In my opinion the level of force used by officer Mark Morelli and Chantelle Wilson was acceptable. Both officers maintained a respectable encounter with the female and the bystanders who were chanting nonsense, all while attempting to detain the female. She seemed to be a tough
one to get a hold of and a little “over dramatic”. She most likely screamed out to grab attention from those who know nothing about the situation they are coming into. But according to the Criminal Code of Canada Section 25
, it states, the protection of persons acting under authority meaning a peace officer is authorized by law to do anything in the
enforcement of law and must act on reasonable grounds this includes using as much force as is necessary for that purpose. In this case the female was resisting, and they had their reason as to why she was being detained. All the cameras being directed at them I bet it put a pressure on them because any wrong move people and the bystanders will twist the situation. Making it seem the total opposite of what they intended. It was not necessary at all for the officer to explain to anyone about the decision made. But it was to clear his concise he did that for himself to maybe not look bad to the camera. He did not want to be seen as a bad cop who was detaining a female for no reason. But citizens never know who that person was, what they did before, and if they were already being tagged by previous events, they were maliciously caught in. Officers are acting in accordance with the standards set out in the regulations and the requirements of the Canadian Charter of Rights and Freedoms and the Human Rights Code (Ontario Police Services Act, 2023).

Identify and describe the factors that suggest the suspect is a person with a mental illness. Discuss the appropriateness of the police officer’s response to the situation. Discuss the degree of control the officer had over the suspect’s movements and identify any potential concerns for bystanders. In the case of Javier Aleman, he began by cooperating with the officer, but it seemed as if when the officer mentioned that Mr. Aleman was going to be searched, his behavior went from mild to severe another factor is his state of housing, it is said that homeless people have a history of mental illness which majority of them have substance abuse problems (
D. Cotton and T.G. Coleman, 2010).
In bad encounters with citizens who obviously need help, most police officers automatically draw their handgun, as if they are not trained with other methods to de-escalating a situation. There are designated mental health officers, although everyone should be properly trained for the job. There are mobile crisis team which the officers who get dispatched travel with a nurse, social worker, or any other mental health professional (
D. Cotton and T.G. Coleman, 2010). Communication is a very important strategy one may have, some people who need help all they require is someone to talk to. Javier did not like that he was going to be searched, but the officer should have reacted differently and not yell and draw his gun. I do not believe the officer in the video had no control over the situation, walking on the freeway with cars going at a high-speed pointing his
firearm carelessly. Communication helps speaking in a calm manner would have helped, this officer started yelling profanity did not want to de-escalate the situation. All bystanders were in danger if the officer would have taken his shot and missed who knows where that bullet would have landed.
