Imagine someone close that’s lived the straight and narrow to get where they are at. They are not perfect, maybe they could have put a little more time into their assignment at work or held their temper towards the grandpa driving too slow in front of them, but they’re just human living life the best way they know how. When a not-so-freak accident occurs and they find themselves behind bars imprisoned for the rest of their life. Sounds like the plot to “Shawshank Redemption” right? At this very instance, this story is being told of ordinary citizens behind the curtains of the New York Court System in rapidly increasing numbers. Courts are established social, political, and judicial institutions necessary for the manifestation of justice and the maintenance of law and order. The courts are part of the judicial branch of government, as outlined in Article III of the United States Constitution. Courts are the arenas in which the law is tried and applied. Judges are the presiding officers of the court. The United States Supreme Court is the most fundamental court because has "the authority to decide the constitutionality of federal laws and resolve other disputes over them," (United States Courts, 2012). This is true even though even though the court does not expressly enforce that law; enforcement is the province of the executive branch.

When the English were colonizing North America, they brought with them their laws. Being from the British Common Law system, the settlers understood how that system worked, so they modeled their own government using Common Law.

The courts play a huge role in the criminal justice system. The dual court system of the United States (U.S.) was established through the U.S. constitution. The court systems have a multiple purposes and elements of court. Federal and state court system is what makes up the dual court system of the U.S. Today the U.S. court system is what it is today because of previous legal codes, common law, and the precedent it played in the past. Making the U.S. court system a vital role in the criminal justice system..

The California judicial system and the United States federal system are different but comparable. Consequently, both the California and the United States federal judicial system handle different types of cases. Essentially, California handles cases that deal with 1) state courts 2) civil cases and 3) criminal cases. On the other hand, the United States federal system handle cases that deal with 1) the Constitution, 2) laws that are passed through congress and 3) cases in which the United States is a party. In spite of the fact that the California system and the United States federal system are different yet comparable, this paper will address both court systems concluding with the United States federal system being superior to the California system.

There are two kinds of court in this country. The two courts are state and federal. In this essay I️ will be briefing you on the things that they have in common and the things they don’t have in common such as behavior in the court and the way they handle the state court room.

In reviewing the court system of the United States there is a definite hierarchy between the trial courts, appellate courts and the supreme courts of both the state and federal levels. However, the actions of the court systems move at such a slow and hindered pace because of the bureaucracy of motions and objections among many others. The federal system of government in the United States shares power between the federal government and the state governments. Our political system dictates that both the federal government and each of the state governments have their own court systems. Therefore, while the Constitution states that the federal government is supreme with regard to those powers delegated to it, the states remain supreme in matters reserved to them. Both the federal and state governments need their own court systems to apply and interpret their laws which are done by specifically spelling out the jurisdiction of their respective court systems.

“The court finds you guilty on all accounts. You are sentenced to 35 years in federal prison. Court dismissed.” If only justice in America was the same as a hollywood movie, where, in the end, each and every person put on trial receives a true and just verdict. It would be nice if America’s justice system was designed so that “you couldn’t be the next victim of corruption - innocent and sent to prison, or strapped to a table and put to death; or robbed of your life savings by American lawyers” (Sachs, America’s Corrupt Legal). Welcome to the new America, where all it takes is pockets as deep as the Pacific Ocean to be innocent and poverty to be found guilty, thrown in jail, and not given a second thought. Although America often prides itself on its just ways of governing and dealing with potential criminals, the justice system is often corrupted because of social issues, ethical issues, corrupt officials, and control of the press.

Over the last 224 years, the US court system has been continually evolving. At the heart of these changes, is the belief that the Constitution establishes basic practices that must be followed at all times. This has led to the development of a legal structure that is based on case precedent and oversight (which are augmented with constitutional ideas). The combination of these factors has meant that the judicial branch is continually transforming. To fully understand the way this is taking place requires examining the dual court system and how this compares to other countries. Together, these different elements will highlight the way the US judicial system has developed in comparison with other regions of the world. (Couser, 1992, pp. 14 29)

People in the United States attend court every day for different many reasons. Those reasons could be for traffic violations, civil law suits, or for unlawful criminal acts. No matter what they are all handled and disputed in a court of law. Courts are empowered to make fair and binding decisions upon the facts that are received. The United States court system is the institution were all the legal disputes in the american society are carryed out and resolved. However, one single court is not enough to resolve every single dispute in society and that is why the court system is made up of two different courts, the federal courts and the state courts. Moreover, the federal and state courts are made up of several divisions made to handle legal disputes differently depending on its seriousness. For example, the state court is made up of trial courts of limited jurisdiction and probate courts were cases and disputes originate and then move up to trial courts of general jurisdiction, intermediate apellate courts, and courts of last resort respectively depending on the case.In contrast, the federal court consists of district courts, territorial coutrs, tax court, court of international trade, claims court, court of veterans appeals, an courts of military review which then move on to courts of appeals respectively and may ultimately end up in the United States supreme court. In addition, cases from state court may also appeal into the federal court system but not the other way around.

There are three women on the Supreme Court, one of whom is Latina, and there is one black justice serving on the Supreme Court (Brown, 2016). This is a major issue. The United States, the “melting pot”, has an extreme lack of diversity in their court system. This is an issue that affects several aspects of society. Decisions made by judges will affect the lives of men, women, and their families. The decisions made by judges can also create law. Unlike political officials, the people do not always have the power to vote judges into their positions. Instead, the people hope that their peers with the power to affect the system choose a candidate that will fight for them. Often times, this does not happen.
