On January 31st, 1969, Gail Miller had been on her way to work as a nurse, when she was raped and murdered in the snow. Meanwhile, sixteen-year-old David Milgaard went on a road trip, along with his friends Ron Wilson and Nichol John. They stopped to pick up their friend Albert Cadrain in Saskatoon. The man living in Albert’s basement was serial rapist Larry Fisher, who was then unknown to the police. He was responsible for Gail Miller’s rape and murder. Approximately a month later, on the 2nd of March, Albert contacted the police, as he was secretly an informant. Despite the fact that Nichol hadn’t said something as explicit as she saw David stabbing Gail, the prosecutor read her statement in front of the jury. Matters at David’s trial were worsened due to the emerging of a story involving a situation that occurred at a party back in May. Other teenagers had teased David of being a murder suspect, following which he stabbed a pillow and joked about killing Gail, due to being intoxicated. As a result, the jury members found David guilty of Gail’s rape and murder on January 31st 1970. David attempted to convince the higher courts that he was innocent. On January 5th, 1971, his appeal to the Saskatchewan Court of Appeal was dismissed. On November 15th, 1971, the Supreme Court of Canada rejected his attempt at another appeal. David made another attempt at receiving a review in August 14th, 1991, claiming that Larry Fisher killed Gail Miller. Joyce’s assistance in convincing people of her son’s innocence through media reports increased public pressure. Consequently, the Minister went to the Supreme Court of Canada for an opinion on the next steps for David’s case. On April 14th, 1992, the Supreme Court of Canada put an end to David’s conviction for the purpose of a new trial. David was finally released from prison; however, his name was still not
