Medical Practice Act
1
The Medical Practice Act means law and regulations governing the practice of allopathic and
osteopathic medicine within a member state. The medical practice act that I will be writing about
is the Good Samaritan Protections. This is when a person who acting in good faith seeks medical
assistance for another person who is experiencing an actual or reasonably perceived drug-related
overdose if the evidence supporting an arrest, charge, or prosecution was obtained because of the
person’s seeking medical assistance for another person.
This law states that if you help another
person that you see is any sort of medical distress and you help them you cannot get in any
trouble for helping them if they have DNR.
This section that I read on was Title 50 Health and Safety, Chapter 32. Controlled
Substances, Part 6 Help Save lives From Overdose Act. This is something I found interesting,
this law states that if anyone is under pretrial release, probation, furlough, supervised release, or
parole may not be revoked based on an incident for which this person would be immune from
arrest, charge, or prosecution under this section. This law also states that if you help someone
who is experiencing a medical emergency that is drug-related that you may be used as a
mitigating factor in a criminal prosecution for which immunity is not provided under this law.
This law also does not apply to pregnant women seeking or receiving evaluation, treatment, or
supportive services for a substance use disorder.
This next section is Title 27 Liability and Limitations, Chapter 1 Availability of Remedies
—Liability, Part 7 Liability. 27 – 1– 714 states that any person licensed as a physician and
surgeon under the laws of the state of Montana, any volunteer firefighter or officer, any certain
rescue volunteer any person in good faith, renders emergency care or assistance without
compensation, except as provided in section 2 at the scene of an emergency, or accident is not
liable for any civil damages or acts or omissions other than damages occasion by gross
