2 Cyberlaw Chapter 12 Improper management of client information, particularly personally identifiable information (PII), can have serious consequences for businesses. PII includes any data that could be used to identify an individual, such as a person's name, face, or phone number, but it can also include IP addresses, web browser information, and even GPS coordinates (Kline, 2020). Concerns about identity theft and data security may prompt government agencies such as the US Department of Homeland Security, HHS, and the FTC to investigate PII-related malpractices. Companies that are found guilty face significant fines, with Safeway being fined $9.87 million for mishandling pharmacy records containing PII. The FTC may impose penalties of more than $100,000 in cases involving financial information. Companies may be required to compensate clients in addition to regulatory fines, particularly if they promised information security. According to the Attorney General of Texas, businesses that provide explicit assurances about information security may face fines of up to $20,000 per violation, in addition to general oversight penalties.
