Transnational Crime And The Criminal Act

Human trafficking is the modernized version of slavery that involves force, fraud, and/or a type of labor in a sexual act. The United States government defines it to be “In which a sex act is forced in which the person induced has not yet been attained eighteen years of age” (National Institute of Justice). Human trafficking is a threat to all nations and promotes breakdown of families and can support organized crime. Trafficking can occur everywhere. Human trafficking and human smuggling are related to one another, but different crimes. The difference between smuggling and trafficking is that smuggling is the illegal movement of someone across a border while trafficking is the illegal exploitation of a person.

Human Trafficking is a form of organized crime, in which people of all ages are taken from their homes to be exploited for sexual or labor purposes. The traffickers use fear and violence to get these people to come with them, and all they really want out of it is money. I will be using four main sources to gather my information. First I will give a general overview of two websites giving great depth into the topic of human trafficking. I will then summarize three case studies on human trafficking. Finally, I will give my views on the issue, and tell why it is such any important topic for the public to hear about.

In fact, it is now considered as the fastest growing multi-billion-dollar business form of organized crime. One of the major issues today in criminal justice is human trafficking. As a definition, human trafficking is the illegal transporting of people, by use of force, to be sold or sent to modern-day slavery (Homeland Security, 2017). There are countless methods of human trafficking throughout the world. Unfortunately, each one is more horrendous than the preceding. To elaborate, some types of human trafficking are Forced Labor, Debt Bondage, Domestic Servitude, Commercial Sex Trade, Child Soldiers, and Child Commercial Sex Trade (The United States Department of Homeland Security, 2017). That being said, the most widely discussed forms of human trafficking are sexual subjugation (Human Trafficking Prosecution Unit, 2017).

Human trafficking,the illegal practice of trading in human beings for the purpose of prostitution, forced labor, or other forms of exploitation, is a crime that affects the most vulnerable citizens of society. After drugs, it the largest criminal activity globally! The victims must be the primary concern for all law enforcement units. Human trafficking in the world can be diminished and possibly erased through teachings, government intervention, and awareness.

Human trafficking is an ongoing criminal industry that affects the lives of many individuals as well as deny them the simple right of freedom. There are three main kinds of human trafficking which are all different from each other, yet still impact a huge population of the U.S. Sex trafficking, labor trafficking, and debt bondage are the different kinds of human trafficking that affect people in the US. In addition, within sex trafficking, there is also the existence of child sex trafficking and prostitution. According to the International Labor Organization, there is an estimated 209.9 million incidents of human trafficking worldwide.

The services aimed by the dealer are forced as mentioned earlier and mainly include forced sex slave, forced labor, or prostitution for the sake of earning money using humans completely out of moral bounds. The kinds of acts included in the human trafficking may be the one of providing a spouse in case of forced marriage or even the physical withdrawing of tissues. It is sad, but true that there exist no bound to the human trafficking as it may occur nationally or internationally. It is indeed a criminal offense because it results in a breach of human rights and involves the misuse of their body. There exists no condition pertinent to the movement concerning the human trafficking as it may occur at the residence of the forced personnel (Kempadoo, et. al, 2015).

The elements of Human Trafficking are (1) The Act, (2) The Means, (3) The Purpose. The Act involves “What is done”, such as: recruitment, transfer, harboring and or transportation. The Means involves “How it is Done”, such as: abduction fraud, coercion, threating with force, abuse of power or vulnerability. The Purpose involves “Why it is done” such as: exploiting the prostitution of others, sexual exploitation, slavery, and other types of exploitation.

Human trafficking is a topic that is not discussed very often in society. Many people fail to realize that human trafficking still exists today. Human trafficking violates basic human rights. It takes away the freedom and security of men, women, and children world wide. The diversity and widespread execution of human trafficking make it difficult to regulate and prosecute.
