Have you ever heard of the saying “never judge a book by its cover”? To judge someone based on what they look like on the outside, how they act, or even how they dress is discrimination. Discrimination is the practice of unfairly treating a person or group of people differently from other people or groups of people (Merriam-Webster). While discrimination is a significant problem in todays society so is racism. Racism is not something new; it has been around for centuries. Racism is a major factor in many of the events that have happen in the past as well as the events that are happening in society today.
John Pemberton invented Coca-Cola in 1886 in Atlanta Georgia selling only nine bottles a day. Today Coca-Cola is one of the largest distributor and marketer of non-alcoholic beverage company’s in the world. It’s everywhere. Coca-Cola has 900 plants around the world and approximately 123,000 employees worldwide with its product being sold to 200 countries. It has hundreds of brands and thousands of products sold worldwide. Coca- Cola has one of the most sophisticated and persistent production and distribution systems in the world. In today’s world, the American still has barriers to overcome in the matter of racial equality. Whether it is being passed over for a promotion at the job or being underpaid, some people have to deal with unfair practice that would prevent someone of color or the opposite sex from having equal opportunity at the job. In 2004, Dukes vs. Wal-Mart Stores Incorporation was a civil rights class-action suite that ruled in favor of the women who worked and did not received promotions, pay and certain job assignments. This proves that some corporations ignore the 1964 Civil Rights Act, which protects workers from discrimination based on sex, race, religion or national origin.

Discrimination can take place between any two ethnicities or cultures. The case of the Equal Employment Opportunities Commission (EEOC) vs. Paramount Staffing Incorporated is one example of a case not between blacks and whites. This is also a prime example of how the process of dealing with discrimination is dealt with more fairly in modern day society. In this case, the EEOC accuses Paramount Staffing Inc. of choosing hispanic people over African Americans regardless to the level of experience or availability they had. Although they admitted to doing no wrong, they agreed to pay a total of $585,000 to settle the suit. This case is different than previous ones because instead of ignoring all evidence that points to wrongdoing the courts acknowledge that the company was only hiring hispanic people. Had this case been presented back in the 1930’s it would not have even been considered. It probably would not have even been reported. This goes to show just how far society has come in defending people of different ethnicities. After reading the article from Drake University; Drake Law Review, I agree with several issues mentioned within the article. Obviously, being a man of color, I agree with the Title VII of the Civil Rights Act of 1964. The idea of being judge by ones skin color, sex, religion, or national origin is dull-witted and idiotic. Not only should a business judge by the content of your character, said judgment should come from all walks of life.
The Coca-Cola is suing the Koke company of America from using the word Koke for their products. However, the Coca-Cola company believe that the Kola company is in violation of trademark infringement and is fraudulently making the beverage for which a trademark Coke is using. The defendants Kola Company claims that the Coca-Cola trademark was a fraudulent representation of the Coca-Cola name and that is contained cocaine from coca leaves ingredient. However, the trail court granted the injunction against Koke, but the proceeding court was overturned, and Coco-Cola appealed to the United States Supreme Court.
In the article, Bank of America ordered to pay $2.2 million to 1,000 black job seekers it discriminated against written by David Knowles there was a major issue regarding racism. This written piece discussed the court case against Bank of America and how this corporation was ordered to $2,181,593 in back wages and interest to 1,147 African Americans that were denied jobs. This bank’s office branch in Charlotte, NC had discriminated against blacks in 1993 and again between the years of 2002 and 2005. This case was first introduced in 1997 and settlements were not concluded until late 2013.
