Repealing the second amendment would not make America safer because it does not penalize the criminals doing harm but the law abiding citizens exercising their right to self-defense. As stated in the book In Our Defense, Zangrilli argues "the ordinance penalizes the victim, not the criminal." An ordinance to prohibit handguns in Morton Grove, a small town in the United States. The point of the 2nd amendment was to be able to balance the power of the state and the power of the people. Around the late 18th century, mass production of firearms ensured that almost everyone could afford a rifle. This equality of arms between the people and the state allowed for individuals to assert their right to self-defense. The ability for the people to resist …show more content…
The second amendment has protected and shown that it is being used in cases of self-defense. In Measuring Civilian Defensive Firearm Use revealed that United States civilians used guns in self-defense from crime at least 980,000 times per year. This survey shows how many citizens are using guns to defend themselves which would otherwise have been seriously harmed if the individuals did not have the firearm to defend themselves. A gun was used in 980,000 cases for self-protection. In Armed Resistance to Crime, a 1993 a nationwide survey conducted in about 5,000 homes found that over five years, at least 3.5% of households had members who had used a gun “for self-protection or the protection of property at home, work, or elsewhere.” This amounted to around 1,000,000 incidents per year. This excludes all “military service, police work, or work as a security guard." Citizens who had possession of a gun were able to defend themselves in such cases. This brings up the point that many people are exercising their second amendment right accordingly and using it in cases of self-defense. It has also been shown that criminals have avoided or retreated from civilians believed to have a …show more content…
In most cases even preventing the crime from taking place in the first place. While the second amendment protected these individuals, it has also harmed others; According to 2014 Crime in the United States, Expanded Homicide, roughly 14,000 murders committed in the United States during that year, of these, about 10,000, were committed with firearms. While repealing the second amendment would have decreased the deaths, the criminals who are doing harm, will still find a way to commit harm with or without a firearm. It would give the criminal the advantage of knowing that the citizens do not carry guns and would lead to the criminal to conduct the crime because the citizen cannot defend himself. The problem with repealing the second amendment is that criminals would still find a way to commit the crime if the second amendment gets repealed. As shown in Criminal Victimization 2014, roughly 5.9 million violent crimes were committed in the United States during 2014 these included assaults, robberies, sexual assaults, rapes, and murders. 10% were perpetrated by offenders visibly armed with a gun. This goes to show that 10% of these cases did the criminals require the use of a firearm to commit these offenses. Meaning that the criminal committing the crimes would have committed the crime with or without the firearm when only 10% of the criminals needed a gun to go through with their crime. Taking away guns would
Not only does the Second Amendment provide citizens with peace of mind that they can protect themselves against the authority, but it also allows citizens to protect themselves from fellow Americans, should the need arise. Firearms help to create a level playing field for all people, regardless of their age, size, gender, or even disability. Because we have the ability to carry arms, dangerous people no longer have the ability to pick and choose “easy” victims due to their lesser size or strength. No matter who you are, an added measure of security can make all the difference in a dangerous
The second amendment entitles the people to own or bear arms. Many people today believe that gun rights should be repealed or removed for the Bill of Rights, but I believe that this is one of our very first amendments and it is one of the most important ones, because it keeps the government from imposing tyranny or an oppressive government upon the people. The second amendment also give us the ability to protect ourselves without the government taking the right away from you. History is filled with stories of government overpowering people, and without the second amendment these problems will repeat themselves. The past couple of months this year believe that gun laws or rights are being violated, and many people are voting to repeal the second amendment because of these people hurting others with the right to own a gun.
The Second Amendment is a part of the Bill of Rights, (the first 10 Amendments to the Constitution) the framework to elucidate upon the freedoms of the individual. The Bill of Rights was planned and sent to the states, and were later ratified on December 15, 1791.The first 10 Amendments to the United States Constitution were introduced by James Madison as a series of legislative articles and came into effect as Constitutional Amendments following the process of ratification (three-fourths of the States) on December 15, 1791.
