ISSUES AND CHALLENGES IN ISLAMIC INHERITANCE
INTRODUCTION
Islamic inheritance is one of the most important thing in islamic law. In legal terminology, it means inheritance must be divided from the property of the deceased among his successors. Inheritance also prominently dealt with in the quran and its often called ‘mirath’. All muslims are expected to follow and implement the rules of islamic inheritance. As we know islamic inheritance has been pre-ordained by Allah s.w.t in a wise and gradual manner in order to allow for its evenness with the judiciary and human nature which it can make difficult to change their normal practice.
In addition, the system of inheritance had been continued in zaman jahiliyyah based on kinship and hijrah

As we know, before the estate of deceased distributed by faraid apportion, there are some right and obligations that must be fulfilled by relatives of dead muslim. First, right that the relatives must fulfilled is funeral expenses. Funeral in islam means that, called jenazah in arabic is quite certain ceremonies, although they are subject to regional interpretation and variation in custom. While funeral expenses, means that all expenses that used to manage the deceased funeral such as, bathing, shrouding the corpse, bringing it to cemetery, digging the grave and burying it. This expenses must using the deceased’s money before distribute. But, if the deceased do not have money the relatives had to pay it, while money from the baitulmal can be used if it is found that the dead do not have the money and the beneficiary.
Second responsibility that relatives must fulfilled is payment of debt that owed by deceased. The debts can be whether debt with allah or debt with human being. Debt with allah means that like alms(zakat), atonement(kaffarah), vows(nazar) and also obligatory hajj and debt with human being like debt in money and other things. As we know debt with human being, the debt can be paid by using deceased money or if the deceased do not have money, the debt can be settled by relatives or baitulmal. The Islamic empire expanded in many different ways. One of the ways the Islamic Empire expanded is conquering land. In document A Islam killed the Greeks and conquered some of their land. This means that that the Greeks were taken over by Islam so Islam had more land than before. Another way the Islamic Empire expanded was they made a treaty with Tudmir. In document B “The slaves will not be killed or forced in any way but will be slaves.” This means that Islam had a truce with Tudmir. Islam will have a bigger civilization from getting more slaves/warriors from getting slaves from conquered
I have learnt that even though a patient has died; communication, dignity, respect and advocacy is still fundamental. I have also learnt that last offices are carried out differently depending on the individual’s religion. Before this experience, I assumed that it would be carried out the same, I now know to make sure to check the patient's notes and research their religious belief on last offices in the future. I have realised that the care given to individuals of different religions may also differ during all aspects of care not only after death.
Nothing can prepare a family for an unexpected death. The toll it takes has devastating emotional consequences. To make matters worse, there are practical problems that often arise. The deceased may have incurred large medical bills before they died. The death requires a burial which can cost the surviving family members more than expected. Also, if the deceased provided income for the family, the struggle to keep their lives going can be almost impossible. When the death was caused by an act of negligence, there are terms for the surviving family members to bring forward a wrongful death claim.
Islamic Achievements Over the ancient years, the Muslims gathered ideas from many different places. They generated their own visions of the world based on the thoughts that were inherited from the Greeks, Rome, and India. In addition, they also evolved their ideas when they conquered many different places, all depending on how that certain place was. The Muslims were able to deal with many different cultures, allowing them to practice what they wished, thus giving themselves room to envision their own. The achievements that the people from Islam left behind was and is amazing, and left a big impact for years ahead of their own time. Sharia law is an ancient compilation of religious rules that most Muslim nations seek reference in governing their people. For my paper I decided to choose the religion of Islam. I decided to pick this religion because of its fast growing rate. It is also different from what I am used to growing up with, so I was interested in learning more. I had learned some basic facts after the 9/11 event, but the Muslim religion and culture was still a mystery to me. Picking this topic has helped me learn more about Muslims and will help me better relate to them in my future work.
