Schools are having to update their code of conduct because of new circumstances that the schools face. Schools have to consider every aspect, otherwise the schools may find themselves being sued by the student’s parents. Bullying and harassment has increased throughout the years. Not only that, but it has become more severe. Teenagers have committed suicide because of this. There used to only be bullying face-to-face. However, because of technology and social media, bullies are now able to bully and harass others without having to be next to the person. Schools used to not have any control of what happened to students outside of school, but because of many furious parents suing schools for not doing anything, these schools have to consider …show more content…
Madera High School’s code of conduct needs to be up-to-date because, for starters, what is meant to be cyberbullying they have it under “ ‘Electronic Act’ ” and the definition under it states, “the transmission by means of an electronic device, including, but not limited to, a telephone, wireless communication device, computer, or pager, [etc.].” The consequence for an Electronic Act is under Suspendable and Expellable Offenses. There should be given advisements before going towards suspension or expulsion, depending on how severe the case is though. If it came to a point where the target considered to hurt his or her self, then suspension would be a right consequence for the perpetrator. School officials also need to learn how to deal with and who to turn to when a student comes up to a school official and explains to them about being cyber bullied. Sometimes talking to the bully does not always stop the bullying. Going back to the digital pile on, where it may come to about 400 students getting in trouble. The code of conduct should have different offenses for how severe the involvement of the certain individual had. Also, the background of the student should be taken under consideration when the punishment is given. Going through the student’s record may or may not help the student when awarded a punishment. If the student has a clean background, does not indicate any sorts of fight or getting into trouble, then the punishment shall be minor. However, if the student has a record of getting into fights, getting into trouble, well then the consequence shall become major. Cyberbullying should not be taken lightly. There will be consequences upon the event of any sort of cyberbullying. The only difference there will be is on the punishment on how minor or major it will be. Updating the code of
After looking over the Hoover High School code of conduct, there is one rule that I think is not justified. This rule is 3.15, assault upon a student or other person.
A young boy was once sitting on his computer when he saw an email from one of his peers. He opened the email, and soon enough realized he was being bullied. However, the young boy let the cyber-bullying get out of control. His parents told the school about it, but there was nothing they could do. The boy had to go to a new school where he wouldn’t be bullied. There are many problems like this that get out of hand, so much that the school can do nothing to help. Many people blame the school for not helping, when there is nothing they can do about it. Therefore, schools do not have the responsibility to respond to and protect students from the challenge of cyber-bullying, even if it’s off campus.
There is an increase in cyberbullying due to technology, the school has the right to protect their students, and it affects how teachers work. Numerous individuals trust that punishing students for what they say outside of school goes against the First Amendment, yet in the event that it disturbs the wellbeing of the student body, something should be done. At the point when students are included with cyberbullying, it unquestionably goes past the school's doors and influences not only the student, but the general population around
As more and more children go to school, the rates of bullying go up as time goes by. there are many times at which students suffer all the bullying that occurs within their lives. As more schools become aware of the magnitude of the bullying occurring right under their noses, there are rules created to aid the victim. There are various types of bullying and these are created to do one thing, instill superiority among the “stronger” and place a feeling of inferiority. Bullies are the ones who are detrimental to a child’s development.
In addition, we used the 2015 Florida School Laws book and the Florida State Statutes to review the K-20 Education Code. The major topics of the summary paper were bullying, due process, and FERPA. To complete the summary, I read through many legal documents, such as the Duval County School Board Policy Manual Chapter 10, Duval County Code of Conduct, Fla. Stat. §1006, §1002, §1003, and the U. S. Constitution. According to the state statutes, every school district must have a student code of conduct that includes a bullying and harassment policy. This document provides the foundation for student expectations and responsibilities at school, school-related activities, and situations that affect school culture. The state statutes specify the responsibilities and obligations of teachers regarding supervision and discipline of students. Teachers must make all decisions in the best interest of students in academics and safety. Due process of law and equality are guaranteed in the Fourteenth Amendment and forbid the basic rights of life, liberty, and property from being unfairly taken away. Substantive due process refers to government guidelines and rules that deny students of their fundamental rights. Procedural due process is a way of making sure the school system provides fair and appropriate measures to
These kind of surveys reveal the necessity of facing cyberbullying logically and prudently, among young people. Schools have very important role in controlling this issue between students. Some people believe that school should suspend students who have perpetrated cyberbullying, but since this kind of punishments can have serious consequences other options should be considered first before any suspension. In this paper we discuss why the suspension should be considered as the last option. Suspension will only result in hiding the fact of the issue and is not an effective solution, because it will not only harm perpetrator, but also will harm victim by preventing her/him from learning how to deal with issue wisely, and it only shows the lack of an elaborate educational system.
