The plaintiff must prove that there was negligence from the defendant’s side, which resulted with the injury and they are to be blamed. Negligence is generally a question of fact for the jury, and whether a legal duty exists is something that needs to be solved within the court. In this case, what needs to be determined is whether the City of Elsewhere and/or Officer Ruthless had a duty to Susie Marks regarding to her riding in the camper of the truck, and if so, to then determine the actual cause of the injuries to Susie. The actual cause refers to what really caused the injuries.
Jose Carcamo et al., Defendants and Appellants in the Supreme Court of California held that tort liability based on negligent hiring and retention is a cause of action distinct from vicarious liability based on respondeat superior. In the case against Jose Carcamo, it was stated he hit a car while driving his truck for his employer, causing Renae Diaz to lose control of her vehicle. The jury awarded Diaz $22.5 million in damages in which Sugar Transport, Carcamo’s employer, was also help liable based on its negligent hiring of Carcamo. Sugar Transport contended that while it is liable for Carcamo’s driving, it should not be held liable for negligent hiring and retention. The court reviewed negligent hiring and retention as theories of liability independent of vicarious liability. The court stated that the liability comes from hiring and retaining an employee who is unfit to conduct his or her duties. Due to the fact that the employer had sufficient enough reason to believe that undue harm could exist with the employment of Carcamo, they were held liable for negligent hiring. Carcamo’s driving history included previous accidents that were relevant to his job assignment. When it comes to Easy Spa hiring a compensation professional the three main ways that they will benefit is by aiding in the rationalizing the structure when it comes to the organization objectives and the market parity, attract the best talent, and help when it comes to cost savings. I believe when one is looking to hire a compensation professional this will free up time that other employees and the professional can focus on the issues without having to put out fires that a company may have at that time. The professional will also be able to complete projects that have deadlines in a timely manner. I also believe when a company is looking at their objective it is vital to have experience within the company. The compensation professional will bring that experience. They bring the breadth and the depth of experience to deal with these types of issues with a broad group of clients. In addition, the professional can respond to the needs of the company without having the wheels reinvented or even one learning on the time of the company.
Post these responses directly in your private student journal. Your assignment is due Wednesday, April 10th. Then a forum will open for each of these assignment questions. Please write two-to-three paragraphs per question.
Although research generally confirms that pay-for-performance plans can influence greater outcomes, it is unclear how effective different pay plans are relative to each other (Park, 2012). Like most things in business, compensation is something that requires evaluation, study, assessment, strategy, modeling and integration. Achieving a pay for performance culture does not happen without paying attention to the behaviors, activities, rewards and motivations that have to be linked and reinforced through a well engineered and successfully executed process. Actually if that process does not tie rewards to shareholder financial objectives, employ the proper mix of compensation elements, result in meaningful dollars, embrace performance that employees can impact and are effectively communicated and reinforced, then the results it produces will likely fall short (Vision Link Advisory Group, 2013).
