Sometimes people in Florida, and elsewhere, participate in activities or events that they know are dangerous. This may include running in a race, skydiving or even riding a horse, among other activities. In order to protect themselves, the businesses, organizations or people running such events may require participants to sign liability waivers. Should they suffer serious injuries after signing, however, their options for recourse and restitution may be limited.

When his neurological symptoms continued and worsened after he returned home, the man sought medical treatment. He was diagnosed with post-concussive syndrome. Since he had signed the tournament’s liability waiver, however, the event’s organizers and Disney reportedly claimed that they were not responsible for his injury, or the resulting damages.
Appeals court ruling
According to the Orlando Weekly report, the tournament had a liability policy for the event. However, the man’s claim was denied because he was injured at the trade show, and not during the tournament itself. In 2010, he took legal action against the park, the organizers of the event and a one of the vendors at the event, among others. His lawsuit was reportedly dismissed based on the liability waiver.
Recently, the Orlando Sentinel reported that the 5th District Court of Appeal reversed that court’s decision. As a result, the man will be able to pursue his lawsuit, and have his day in court. While Disney did have the option to seek a review from the Florida Supreme Court, it has reportedly decided not to take that step.

NFL players have finally gone against the NFL corporation. This specific argument went to court saying that head trauma was never in the professional athlete's settlement. Hurley explains “That the settlement did not cover potential victims of a degenerative brain disease that scientists have linked to repeated blows to the head” (Hurley) Professional players are still not agreeing with the NFL and the rules about the concussions. There have been many professional football players who have brought up the argument of concussions with the NFL and they have not won. Despite that, the court argument with Siegel went in the professional athlete's way. Later on, Siegel announced that "Forty-five hundred players sued the league over concussion-related injuries" ("Concussion Dispute") These athletes that have brought this argument back up having thought this was unfair to them. Through the findings and the explanations about the NFL settlement with their athlete's there should be a change to their settlement to be in more favor of the athlete's life since it is at risk. This has become an important issue since Ryan Freel took his life after suffering from depression. Researchers analyzed his brain and found that he was suffering from CTE. Torre uses pathos to reach people’s emotions by pointing out that Freel was an all-out player who was famous for diving catches.

The National Collegiate Athletic Association’s (NCAA) motion to dismiss at the US District Court for the Western District of Pennsylvania involves Plaintiff Matthew Onyshko’s (Plaintiff) claim that his health issues resulted from the NCAA’s negligence to inform, protect, and mediate student-athletes that are exposed to head related injuries. This memorandum will establish the relationship that the two parties share and the extent that the duty of care applies to this relationship. By analyzing NCAA’s duties, if any, to the Plaintiff —including the duty to protect, duty to warn, and how risks not contemplated by the Plaintiff apply to the case— we find the NCAA, while having a strong case, does not have grounds for dismissal. Finally, we will assess the NCAA’s limited liability due to their defenses including assumption of risk.
My first trip to Disney World, now that, that was a memorable trip. That trip was one of the most magical and happiest memories of my life. It was back in 2008, I had just turned 6 years old a few months before we left to go there. It was summertime, and the weather was perfect. I remember being so bored on the way there because I am an only child so I didn’t have anyone to entertain me besides myself. My mom’s side of the family went on this trip with us, and at the time I was the only grandkid, and the only kid at all. So once we finally were almost there I remember passing the big ‘Welcome to Disney World” sign and being so excited I peed my pants--my mom was pretty mad, but my dad thought it was kinda funny so I didn’t get in too much trouble.

These three incidents of sports illustrates that injuries can be unpleasant in any sports given and athletes have great amount of risks while they continue their game in the field, in order to amuse their viewers (Bird 91). Apart from the examples mentioned above, there are several small and large accidents that have occurred in the past and they have made the life of sportsmen bitter and even their future uncertain, with respect to their ability to work.
