According to the article, “blacks…are stopped and documented 2.5 times more than white males the same age [in Toronto].” This statistic alone is enough proof to state that racial profiling is still a very common practice amongst law enforcement today. Racial profiling is the act of suspecting or targeting a person of a certain race based on a stereotype about their race. Racial profiling occurs twice as much for minorities,such as Latinos,African Americans and Arabs,than it does to White Americans. Racial profiling has led to many disputes around the United States and now racial profiling is commonly used by hundreds and thousands of people around the country.

Tensions between police and communities of color have been happening since 1704 in South Carolina. Racial profiling is unconstitutional and harmful to human beings and today's society people can approve that racial profiling persists. Racial profiling is often encouraged to police officers when they either find a street-level crime, counterterrorism or even immigration law. Police cultures inculcate a sense of rights to authority over the rest of society. Due to their culture, certain officers are the ones that can set an image to the society so that people can follow them and understand they are doing the right thing, but it is a disturbing matter knowing that police officers does racial profiling.

Today in America racial profiling is out of control. People are being attacked, judge and even killed for reasons beyond just skin color. For many years people of color have been racially profiled, and now when America should be moving forward, America is going backwards. Racial profiling, which is a form of racism has gotten out of control, and the past has not improved as we have moved into the 20th century. It is time for Americans to take a closer look at racial profiling and do something about it. We should all take a self evaluation, of how we have handle someone, or some situations, and ask the question are you a racist?, it is Clare that racial profiling in America has gotten out of control. Striving towards the same goal, and eliminating judgment of others, solely because of their color, race, religion, gender, or sexuality. America shows power, strength, and control. As one we can build a strong America, and stop racial profiling.

Merriam Webster defines racial profiling as the act of suspecting or targeting a person on the basis of observed characteristics or behavior (Webster, n.d.) The legal dictionary definition is the consideration of race, ethnicity, or national origin by an officer of the law in deciding when and how to intervene in an enforcement capacity. (Law Dictionary, n.d.) Sadaris’ definition, targeting a person according to certain stereotypical characteristics or assumptions learned or observed, using one’s own personal discretion.

“Racial profiling describes the practice of targeting or stopping an individual based primarily on his or her race rather than any individualized suspicion” as illustrated by Warren of Sage journals. Racial profiling is the use of race or ethnicity as reasons for suspecting someone of having committed an offense. African-Americans have been fighting what seems to be a never ending battle against oppression and racism. Over the years 2012-2015, reports of police killing unarmed black men in America have been alarming.

Is it right to racial profiling someone? Many people did this to other .but i think its wrong because we all human and same no matter how different our race and skin color.

Benjamin Todd Jealous once said, “Racial profiling punishes innocent individuals for the past actions of those who look and sound like them. It misdirects crucial resources and undercuts the trust needed between law enforcement and the communities they serve.”(Jealous, 2015). I couldn’t agree more with him. In today’s society more and more Black men and women suffer from police bias. Police is a powerful organization that was meant to serve and protect. Enforce laws and keeping communities safe.
