Prosecuting those who commit crimes is very important to the overall wellbeing of society and the citizens within society. Prosecuting and convicting criminals not only prevents them from committing another crime, it also serves as a deterrent to others that may be considering breaking the law. Many courts make up the judicial branch and these courts are responsible for applying laws made by the government. The courts are made up of courtroom workgroups that are the basis of the courts proceedings.
When the English were colonizing North America, they brought with them their laws. Being from the British Common Law system, the settlers understood how that system worked, so they modeled their own government using Common Law.
The Supreme Court is the highest judicial court in the country or the state, they take judicial precedence over all over courts in the nation. Every year the Supreme Court receives about ten thousand petitions and if four Justices agree to grant the petitions then, the Supreme Court will consider the case. Out of all the cases there are only about one-hundred or fewer cases that they will chose a year. I will be discussing seven well known cases that were selected and decided on. These cases went on trial for months until the jury and judge could make a decision. Unfortunately, these cases were tried unfairly, missing key evidence in some way.
I conducted my observation at the Regional Justice Court in Las Vegas, Nevada. This is located at 200 Lewis Ave. I was able to see the morning docket of the Honorable Judge Diana Sullivan, who happens to be one of four pilot judges for the new Nevada Pretrial Risk Assessment (NPR). I went on the morning of Monday March 20th, to observe both her 8am docket and her 9:30am docket. The 8am docket contained initial appearances and arraignments for the in-custody suspects. There were a few status checks and arraignments for out of custody suspects as well. The 9:30 docket was entirely out of custody and there were a few initial appearances and preliminary hearings.
I do agree that it’s not too many layers and that it’s a good system. It gives us balance between the state and federal. The state is allowed to handle local issues that deals directly with it local citizens and that federal courts helps out to interpret the constitution to ensure that citizens’ rights weren’t violated by the states courts.
In both China and the United States, the judicial system is composed of courts that contain several different levels. However, there is a basic structural difference between the Chinese and American legal systems. In America, the three branches of government are supposed to be separate, so that the court system is supposed to be beyond party politics and partisan antics. This separate system of checks and balances does not exist in China. On the contrary, the judicial branch is not independent. It is meant as an extension of the government, and therefore of the single political party with any power in China. The distinction between American judicial independence and Chinese judicial dependence may be one of the most critical differences between the two systems because the American judicial branch is meant to act as a check and balance with the other systems, while China's three-part system has the same branches but lacks the same independence.
The first type of specialized courts are domestic violence courts that focus only on domestic violence cases. Which became very popular when more offenders started getting prosecuted. The second type of specialized courts are drugs courts, that mainly focus on treatment programs for drug users to help offenders realize their issue and try to prevent it from occurring again, instead of jail time.
