Hello Professor Derby and Class,
The legal standards for clinical documentation in the state of Alabama "calls for an intake and
evaluation note, and progress notes, as well as a termination note to "likely reduce exposure
to arguments about continued duty of care, and reduce the risk of responsibility in a duty to
protect/warn jurisdiction" (APA Division, Nd). The Alabama Board of Examiners in Counseling
adopted a code of ethics that is pursuant to the American Counseling Association's code of
ethics to govern appropriate practice or behavior as stated in section 34-8A-16 and section
34-8A-17 (ABEC, 2021). Due to this, the similarities far outweigh the differences between state
and federal regulations. The HIPAA privacy rule also ensures that every state follows these
guidelines pertaining to client's and their rights.
