Is America’s Views on Gay Rights Flawed?
The struggle for gay rights is an ongoing political debate and has often been described as the next big step forward in human rights. In many countries gay rights groups openly protest primarily for the right to marry as heterosexual couples do. Do you believe that in America people persecute homosexuals?
The question often arises “Why do gay couples want to get married? Aren’t there other forms of union the state offers?” There are other alternatives to marriage that give gay couples the same tax benefits as other couples but, marriage allows for some benefits under taxes, medicare, and medical decisions that other types of union won’t allow.

The argument is much deeper then weather or not they should be married because they share a home together. If couples are paying taxes to build roads and help public schools, they should be afforded the same rights the heterosexual couples have. This was the argument used in the Baker v. Vermont. In the Baker v. Vermont court case, “gay and lesbian couples had argued that they were denied the protection of more than 300 laws as a result of not being allowed to marry.” Homosexuals are finally suing the state because they are not receiving protection under the laws of state strictly because they are gay. The Vermont House of Representatives voted in favor of a same-sex civil union bill after the case resolved. This shows that looking at the matter as a legal issue, it is evident that gay couples are not regarded equally in the eyes of the law, and that the first steps to fix this social injustice are just now being taken, however, the vote is very close. Same-sex civil unions are a basis for nation-wide legal recognition of same-sex relationships. The battle to legalize same-sex civil unions is not trying to change the beliefs of the churches. These unions are to be recognized by the state. Priests are not forced to perform these ceremonies, nor do they have to be held in a church. It would be unfair for the government to decide what people should and should not believe, this would impair our right to freedom of religion. But, this does not give the government the right to discriminate against gay and lesbian couples in the eyes of the law, because the government and religious beliefs are separate. Gays should be allowed to have the same rights as everyone else. They used to not be allowed to adopt children in some states. They get abused verbally, mentally, and physically by their family and friends. There are some people who disagree with the thought of gays getting married. They can’t get jobs because of their sexual orientation. Some people accept the fact that they want to love who they want to love. What’s important is that gays are mistreated wherever they go.
The Supreme Court ruled that it was not unconstitutional to not give the couple a license (Minnesota Reports 310-311). Not until 2004 did the United States have a state, Massachusetts, which permitted same-sex marriage (Hackl, Boyer, and Galupo 1). There are many reasons why gay, lesbian, transgender, and bisexual would like to become married. There are financial benefits, legal benefits, physiological benefits, as well as stability (Karasu 13). As the First Amendment states, free exercise and establishment, churches are not being forced to marry against their will (Weber 1). Although it does make it harder for the gay couples, it gives the churches an option. While churches are slightly more vulnerable than pastors in some areas, both have significant protection under the First Amendment and other provisions of the law from being forced to perform same-sex marriages (Weber 1). Although I do believe that marriage should stay between a man and a woman, it is hard to defend every religious persons beliefs and the discombobulated upbringing of children without changing the law. Gay Rights--civil and social rights given to homosexuals in comparison to heterosexuals--is a topic that has been roaring, especially in the conservative state of Mississippi. Because this is such a controversial issue, citizens have a different viewpoints that are deemed “the right way.” Citizens’ viewpoints have grown stronger with the recent passing of Governor Phil Bryant’s initiative “1523.” The legislative measure claims, it is a person’s religious freedom to hire or sell to gay citizens. Gay rights are a civil rights issue although unrecognized on a par with women or Africans. As the definition of civil rights states “those positive rights, whether political, social or economic, conferred by the government on individuals or groups that had previously been denied them” (Yalof, 108). Homosexuals have been discriminated against historically, by both religious and political groups. There have been cases where they have been discriminated at work, clergy, and the military.
Our world changes day by day, but we do not realize it until we look back and everything is completely different. Over the years our government had come to many different conclusion on what is best for the nation on the topic of gay marriage before the 2015 court hearing legalizing it. From 1972 to now, from Baker v. Nelson to Obergefell v. Hodges, there have been dozens of court cases. My speech will be focusing on specifically Baker v. Nelson, Baehr v. Lewin, and Obergefell v. Hodges.
When you hear the word discrimination what is the first thing you think of? A majority of the population says wither blacks and whites or Jews and Nazis, but that’s not the only discrimination there is. Same sex marriage has been widely looked down upon for ages. People say, “It’s not the traditional constitutional marriage”, or “Children need a mother and a father”. It honestly doesn’t matter. If two people love each other, they should be allowed to marry. It’s just as simple as that. What other reason do you need? In addition, marriage is a religious rite. “Gay marriage is not compatible with the beliefs, sacred texts, and traditions of many religious groups” (ProCon.org, 2011, Con Gay Marriage, ¶4). In fact, we know that most of the religions are opposing same-sex marriage, because they are always guided by the Bible and God’s commandments and his teachings. “Marriage was established by the Creator with its own nature, essential properties and purpose.