But because the second amendment cannot be changed, the Government should focus on controlling gun violence instead of gun control. As soon as people start focusing on how to stop gun violence without taking away guns, the country will see a considerably fast decline of shootings. Many laws have already been made in the 19th and 20th century to try and stop gun violence. It all varies on each state and what laws they have in place as well. In states with low population densities like Alaska and Vermont citizens are allowed to carry a concealed weapon without a permit but at places like Washington, with the highest murder rates in the country, the citizens there cannot even own a handgun. Different states, have different laws, about guns and whether you can conceal or not conceal a weapon with a license. The second amendment protects people the right to own guns for protection and cannot be changed, but laws that are put in place for gun control can take away certain types of guns and where you have access to
We have had several of the worst mass shootings in our nation's history in quick succession over the past few years. Certain legal restrictions and acts from our government could have prevented numerous deaths. Common sense background checks and limitations to cartridge size and assault weapons would surely have saved many lives at the Las Vegas Massacre, but certain men and women claim that these restrictions violate their second amendment right. They claim that guns aren't the problem. That guns don't kill people, people kill people. So limiting access to devastating guns is just avoiding the problem. The Second Amendment right presumably violated by common sense gun control is “A well regulated Militia, being necessary to the security of a free State, the right of the people to keep and bear Arms, shall not be infringed” (Second Amendment). The Second Amendment states that for the need of a well regulated militia to protect the security of the free state and the right for the people to keep and bear arms. Militias have been inactive for decades so in a sense the intent of the amendment is no longer relevant. Based on the 2nd Amendment, the Constitution is not still a valuable and viable document in modern America because it stands in the way of thorough background checks, training courses, and its vague wording and absolute intent make it inefficient to maintain peace and order and should be amended “To the People of the United
The second amendments is the "A well regulated militia, being necessary to the security of a free state, the right of the people to keep and bear arms, shall not be infringed". This amendment was added to keep the people voice in the government. Congress wanted to keep the people safe by giving them to have the rights to have weapons to defend their families, limited government power, but also give the state more power to their militias. Alexander Hamilton thought it was important for the government to have a strong central government and thought that the Second Amendment was dangerous to the government. They didn't want people to have weapons because it will allow the slaves to escape. Alexander Hamilton and the Federalists were the slave
Man will be tempted, government leaders will take advantage of their power for control, and darkness may fall over the land, but as long as good men are not idle, evil will not thrive. The second amendment enables the good to take action against evil. Thomas Jefferson put this best when he said, “No free man shall ever be debarred the use of arms. The strongest reason for the people to retain the right to keep and bear arms is, as a last resort, to protect themselves against tyranny in government.” Our second amendment is important because it gives good men the ability to protect those self-evident truths from a corrupt and overreaching government.
Most people would link violence and crime problems with gun control in America. The debate that Americans face today is the freedom the Second Amendment gives citizens and whether or not the country should repeal it. While some people feel that repealing it should solve the problem, others believe that it is one of the most important basic freedoms we have as Americans. Federal gun control laws are unconstitutional, and I believe the Second Amendment is both an individual and state right.
The second amendment of United States constitution said “A well-regulated militia, being necessary to the security of a free state, the right of the people to keep and bear arms, shall not be infringed”. This amendment was embraced on December 15, 1791, taking in consideration that American citizens have a natural right to self-defense and they can help to accomplish the following purposes:
“A well regulated militia, being necessary to the security of a free state, the right of the people to keep and bear arms, shall not be infringed.”
I agree with the outcome because the authorities did not have enough probable cause to force the suspect into giving up his passwords to the encrypted drives. The District Attorney attempted to circumvent the current laws in order to force decryption of the drives that would have violated the suspect’s rights against self incrimination which would have been a direct violation of the Fifth Amendment. If the authorities already had the same evidence they were asking for it would have served no purpose if the drives were decrypted. If the drives did in fact contain the content that the prosecutor claimed to be on the drives and that information would have been used as evidence against the suspect, so the suspect had every legal right to refuse tho give up the passwords. The fact that the suspect invoked his Fifth Amendment rights in which he refused to provide the drives encryption keys or refused to decrypted content is the sole reason why I agreed with the suspect. I also found what the prosecutor attempted to do to be unethical, if he wanted the information that bad with out having the evidence to support his suspicions, he should have followed the law and granted the suspect total, and unlimited immunity from prosecution.
Here in the United States that were roughly 2.97 people killed for every 100,000 of us, where as in Sweden there are only .41 people killed per 100,000 citizens, why is this? Well in Sweden their guns per capita (which means number of guns per 100 people) is around 30, the United States is 88.8. This is why there is more deaths here than there. With this knowledge one could come to the conclusion that the less guns you have the less deaths can accrue by guns. Now using this information, I believe that it’s safe to say that if we were to take away all the guns in the United States there would no deaths by guns. There for everyone would feel much safer and happier because they wouldn’t have to worry about getting shot in the street.
The United States is in a controversy of whether or not the Second Amendment is protecting our country or killing it. The United States owns approximately 250 million guns, nearly one for each citizen, and grows about 7 million each year. Experts believe that the Second Amendment in the Constitution is rational and legal, author of, Handgun Prohibition and the Original Meaning of the Second Amendment Don B. Kates states that the “Second Amendment protects an individual's right to possess a firearm unconnected with service in a militia, and to use that weapon for traditionally lawful purposes, such as self-defense within the home; however, they do not say that you can go around shooting people and claiming that you are
Firearms are your defense from criminals. If we are not to have our 2nd amendment our crime rates will increase because criminals will invade houses more freely because they know that that citizen doesn't have a firearm or another words “protection”.Also new types of crimes will probably be created such as home-invasion robberies or car-hackings. Not only that but a rise in intimidation where criminals will intimidate people to give up their valuables so they can avoid being injured by the criminal. Also if we are not to have firearms the 5,285 children will be alive but our nation will be enduring more violence then it already is enduring.
Ever since the Declaration of Independence has been torn up, the United States has converted to the Constitution as the new sets of rules and laws. Now, the United States refer only to the U.S. Constitution as the base of rules, and nothing can go against it. The Constitution is known as a living piece of document, meaning it can be changed or repealed at any time if needed. Our second amendment, “Rights to Bear Arms” means citizens are allowed to own a firearm. A firearm purpose is to kill another. The reason to manufacture a firearm is to shoot a bullet at a high enough speed to kill a person instantly or wound someone enough to be life threatening. The firearms today cause more harm than good. With firearms, we have numerous accidental shootings, suicides, and murders, and therefore, the United States need to repeal the 2nd amendment.
