Software Piracy beyond the Street Corner
On January 23, 2003, the world’s leading computer networking equipment maker Cisco Systems, headquartered in San Jose California, filed a lawsuit against China-based Huawei Technologies and its United States subsidiaries Huawei America and FutureWei Technologies. In the lawsuit, Cisco alleged that Huawei stole intellectual property by copying its Internet Operating System (IOS) software and its copyrighted user manuals. Cisco also claimed that Huawei infringed on its patents. Huawei also pitched the fact that any Cisco-trained engineer could operate the Quidway router with ease. Cisco’s rise to the leadership in networking equipment and technology was the result of many years of diligent, hard work and creativity. Cisco holds several patents, copyrights, and trade secrets that are critical to its success. Huawei, on the other hand, chose to make shortcuts and had complete disregard for the sanctity and legality of intellectual property. In fact, Huawei’s Vice President confessed that “all the world’s leading equipment suppliers are our learning modules.”[1] Can Huawei’s belief in “learning” from their competitors and Cisco’s belief that Huawei stole and copied intellectual property be attributed to a differing ethical perspective due to culture? We will discuss this in Section 3.
Cisco claims against Huawei involved copying IOS source code, copying technical documentation and user manuals, copying command line interface (CLI) and screen displays, and patent infringement.

While this case proved to be an exception to most individual’s moral code, Apple still challenged the FBI and refused to allow access to the iPhone information in a court case and Apple deemed that it would be unethical to create software that would “undermine the security of the devices”. (Moser) According to Apple Inc.’s code of ethics in regards to suppliers they are allowed to disclose information in accordance to different laws (Apple Inc). In the case of the San Bernardino terrorist attack Apple stepped away from this ethical code because they felt that by allowing the information on the phone to be accessed it would be a breach of security and the first step on a slippery slope that would possibly endanger the information of all iPhone users. (Moser) Even though Apple had already had a code laid out in regards to security they still have to make ethical judgments in certain situations based on the morals of the situation and all those who are involved. This supports the case that ethical codes are ever changing and need to be altered to in regards to different situations and diverse moral codes. This ethical issue spans to other moral codes besides the concept of security. It spans from labor issues to environmental issues that are becoming more prevalent in the technological world.
Huawei is produced in China and is distributed and sold in Europe, India, Africa and the US and UK. Their products being produced in one country and distributed to other creates a geographical space gap between the manufacturer and the consumer.
A potential sustained advantage for Cisco is leading the market across several segments. Cisco is a leader in providing routing, switching, and associated services including comprehensive security and mobility solutions. According to the company, at the end of 2014, it had 47% share of the market for routers; 48% share of the market for TelePresence solutions; 51% share of the market for wireless LAN products; and 64% share of the market for switching products. In addition, Cisco was also the leader in voice products category with a market share of 39%. Leading market position across all its products segments provides Cisco a competitive advantage over its peers.
Many people in the West may have never heard of the Chinese brand called Huawei, but Huawei’s products have been all over the world. According to Huawei’s official website, so far, about one-third of the world’s population in more than 170 countries and regions are using their products, and 45 of the world’s top 50 telecom operators are also the customer of Huawei (Huawei.com). In the UK, its customers include BT, Everything Everywhere, O2, Orange, TalkTalk, Virgin Media and Sky (Anderson, 2012).

For this reason, the Internet has become a necessity to the American population, shown in the estimated 50 million users on-line in the U.S. The ease of Internet access has increased along with the advances in technology. Apple is being criticized in China for three main issues, including slave labor, guarantee scandal and underdeveloped infrastructure. However, China is a significant market for Apple. Apple’s market share in China is continuously growing while decreasing in mature countries. Issues related to human rights and labor protection in China are sensitive and of globally mutual concern. If we do not address these issues properly, we will lose Chinese customers as well as suppliers and sub-contractors. This may also seriously impact the reputation and sales of Apple products worldwide.
Shortly after Google.cn received its license from the Chinese government in 2007, Google proceeded to sign a set of guidelines, designed to reduce the risk that their actions would lead to human rights abuses in China and other countries. The challenges of censorship in China have forced Google to look beyond the appeal of China’s gargantuan search market. Instead, Google shifted its focus to the operating systems of smartphones. Relationships are extremely hostile between Google and China, and the options for China are quickly disappearing. The only course of action left for China is to build its own Chinese mobile-OS for Chinese mobile devices. Regardless of Google’s legal efforts and privacy challenges, it is still pressing on with several innovative projects. Technology is inevitable, and the Internet has reached nearly every corner of the world. For the countries that do not adopt the Internet as a part of their economic activity, it will be an uphill struggle to receive new information and new ideas, especially if those new ideas mean the difference for whether societies evolve.
Because of this support and relationship with the Chinese government, Huawei have faced significant political obstacles in its international expansion. The Chinese company, in fact, has been considered as a threat by different western countries, becoming the “focus of contract exclusion and finger pointing by certain western governments” (Chung and Mascitelli, 2015). The most evident case is represented by the conflicts that the Chinese company faced with the US market.
Other leading firms as NOKIA and MOTOROLA thought the technology didn’t be prefered by customers. Appearance of apple was the threaten factor to HTC.
