Not only did they operated the aircraft but also they was in charge of loading the cargo fully. In the investigation the FAA and NTSB was involved not the DoD. However, I think the DoD could have provided better oversight or visibility to insure that the contractor was loading DoD assets in according with the applicable regulation or guidance.
