United States vs. Russia Introduction Gay rights has been an issue that has been controversial for decades, although it was never discussed until now. Society has changed over the last years, in fact it has changed so much in the past 20 years; with that said race, drugs, and sexuality are still the main factors in modern times. Not only does this subject affect America, but also other countries, they are just silent about it. We really don’t hear about any misconduct toward gays in other countries, besides Russia. The gays want their rights in America and Russia, they are speaking out and they will be heard. LBGT, Lesbian, Bisexual, Gay, Transgender, are not only fighting for their rights and equality, but to ban discrimination all around the world. Russia is more anti-gay and more extreme than America, they’d let extremist take advantage of homosexuals. Since Russia’s government strongly implements that being gay is wrong and will do anything to keep that mindset. America on the other hand is more towards equality for the LBGT, they’ve spoken out to demand the same rights as everyone else, slowly the LBGT in Russia are setting their foot down and want the freedom to walk the down the street with their loved ones and not be targeted. The movement of the gay and lesbian population in the United States is one that has been in progress since the early 1900s, and is still facing overwhelming controversy and backlash today. The push for gay liberation in a country founded on Christian morals and beliefs has subsequently led to struggles over equality of marriage, adoption, jobs, and healthcare. One side of the controversy argues that every individual deserves the same rights, while the opposing mindset argues that being homosexual puts you into a group of people that is different, and will therefore be treated as such.
The massive amount of people who believe and support LGBT should have the same human rights and equality say, “it's only fair they receive the same liberty to love who they love.” (Texas, Democratic Party, 1) Throughout the years, same sex marriage supporters have been increasing; “81% of adults under 30 now support marriage equality.”(Texas Democratic Party, 1). People have been making an effort to fight this case even since the beginning of the gay rights movement in the 1960s-1970s. In the landmark case of Korematsu v. United States the Supreme Court was correct in the ruling because the executive order that was issued became a law to protect the country from persons that had close ethnic ties to the enemy and made all people that the government deemed a threat to national security into prisoners. Although this was against moral standards, it was a necessity at the time to protect the country. While it may seem that it was just the Japanese that were prosecuted, it was also Americans of German and Italian heritage that were also persecuted. This executive order infringed on the rights of American citizens based on their ethnic background. This isn’t right because as said in the constitution everyone has the right to life, liberty and the pursuit of happiness.
This paper addresses human rights abuses against members of the LGBT community in Russia. The LGBT community has been a marginalized group of society in Russia in many ways throughout history, however the legislation that was recently passed in Russia goes a step further to strip these individuals of their human rights and dignity. The legislation is inconsistent with several human rights provisions in international treaties that have been ratified by Russia: International Covenant on Civil and Political Rights (ICCPR); International Covenant on Economic, Social, and Cultural Rights (ICESCR); Convention on the Elimination of All Forms of Discrimination Against Women (CEDAW); Convention Against Torture and other Cruel, Inhuman, or Degrading Treatment (CAT); and the Convention on the Rights of the Child (CRC); European Convention for the Protection of Human Rights and Fundamental Freedoms (ECHR); and the European Convention for the Prevention of Torture and Inhuman or Degrading Treatment or Punishment (CPT). There are also several articles in Russia’s own constitution which are incompatible with current human rights abuses against the LGBT community, as well as the Universal Declaration of Human Rights (UDHR), and the Yogyakarta Principles.
There are many different topics in the world that split people’s opinions. Some stronger than others. These views and opinions are often swayed by one’s political views, and one of the biggest topics that sparks controversy are the rights of all people. Although the war had ended, Americans were still in fear of the spreading of communism that may affect their society as a whole. In light of the recent election putting a man with questionable morality in the powerful seat of President, many in the lesbian, gay, bisexual, and transgender community are fearful of the repercussions this will cause. According to the Southern Poverty Law Center, “867 cases of hateful harassment or intimidation [were reported] in the United States in the 10 days after the November 8 election”, and swastikas adorned people’s cars and homes in angry graffiti, accompanying words such as “white power” and “fag”, “he she” and “die” (Yan). While the American legal system has come a long way in granting the homosexual community their natural rights, the present climate gives many a fear that things will go back to the way they were before, with homosexuals being oppressed and persecuted for simply loving who they love.
In 1991, a poll that was taken of Chelyabinsk reveled Russian thoughts on homosexuality. 60% of the people had a negative attitude towards gays. 30% said that gays should be isolated from society. 5% said that gays should be liquidated (killed). Another 5% labeled homosexuality as “unfortunate”. When Russia was under Boris Yeltsin’s rule, which lasted from 1991 to 1999, the government was much more tolerant of the LGBT community. On May 27, 1993, homosexual acts between consenting males was legalized. Also, in 1996, a Russian LGBT rights organization called “Triangle” was formed. Since 1999, Russia has been under the control of Vladimir Putin. In 1999, homosexuality was removed from the Russian list of mental disorders. In 2002, Gennady Raikov, who is a leader of a conservative pro government group in the Russian Duma, suggested outlawing homosexuality, but he didn’t get enough votes. On July 1, 2003, homosexuals were allowed into the military. In May of 2005, Nikolai Alekseev founded the LGBT Humans Rights Project Gayrussia.ru, and a year later, the Russian LGBT network was created. But that’s where Russia’s recognition and toleration of gays stops. Since 2006, Russia has become more and more resentful and violent towards the LGBT community.
The LGBT community has made new laws each day to bring equality to all. “Throughout its, America has symbolized equality of opportunity for people of all races, origins, religions and creeds, serving as a beacon of hope for anyone seeking a better life. However, despite its founding principles of equality and acceptance, the United States also has a long history of denying basic rights to certain people” (LGBT Equality). When the US discriminates against a certain thing people retaliate and rise up and try to make new laws to help their cause. The LGBT community has been striving to bring equality in many ways. The LGBT community has made great strides in gaining equality of same-sex marriage, gay adoption, and transgender equality.
Because of this discomfort, there has been protests and laws set to abide with homosexual relationships and marriage. The status quo would go against any gay activity. Homosexuals are trying to fight for gay rights. Some states in the US has already legalized gay marriage. One reason why LGBT Americans are mostly treated unfairly is because currently, LGBT Americans only have a handful of rights. One of the biggest milestones was when on June 26th, 2015, LGBTQ+ marriage was legalized at a federal level in all 50 of the United States. And the LGBT community is popping up more and more in the media. This article states "The struggle of LGBT (lesbian, gay, bisexual and transgendered) people for equal rights has moved to center stage. LGBT people are battling for their civil rights in Congress, in courtrooms and in the streets. Well-known figures are discussing their sexual orientation in public. In some states, discrimination of LGBT people is illegal. LGBTQ+ people's lives are improving, and the amount of laws protecting them is growing. Slowly but surely, full protection is drawing nearer.
What if you were denied rights that a U.S citizen is guaranteed in the Constitution? What if you were treated as a second-class citizen because of what you believe to be fair?