Is the threat of bullying a real threat to kids today? Bullying has been a threat for a long time in schools and adding the new advances in technology such as cell phones, twitter and facebook bullying is now being done online and school learning is being affected. Schools should have the power to limit students’ online speech because the percent of boys and girls being cyberbullied is raising, teachers teaching ability is being affected, and students learning in class is being affected. One reason schools should have the power to limit their students online speech is cyberbullying is now a problem in the United States. The Cyberbullying Research Center posted statistics in February 2010 saying 16.6% of males between the ages of 10-18 have been cyberbullied and 25.1% of females ages between 10-18 have also been cyberbullied (Doc A).
To begin with, Ontario created Bill 13 as an amendment of the Education Act, to help those suffering from bullying. According to a website: “The purpose of this legislation is to: 1 identify bullying; 2. prevent bullying; and 3. improve inclusiveness in schools” (Bill 13 - Accepting Schools Act). Bill 13 helps provide support for students that are being bullied and improves how the school approaches these situations. Their goal is to reduce the amount of these incidents and provide healing for the victims. It also requires for schools to prevent bullying to make sure that students are learning in a positive and safe environment at all times. Therefore, having this law ensures the students’ safety and prevents bullying from ever
A meeting is then held with the parent(s) of the student(s) trying to stop the online/confrontational bullying/harassment on/off campus. Student(s) will then later sign a behavior contract for the first warning that can lead to suspension or expulsion if the contract is failed. Sometimes it can be a challenge to make these teens stop promptly but now that it involves social media some might think it will be more difficult for one to find them in the act of a crime that cannot only cause troubles for themselves but bring a high amount of intimidations to peers or the victim as well. The world today is surrounded by social media and it makes it easier for kids not to be confrontational to people they might not only like an addition to easier targets. Harassment affects kids in negative ways which stop them from participating in school functions and even school itself. Why should the kid being bullied/harassed be the one who stops coming to school? Every kid deserves the same opportunities, but some just throw it away for what they think is a fun time and will not be a big issue to schools. The issues around bullying and harassing have not decreased nor increased and that is another issue schools should react to and solve. At MHS and in other schools it is a big issue and the code of conduct may not be updated to what has changed like
After the Columbine massacre, schools have truly put their foot down on student threats and bullying by enforcing zero-tolerance policies that punish any violation of a rule, regardless of ignorance, accidents or other circumstances.("9 Ways School Has Changed Since Columbine." Criminal Justice Degrees Guide. N.p., n.d. Web. 05 Oct. 2017.) Students, staff, parents and other school visitors who are in possession of a weapon or drug are punished. zero-tolerance has lead to many criticisms and overreactions by school districts, such as student expulsions for bringing nail clippers or a knife to cut a cake to school.("9 Ways School Has Changed Since Columbine." Criminal Justice Degrees Guide. N.p., n.d. Web. 05 Oct.
Madera High school in its past years have dealt with many cases of bullying and harassment among the students on the campus. A hand full of students from Madera High stated that people being harassed and picked on was something that was seen often on social media and up in personal. This became a major problem when social media such as Myspace were first made. This was the beginning of online harassment and bullying. Cyber bullying isn’t something that other people should just look past and ignore because people take their lives from it. People don’t notice what’s going on in the life of a victim that is bullied. Nowadays mostly all of Madera high school students have social media and physical bullying is more rare to see because most of the
Bible Belt Academy advise that all employees shall not commit any act of violence, disorderly conduct, rudeness or violation of any rule on or off the job. We are not a company that trying to control one’s life. We just want our employees to understand the importance of ethics of always doing the right thing. Cyberbullying is a major problem Young people have hurt themselves because of cyberbullying. School Administrators sometimes feel they have to punish students for online activity, even if it happens off-campus,
Lawmakers, activists, and parents have all been working to institute laws to help reconcile the bullying that has invaded the schools. It has not been a speedy process, only nine states require the schools to report bullying to the local authorities (Garby, 2013). New Jersey has the stiffest anti-bullying law thus far, by suspending or
Bullying and Ostracization of children has become a significant problem in schools. “School bullying statistics in the United States show that about one in four kids in the U.S. are bullied on a regular basis.” (“School Bullying Statistics”. (n.d.)) According to Merriam-Webster online dictionary (2017), bullying is “to tease, hurt, or threaten a smaller or weaker person”, and ostracization is “to not allow (someone) to be included in a group”. Many children are picked on or completely excluded or shunned from peer activities. When a child is bullied or ostracized it can lead to low self-esteem, emotional issues, and in extreme situations death. There are different types of bullying such a verbal and physical. There are many anti-bullying movements already in play trying to reduce bullying within school settings. By reducing bullying and ostracization the school environment will be safer, more productive, and more enjoyable for all students. There are several techniques to reduce bullying and ostracization of children in school. I believe that the best approach is to start at an individual level. We need to teach children to accept and respect each other on a personal level. Requiring students to work with and spend time with other students who they would normally not associate with and removing students from their regular groups and having them get to know other students without the influence of their group are a couple
