Complete your report in the template below: Table 1 Report Report on the legal requirements for working with students with disabilities Introduction Identify which employees must follow the legislation, and a definition of disability (including a statement on behaviour) as defined within the documents. All the employees who are working with students with disabilities by one or the other way must follow the legislation. Disability in relation to the DDA includes Physical, Intellectual, Psychiatric, Sensory, Neurological, Learning disabilities and Physical disfigurement. About the Disability Discrimination Act 1992 Include the aim, and a statement on rights and participation. Aim- to eliminate 'as far as possible' discrimination on the ground of disability. Its focus is on addressing the physical and attitudinal barriers that prevent people with disabilities from making the most of their abilities and participating more fully in the community. This benefits both people with disabilities and the Australian community. A statement on and participation-There is broad agreement that the rights of people with disabilities should be protected. The Australian Government is a signatory to several international agreements that oblige it to address disability discrimination. It makes it unlawful to discriminate in the following areas of activity: employment education access to premises used by the public (including public transport) provision of goods, services, and facilities applications for accommodation (for example, renting)
disposal of land activities of clubs and associations sport administration of Commonwealth laws and programs requests for information. About the Disability Standards of Education 2005 Include the aim, and a statement on the three main obligations, and a link to duty of care. Aim- All students must have the right to education and training on the same basis as those students who do not have a disability and must not face discrimination when trying to do so. On the same basis means that a student with disability must have opportunities and choices which are comparable with those offered to students without disability. This applies to: admission or enrolment in an institution participation in courses or programs use of facilities and services. Education providers must consult to understand the impact of a student's disability and to determine whether any adjustments or changes are needed to assist the student. Conclusion Include in your conclusion, an explanation of the phrase “on the same basis as” in the context of these documents. Under the Standards, education providers are required to ensure that persons with disabilities can enrol and participate in education and have access to educational facilities and services on the same basis as a person without disabilities. This is achieved primarily through: consultation with the person with a disability- Education providers must consult to understand the impact of a student's disability and to determine whether any adjustments or changes are needed to assist the student. the making of reasonable adjustments- An adjustment is a measure or action taken to assist a student with disability to participate in education and training on the same basis as other students. the elimination of harassment and victimisation- Harassment and victimisation of students with disability is unlawful and education providers must take all reasonable steps to prevent this from happening.
