The Death Penalty Should the death penalty be illegal in the United States? Should the death penalty have ever been used at all? Most people would say that the death penalty should not be illegal, while I think it should be illegal and should have been illegal. There are many reasons why the death penalty should be illegal, but what is the death penalty?
The death penalty is when a person is put to death, by the state, for a crime that they have committed. The death penalty is also called Capital Punishment. The first recording of the death penalty was recorded in 1608 when a man named George Kendall was sentenced to death for spying in Spain. This happened in Virginia and after four years things such as, exchanging goods with Native Americans or killing chickens were considered crimes and people could be punished by death. Capital Punishment had then spread through Pennsylvania to Michigan, and then started spreading throughout the United States.

Whenever Capital Punishment was legal people started to use drugs to stop a person’s heart instead of some of the other methods that were used. Some of the other methods that were used were electrocution, a firing squad, a gas chamber, and hanging. A firing squad and hanging are no longer allowed in the United States. Electrocution, lethal injection, and the use of a gas chamber are all allowed in the United States. Prisoners are allowed to decide between the methods they can die from. The death penalty is the punishment of execution, administered to someone legally convicted of a capital crime (law.cornell.edu, 2015). The first Congress of the United States authorized the federal death penalty on June 25, 1790 (deathpenalty.org, 2011). The death penalty can also be referred to as capital punishment, however capital punishment also includes a sentence to life in prison, as opposed to strictly executions. A convict can be sentenced to death by various methods including lethal injection, electrocution, gas chamber, firing squad, and hanging. After the death penalty was established, many debates have arisen arguing that these methods violate several of the United States’ Amendments. Select cases have been accused of violating the Sixth, Eighth, and Fourteenth Amendments. It is important to note that the judiciary goes through a series of processes prior to deciding a sentence for a capital crime. Many factors influencing the verdict include proportional analysis, individualized sentencing, method of execution, and classes of people not eligible of the death penalty. This paper will discuss brief descriptions of the methods used for executions, economical issues, the Supreme Court’s opinion regarding the death penalty, as well as important factors that make up the proportional analysis, individual sentencing process, method used, and determining classes of people who are not eligible for the death penalty.
Capital punishment is a legal authorization to kill someone for a crime they have committed. The death penalty has been the highest form of criminal punishment in the American judicial system since the 13 colonies. It has taken the form of hanging, stoning, drowning, burning, beheading, gassing, electrocution, and injection. The taking of a man 's life as penance for criminal behavior is wrong. The moral injustice of murder, the cruelty of execution, and the death of innocent men are all concerns that make the death penalty wrong. Our society has taught children that violence is not the answer and yet our highest form of punishment is executing someone which does not solve anything, nor does it fix a problem. The United States should abolish the death penalty due to execution of innocent people, excessive cost and it is against the US constitution.
The death penalty also known as capital punishment is an execution in which the person who committed the offence is put to death by the state. It was first practiced in Jamestown colony, 1608. The person was hanged for spying for the Spanish government and was the 1st person sentenced to death in America. The death penalty, or capital punishment, has been around as early as the Seventh Century B.C. and is still used in many countries today, including the United States. There are many arguments stating capital punishment should be abolished for many reasons, including that capital punishment violates the Bill of Rights, and life in prison is a more effective deterrent than capital punishment; there are also counter-arguments, saying that capital punishment should not be abolished for reasons such as capital punishment achieves justice for those who have been wronged and that it brings a sense of closure to families.
After many years of having the death penalty In 1960 people began to suggest that they abolish the death penalty due to how cruel it was. Due to this suggestion the law on the death penalty changed in 1976, only those who were convicted of intentional homicide would be executed. Although they had changed the laws many states still disagreed with the death penalty. Those states that did not agree with the death penalty fought and had it taken out. The death penalty should be illegal in the United States because often times, the state executes the wrong person. Someone could be executed but later the real person comes forward and confesses. This has happened many times before. This means that someone is executed for something that they didn’t do. And while the state could just release someone after they are found innocent, there is very little someone can do after they execute the wrong person.

There are many debates about abolishing the death penalty use as of today. Reasons vary among people as to why the death penalty should be abolished but they all agree it should be abolished.
