The lack of regulation from the Food and Drug Administration (FDA) on electronic cigarette products is creating a desire for state and local governments to enact laws aimed to address their usage (Balakit, 2014). In Maryland, House Bill 0026, Clean Indoor Air Act – Use of Electronic Smoking Devices – Prohibition, was intended to make the use of electronic cigarettes (e-cigarettes), “battery-operated devices that contain nicotine cartridges and other chemicals,” illegal in public places (Subramaniam, 2015, p. 2). This would be consistent with the 2007 legislation that prohibited the use of traditional cigarette or other tobacco products that elicit smoke in public places. This could have provided the justification for the committee to deny HB0026, as it is possible that members of the committee felt as if prohibiting the sale of these products to minors was a safe enough form of policy implementation regarding e-cigarettes at this time.
HB0026 was an aggressive bill, one that perhaps did not have the appeal that New Jersey’s law had because of its inability to also address sales to minors. It was a bill that was going to most likely hinder sales of these products and state revenue so it is not hard to understand why the Economic Matters Committee issued an unfavorable outcome. Also, it was the Health and Senior Services Committee who approved New Jersey’s respective legislation, not a committee concerned with economic matters. Perhaps if this bill was brought before the Health and Government Options committee, it may have been more likely to be passed. During the hearing of HB0026, e-cigarette store owners found it troubling that they would not be exempt from penalties of this legislation, claiming that it would dramatically cut sales if they were unable to allow for people to sample the product, for example (Economic Matters Committee meeting, 2011). If HB0026 made vendors exempt from infractions of this law, then it may have been better received among store owners. Even though some people may think that they are better for you but they are actually wrong the “Juice” makes people/kids think that they are not harmful because of the name of what the “juice” is called. Some people believe that E-cigarettes are better than cigarettes for various reasons, and this belief may be true. As the world moves into the 21st century the drug that once funded nations is starting to die off; not due to pestilence but due to increased knowledge of how it harms the body. Tobacco once ruled the world; now in the digital age a new way to inhale smoke has come into being. Electronic Cigarettes, or e-cigs as they are more commonly known, have become very popular in recent years. The act of inhaling vapor (or vaping) has become a social norm; much like smoking a cigarette was just a few years ago. But with an increase in public usage the FDA must make a decision.
Ever since this new, exquisite device, called E-Cigarettes, made and was bought from stores, it has become really addicting around the United States, especially children and teens. Because of its new abilities, people, mostly teens, thinks that it’s a lot safer to use. But it’s not. Risk factors are still acquired from these cigarettes because they have nicotine gas and other chemicals that causes cancer. Due to legalized tobacco, you have still have to follow the age rule, +18 years old, but teens still buy these products because of their taste and its fastidious abilities.
I feel as if the consumers are not safe when the marketing is all geared toward the adolescents. I feel that the adolescents find the fruity flavors of the e-cigarettes more appealing. The down flaw is that there is no set limit on age regulations so most people that are buying this product are teenagers and pre-teens. But this product has nicotine in it and this is highly addictive and is dangerous for younger kids and can potentially affect the brain development, may cause brain damage, and may cause cancer if used obsessively. This nicotine can also cause dizziness, nausea, stomach pains, and may worsen asthma. The following right is the right to choose. I feel as if the consumers have a choice. They can either choose to buy the product or they can opt to not buy the product. None of the consumers are forced or coerced to buy this product. Another right is the right to be heard. I feel as if the company did hear what the consumers were saying when they decided to come to a decision of the regulation and decided to continue looking into it. The FDA claimed that as per Food, Drug, and Cosmetic Act (FDCA), it had authority to regulate tobacco products because nicotine is a drug and devices such as cigarettes and smokeless tobacco deliver nicotine to the body. Brown & Williamson Tobacco Corporation sued challenging the FDA regulations over tobacco product under the Food, Drug, and Cosmetic Act. They claimed that history of the Act did not allow the FDA to regulate the tobacco products. The United States District Court ruled that the Food, Drug & Cosmetic Act allowed the FDA to regulate tobacco product as a device, but under section 360 (e) the agency had overstepped its authority to promote and advertise tobacco products. The Court of Appeals for the fourth circuit reversed the decision of District Court, holding that FDA had no jurisdiction to regulate tobacco products. Because, the description of tobacco (as a device) was imperfect and the agency could not verify that the impact of tobacco products on the body was intended under the act.
