These rules restrict what a jury can and cannot hear or see, details of the law, and the importance of the effective performance of the law enforcement officer. Americans are well aware of the rules that govern evidence; but what are they, what do they mean, how do they apply to each case, and how are they broken down.
One of the struggles I face with my students is getting them to use textual evidence in a meaningful way. Another struggle I face with my students is getting them to analyze the textual evidence they use, rather than summarizing. For the Regents, students are expected to complete a Text Analysis Response (TAR) and an Argumentative essay. Each year, I find that my students struggle more with the TAR. Part of this is due to the fact, that what they are required to do is extremely complex: “identify a central idea in the text and analyze how the author’s use of one writing strategy develops this central idea” (nysedregents).
