SITXWHS003 Incident notification A PCBU must notify the regulator as soon as they become aware of a death, serious injury or illness or dangerous incident that arises out of the conduct of the business or undertaking. SITXWHS003 Penalties for breaches of the Act The updated Work Health and Safety Acts based upon the Model Work Health and Safety Act have greatly increased penalties for breaches of the Act. Penalties may now approach millions of dollars and include long jail sentences for cases that have severe consequences. Individual penalties may vary from state to state, so be sure to check the Work Health and Safety Act in your state for the exact penalties that apply. Under the Model Work Health and Safety Act penalties are broken up into three categories according to the degree of risk and the conduct of the person or entity. «+ Category 1 For reckless conduct that exposes an individual to a risk of death or serious injury or illness and is engaged in without a responsible excuse. «+ Category 2 Failure to comply with a health and safety duty and exposing an individual to a risk of death or serious injury or illness. « Category 3 Failure to comply with a health and safety duty. Maximum penalties are set according to the category of offence and the type of duty holder (individual, officer or body corporate) convicted of the offence.
