If prostitutes could turn to police for help from an abusive pimp or unwanted client, without the fear of being arrested, they would be able to work in a more secure and professional environment. Legalizing prostitution, can allow sex workers to form unions, make a safe environment for them, allow birth control and condoms. Thus reducing STD and unwanted pregnancies, and even give prostitutes the right to say no. “If sex workers should be required to get regular blood and STD tests, so should the clients who see them. Whether these two protections -- against violence and against disease -- come about through decriminalization or legalization depend upon the letter of the law.”

It’s called the oldest profession in the world, but despite its longevity in almost every society and culture, sex work is illegal in most places. Research suggests that the decriminalization of prostitution would be beneficial because it would reduce the danger posed to sex workers, stop imposing a civil law on a morally wrong activity when sex is consensual, and provide the government a tax income instead of a legal expense.

Abstract: This paper explores the world’s oldest and most controversial occupation and puts forth a foundational plan for legalizing and regulating sex work in a safe way that satisfies both radical and liberal feminists ideals. To understand how prostitution has evolved to where it’s at today, this proposal travels through the history of prostitution in the United States (heavily focusing on the twentieth century.) Prostitutes were initially accepted and openly sought after. A shift in societal norms and values placed sex work in a heavy degradation. The regulation of prostitution in Nevada began in 1970 and resulted in the first licensed brothel in 1971. Fast forward nearly fifty years and prostitution is outlawed in 49 out of 50 states. Vast amounts of money are being spent annually in failed attempts to stop prostitution all together. Radical feminists are those who would identify as conservative. They are against prostitution on the belief that it victimizes and degrades women in poverty. Liberal feminists strongly agree that the government has no place in a women’s body and that the right to perform sex work is human right. This paper analyzes these different perspectives and incorporates a model that will resemble the current working regulation in Nevada. Stricter stipulations such as health requirements and the legal age should help influence radical feminist to expand their perspective and acceptance.

Policies and laws fail to stop prostitution, and it will not stop. It is more costly to keep prostitution illegal. Prostitutes will be more vulnerable to getting criminal records, which then makes it harder for them in society, to obtain legal jobs. Also, with prostitution being illegal the workers may not be able to protect themselves from crimes against them. As prostitution is not legal, then they have to find discreet places to work, which usually is not in a safe environment. If some kind of crime against them did happen, they may feel that, they aren’t able to go to the police for help, as their work is illegal. It actually makes it harder on the worker, in turn making it harder for the client. There are all sorts of people who turn to prostitutes. From blue collar workers to high executives of companies, business owners and more. With prostitution being illegal, the clients are facing criminal charges as well. This does not only hurt the client, but communities as well. The author believes that people around the world have changed their older views and sexual norms to adapt to a more modern society. Prostitution has been around as long as human beings have engaged in sexual activities, and it is even touted as the world’s oldest profession. Despite these proclamations, the subject of prostitution continues to spark controversy in the United States in moderns times as it is a hot debate topic. Off and on, throughout the years, various states around the country have proposed that the practice should be decriminalized; however, it remains illegal nationwide, except for a few counties in Nevada. The reasons for this stem from both sides of the argument, as anti-prostitution advocates claim decriminalization of prostitution is immoral and sexually exploitative, while pro-prostitution advocates want to keep the government out of the bedrooms of consenting adults. No matter the stance for or against prostitution, the current legal construction surrounding it is undeniably harmful. Regardless of the arguments against prostitutes, it is time to decriminalize the laws against this practice to protect the rights of sex workers.

The sex industry is highly divided between those who call themselves “sex workers”, and former prostitutes who call themselves “survivors” (Glazer 340). Women should have the right to choose what they do for a living, including prostitution. The criminalization of prostitution does more harm than good when often women are left unprotected, both socially and legally, and therefore, the United States should make efforts to decriminalize and regulate prostitution instead.

It is noted, that arrests and fines are not much of a deterrent, since prostitutes quickly return to the streets to sell sex. (Ivie, 2013). By and large, during the 1980’s several of the larger cities in the United states spent more money on enforcing prostitution laws, than on education, public welfare, health care and hospitals (Raymond, 2013). This should be deemed as unacceptable in such a modern day society. Prostitution, whether done in the alleyways of downtown Columbia, or bedroom of a five star hotel, it is not going anywhere. Those who have no emotional or spiritual connection to sex, will never view it the same way as people who do. Criminalizing prostitution has failed to diminish or eradicate its existence.

I believe that prostitution should not be legalized because it gives men power to dehumanize women, it can be dangerous to the prostitute and the one using the prostitute, and it hurts people financially. Prostitution is the practice or occupation of engaging in sexual activity with someone for payment.

Prostitution has been highly regarded as the “world’s oldest profession”, some evidence even dating back thousands of years before Christ (Forrest Wickman, 2012). Prostitution, in its simplest term, is the act of having sex in exchange for payment (Merriam-Webster, 1828).

Prostitution has been practiced for thousands of years. It is believed to be the world’s oldest profession. Its beginning in ancient Mesopotamia began a somewhat morally disturbing practice that has flourished in the shadows of every civilization through time (Fanni, 2014). Recently, governments have chosen to overlook the morality of this act by making it legal in various countries. America has begun to discuss the pros and cons of allowing such a commonly despised and misunderstood profession to be legalized throughout the country.

One of the oldest known jobs in history is Prostitution, otherwise known as the sex labor industry. It is a major part of our society as an illegitimate source of income and employment. The prohibition of Prostitution creates a larger number of issues in society. Before, prostitution was a more individual decision, where countless women picked it as a last resort in emergencies; whereas now these women are coerced into the industry and experience abuse, murder, etc. The involvement and trauma prostitutes experience results in mental disorders. Furthermore, I investigate how the prohibition of prostitution has greater drawbacks on our society and introduce three policies that may help resolve the social issue within sex workers. Some policies I believe will provide the most benefits are first, the legalization of prostitution, second, enforcing and strengthening the law enforcement for human trafficking, and third, development of availability of medical resources.
